Courts don't want to fool with topix comments cause they are so many that they would overwhelm the court system and you can trace to a general area but not a specific house or computer so you still could not prove it in court. Sorry

If you have the cash, yes an attorney can trace it to the internet account in which it was posted from.

For example: This might be my computer, but if my internet account/bill is in my wife's name then it is traced to her.

For those of you that didn't read The Sunday Edition of The Courier Journal, maybe you should. That story will make one think twice about posting slanderous and negative things on here. They did a two page story about Topix and how comments played a part in the murder/suicide of the four family members in Indiana. They also reported about a huge monetary figure won in a lawsuit and was awarded to a guy in Bowling Green,(I think). The female had posted that he was a pedofile and drug user causing him to lose his job. His attorney supeoned Topix to release the poster's IP address. The names of both parties were mentioned, so we know this is an actual lawsuit.

The Topix website has never been sued. They are not held liable for the speech of others. However, they could become involved if they refuse to release information that is court ordered. Having some knowledge of the law, I see more and more of these cases going before the judges. It definitely is possible to get trace comments made on here. Don't worry about not having money to pay an attorney. Most of them will take a case on contingency.

It's not really the matter of retaining a lawyer though, I Spy that's the major problem. It's getting a Judge to actually issue the court order / subpoena
to access Topix ISP records. Such cases are usually
so flimsy and built upon a house of cards to start with that most Judges are reluctant to issue such an
order. After all, the ISP records will only reveal the physical address of the computer used or the internet account holder's name and in no way directly implicates who specifically used the computer to post the comment in question.

If a certain person had vast knowledge of the internet and computers you would be amazed at what they can find out. I believe the layman term for such people are called "hackers". Which of course is illegal and no one would openly admit they can do such a thing but you would be surprised at just who CAN do so...yet never speaks of it.

YES-- you can trace topix or facebook comments, I just did. First ask the county attorney for an investigation , if the postings are deemed slanderous or illegal, issues subpoena to topix or facebook -- they are more than glad to tell you who created the facebook account, gmail account or topix Isp address which is linked to owner of computer -- confiscate computer and check tracking cookies--- cannot be deleted from computer. cost me a little time and money but can now send them to prison for several years.

Your life has to be threatened. No, attorneys do not take it on contingency. Most will not even bother with it. They pretty much laugh at you. Threats have to be made before anyone will even listen to you.

That is not what the story in The Courier Journal stated....I must disagree with you on all account based on what I see in my workplace. I'm anxious to see where some of the pending lawsuits go now that so many folks are aware of the possibilities.

It is so easy to do Forensic computer work. Even when a proxy server is used. It is easy to trace back. computers, cameras, printers, cell phones ect all have a built in "fingerprint". Big Brother's watching

I'm amazed at how big some peoples egos are. Or rather, fragile. I mean even on the off chance you do somehow find out who it is and manage to take them to court, what do you thinks gonna happen?

They're not going to jail for slander, and suing for pain and suffering, well you're going to come up short. 90% of judges are going to laugh this crap out of court if by some miracle you actually make it there in the first place.

The point what many of you are missing is the actual
legal process. Say you are successful in retaining a lawyer ( money spent ) and getting a Judge to order
an ISP Record subpoena ( VERY unlikely ) and finally
get Topix records..what do you think ANY court of law
is going to do? Even IF someone is convicted they'll
never see a day in jail, if anything and at most it
will be some fines and MAYBE some type of probation. I am sorry to burst your bubbles but there are very serious crimes out there occurring and the jails are
already packed past capacity as it is, no one is going to jail over anything posted on Topix.

If a lawyer agreed to handle my case against something dispicable someone posted on TOPIX, I would take stock of this lawyer because the lawyer might already know my case is a losing venture, yet decides to handle everything for me to include as much of my money as possible. Best to you.

The court case I'm involved in starts soon so I may have a more definitive answer to the original poster's query soon from my own personal experience. I will keep you posted.
