It does not matter how she did it, if she was in a fit of rage, she killed an incent child, a baby for Gods sake, I am sure if she killed your baby even in a fit of rage you would kill her yourself. I've been a way from this forum for a long time now because the case was in a state of limbo. Can anyone bring me up todate regarding Cathy having a new trial? Or has a court ruled anything new after the doctor in the case had his doubts about the injuries surfered by the child. If Cathy intentionally killed Brandon, she should face the death penalty. Has that been determined? I was corrected a longtime ago regarding Texas Law, that anyone who kills a child under a certain age is guilty of first degree murder and faces the death penalty. Is her conviction still first degree murder? Thanks in advance to anyone that replys be it pro or con.
Allow me to correct you again: In order to earn the death penalty, you must be found guilty of first degree murder and have a special circumstance alleged and proved. In Texas, the murder of an individual under 6 years, is a special circumstance.
There were hearings in January and February where the defense was allowed to present additional evidence and the prosecution was allowed to rebut that evidence. As previously stated, the hearings went very well for the prosecution.
The judge will prepare a memorandum of findings of fact and rule on whether the defense have met their burden for a new trial. My opinion, they have not. And if any one had any doubts about her intent, they will no longer after the opinion is published.
The execution date will be reset, Henderson will appeal to the 5th Circuit COA and the USSC and lose. She probably has another year left to scam people.
Hi emwolb, Thank you for the correction regarding the death penalty in Texas regarding the murder of a child. Also, thank you for the update. The wheels of justice move slowly, and in some cases rightfully so. The greatest injustice in America is to put to death an innocent person. If it is proven beyond all reasonable doubt that Kathy is guilty of first degree murder then she should definitely be punished in the appropriate manner: Death by lethal injection. Your estimate that it will be another year before she is executed is very likely to happen. For the victim's family it will be justice served, but not soon enough. If Kathy lived in California her appeals process could drag on for 20 years. Right now there are over 650 people on death row in California. Most of them will die of old age before their sentence is carried out. Very unfortunate for all the victim's families. Also, many states are dropping the death penalty because of the high cost. I'm happy to see that Texas is not one of them. New York state whimped out years ago after having a death penalty on the books for a brief period of time after Mario Cuomo left office as the governor. Again, thanks for the update. Joe: In these hearings the prosecution managed to demolish the defense experts and produce credible evidence of their own that the baby had at least 3 points of impact on his skull. Linear fractures are caused by dropping or falls. However, Brandon's skull had multiple crushing fractures which are caused by being slammed against something hard or stomped on.
As to Dr. Bayardo, he testified that the defense attys invited him to dinner and then dropped all these studies on him, that he admitted he did not have the background to interpret. He was told that he had made a terrible error and he could rectify it by signing an affidavit backing away from his trial testimony. At the hearing, he came across as confused and senile.
So, unless Henderson can convince the judge that there is a greater than 50% chance that the jury, after hearing about the 3 or more points of impact, would not convict her, the execution date will be reset.
Another way to put it, is if the judge finds that only 1 reasonable juror would convict, she is not entitled to a new trial.

In Cathy's letters she writes to all her supporters, she speaks of her life behind bars and asks for money to be sent...Apparently she has a tough life...Poor Cathy...Religious quotes she adds to her letters leads me to belive she is quite religious...Did she ever hear of "thou shalt not kill"? HIPPOCRITE..Babies are a special gift from god, and how could anyone hurt a precious little one let alone murder one...She was trusted,and Brandon depended on her for care, to keep him warm and feed his little tummy,and a little baby talk ccochie-coo...and to hold him close.. a hug or a kiss would have been much nicer, but what did she do...When a baby is held its done carefully, and held close,so there are no accidents...she just didnt care...The message that is being sent here, is not a good one...Lucky for her I am not her judge as she is a waste and should have served her sentance a long time ago, as she still goes on lying and decieving people associating with this mess...What a bunch of fools, and what are they thinking to actually believe her...Just be done with her, lets not inject her, but lets hang her...I'd love to see a rope around her neck and feet dangling... and her final judge will send her straight to HELL...This is a BABY she Murdered..Theres right and wrong and should be no fine line between, it's just not acceptable...Cathy is just a waste of time, as her supporters who should find better things to do with thier time...Maybe her supporters should visit a newborn nursery and feel the joy all around...actually experience the smell of a newborn baby's breath, or maybe even a NICU where sick little babies fight for their life,and nurses put every effort to care and help these babies...Dropping them on the ground would not be acceptable and they certainly would pay dearly for an action like that, as should Cathy...What is wrong with you people???? I came across this thread a few days ago and have managed to read it from start to finish. To the all the Baugh family..I cant for one minute,imagine what you have gone through all the years since your gorgeous little boy was so viciously taken from you. I'm a mother of four and my heart cries for Brandon(I also have a son with the name Brandon) and for your whole family. My warmest wishes for you all. I need to be honest and say that Im undecided on the death penalty, but also need to be honest in saying that I dont see another way for you all to be free of this baby killing monster. It would be horendous to see her released. To john mark and whoever else you call yourself...I am very, very serious when I say that I believe that you really do need professional help. Shame on you!!
yes Baugh, feels like starting over, this time there will be a defense, not you, and Keel, and the Judge, having a barbeque togehter with Hendersons Lawyers validating the death sentance, this time; its on a level field.
