"Prosecutors have filed a motion asking that information found during a search of the cellular phone owned by accused murderer Patrick Smith be sealed “until such a time as an indictment is returned by the grand jury or this case is otherwise disposed of.”
Whats that about!

Allegedly, One of them girls gave Patricks phone number to the Whitesburg boys. Those boys were calling Patrick and James and threatening to kill them. That's why the prosecuting attorney's office does not want it to be released and used in court. They were threatening them before the fight ever took place. James and Patrick were trying to avoid the altercation in the first place. Them boys from Whitesburg went looking for them. NOW!!! There ya go. Chew on that FACT for a week or 2 and spit it out. Um, usually if you go looking for trouble you will find it.

Really??? Trying to avoid the altercation traveling from Pikeville to the big town of Whitesburg (lol)??????? It seems more like the Pikeville boys came looking trouble, grown @ss men fighting with college kids!

Now if one of the girls had trouble with the he-man wannabe , costume wearing freakshow, then it was likely valid, you could see on his FB what a psycho he was.

Also, I highly doubt Michael would have threatened to harm anyone, much less kill someone. Wait, the character of Michael and the murders will be scrutinized in court. He was an outstanding young man that any parent would be extremely proud of. Unfortunately , he ran in lowlifes playing dress up and has been in a cold grave now for 33 days!

Sounds to me like it was 3 on 1 and james was defending himself. Why don't all you people do some research on mike? He is not so innocent. Non of you are! If this is open shut case, then why hasn't James & Patrick been indicted yet? Why are they holding information on Patricks phone until after they go to court? James would not fight over some random girl, cause he is crazy about Nicole. Anyone that knows them knows how he feels about his wife. They didn't print in the paper that one of the victims was arrested for resisting arrest and disorderly conduct. The paper got a big story and went with making James and Patrick look like horrible people when that's not the case. Small town something goes down and everyone assumes. Assume makes an a$$ out of you and me.

I know James and have for awhile , I don't care for him though I will say he wouldn't take someone's life without it being the last option for him to live. I don't particularly like him but I think he felt very threatened by those boys or he wouldn't of some what he did.

have you ever been outside of letcher county? last time I checked no passport was needed to travel from whitesburg to Pikeville. I go from Whitesburg to Pikeville so does that mean I am looking for trouble? As far a highly doubting that MIchael would have done something, there is this little thing called evidence, you don't base decisions on what you think. only the evidence that is available. The character has nothing to do with the victim or accused. It only the facts of that night. Yes the accused is very weird. However that is not evidence of a crime. This is not an open and shut case.

Suspects plead not guilty of New Year's Day murder
Where's the story? 14 Points Mentioned
Letcher County Deputy Sheriff Mickey Stines guarded defendants Patrick Smith, left, and James Richard Huffman IV during arraignment Thursday in Letcher District Court.(Mountain Eagle photo)
The two Pike County men charged in the New Year’s Day murder of Michael Shane Hogg pleaded not guilty Thursday at arraignment in Letcher District Court.
James Richard Huffman IV, 34, of Pikeville, pleaded innocent to murder, first-degree assault and second-degree assault in the early-morning stabbing death of Hogg, 24, a Kingscreek native who was home on winter break from Eastern Kentucky University in Richmond.
Pleading not guilty to charges of complicity to murder, criminal mischief, two counts of carrying a concealed deadly weapon and tampering with physical evidence was Patrick Smith, 27, of the Greasy Creek area near Pikeville.
Letcher District Judge Kevin Mullins set preliminary hearings for Huffman and Smith for 3 p.m. January 9. Mullins also ruled during Thursday’s hearing that both men, who are being held without bond in the Letcher County Jail, qualify for assistance from attorneys with the Kentucky Department of Public Advocacy.
Huffman is accused of stabbing Hogg in the chest around 2 a.m. Wednesday during an altercation near the entrance of a parking lot on Hayes Street, also known as Back Street, in downtown Whitesburg. Two other Letcher County men, David Christopher Puckett, 23, of Jenkins, and Stacy Phillips, 23, of Thornton, also suffered stab wounds during the altercation. Puckett was treated at Holston Valley Hospital in Kingsport, Tenn., but was later released. Phillips was treated at Whitesburg ARH and released.
Authorities found Hogg, Puckett, Phillips and Samantha Mullins, 23, of Wise, Va., in a disabled vehicle in the parking lot of the Letcher County Recreation Center on River Road in Whitesburg after a call was made to 9-1-1. The four were trying to get to the Whitesburg hospital for treatment, but the vehicle’s tires had been slashed. Huffman and Smith were later taken into custody in the recreation center parking lot.
The victims of the crime had been celebrating the coming of the New Year earlier in the night at StreetSide Grill and Bar on Main Street in Whitesburg. Video surveillance recorded at StreetSide shows no sign of an altercation occurring there or the presence there of either Huffman or Smith, owner Charlie Wright said Wednesday.
Smith, who Kentucky State Police said was holding the knife used by Huffman, was originally charged with carrying a concealed weapon and tampering with evidence. The complicity to murder and criminal mischief charges were added before Thursday’s hearing. The mischief charge indicates that investigators believe that Smith is the person who flattened the tires on the vehicle occupied by the victims.
Authorities have not released what they believe is the motive behind the stabbings.
Funeral services for Hogg, son of Don and Connie Frazier Hogg of Kingscreek, will be held at 1 p.m. Saturday at the Whitesburg First Baptist Church. Visitation, also at the church, will be held Friday from 6 p.m. until 10 p.m. Letcher Funeral Home of Whitesburg has charge of arrangements
any new updates on this, did James and the other guy get off with a warning again?

<quoted text>I believe, by "kid", they just meant, he was young and had his whole life ahead of him.
He had a bright future, and believe me, a good prosecutor will make sure that point plays out thruout the trial.
This will be the emphasis for a murder conviction. Yes, they were all in the bar, but like I have stated, I have been to Streetside, a few times in fact and it isnt a seedy place, no underhanded activity going on there.
It is a nice clean place to have a few drinks and even a great meal, alot of people go there for the music, they have bands there often.
Any of them being in the bar shouldnt be the main focus of this issue.
It was New Years afterall, they were all young and out to celebrate.
The murdered man in all likliehood was no way involved with this group until they left the bar and seen what was happening, he might have even been called out to for help.
Maybe that will come out in the trial.
I do hope the MURDERERS, AND I MEAN BOTH, get the maximum sentence for this crime.
i Cant find any new updates on this,
