750.324 Negligent homicide; penalty.

Sec. 324.

Any person who, by the operation of any vehicle upon any highway or upon any other property, public or private, at an immoderate rate of speed or in a careless, reckless or negligent manner, but not willfully or wantonly, shall cause the death of another, shall be guilty of a misdemeanor, punishable by imprisonment in the state prison not more than 2 years or by a fine of not more than $2,000.00, or by both such fine and imprisonment.

Im not sure what to think of this.... What did this 91 year old do so that would make an accident turn to negligent homicide... and accident is an accident, unless of course he was drunk or something like that... but the guy is 91... thats Probably not the case.

I agree he should not have been on the road....but he was! and he should be treated the same as anyone else.

Juno, you have no idea what you are talking about. A woman in Holland served 18 months and I served a year. There is definately jail time!

The man that died is related to local law enforcement. Their is no local justice, just retaliation.

How about you hook a computer to the ignition of the vehicle and the elderly driver must make it though a maze similar to the Zelda game before the computer allows the vehicle to start, Just like the one you had on your car to detect alcohol.
