If someone is harassing you and you tell them to leave you alone and they still don't stop, then how do I go about getting the law involved? I went to a JP and the secretaries tell me they don't do it in their office, I go to Hector's and they don't do it either. My question is, do I come back and ask again when I am dead from violence or what? Just asking. I plan on calling the judicial board to find out why these elected officials don't do their jobs. If anyone knows the steps please let me know.

Why don't u Google it under how to obtain a protective order in Texas all info is on there. Most protective orders are issued for domestic violence or on a ex spouse. So if u are just being harass without an actual threat or no evidence or pretty much Sol

If the person is harassing you through text or any way thru technology you can show the police and they should be able to make a harassment report and maybe issue a protective order if they are threatening you. I know once my ex text me and I told him to stop and he didnt and the police called him and told him he was harassing me and once he was told to stop that he needed to. And that was like three years ago. I would go to the police not an attorney. Sad thing is it usually does take for something physical to happen for anyone to pay attention.

I'm not absolutely positive but you might be able to do something about it if you just go straight to the cops make a statement and ask them where to go about on making a restraining order...the cops are located by the lights...on oak street the first traffic lights farthest away from Walmart its a little building to your right going south but your left going north...hope you get the help you need.

Isn't this America don't we have the right to free speech or is this a Communist country unless there was a terroistic threat against you or you were physically harmed hope it works out for you just grow up and ignore the jerk good luck to you

I had police reports, and evidence in text messages of harassment and Hectors office took an application and never followed through with any of it.

everyone interprets harassment differently. some people think that if you look at them cross eyed it's harassment. the law specifically defines harassment. you also have to have some kind of proof they can't just take your word for it. look it up and if what's happening to you doesn't meet the elements then it's up to you to get a lawyer and try to get results civilly . some times we have to handle our own business and stop trying to let others do the dirty work.

The Texas penal code does outline harrasment as :

ยง 42.07. HARASSMENT.(a) A person commits an offense if,
with intent to harass, annoy, alarm, abuse, torment, or embarrass
another, he:
(1) initiates communication by telephone, in writing,
or by electronic communication and in the course of the
communication makes a comment, request, suggestion, or proposal
that is obscene;
(2) threatens, by telephone, in writing, or by
electronic communication, in a manner reasonably likely to alarm
the person receiving the threat, to inflict bodily injury on the
person or to commit a felony against the person, a member of his
family or household, or his property;
(3) conveys, in a manner reasonably likely to alarm
the person receiving the report, a false report, which is known by
the conveyor to be false, that another person has suffered death or
serious bodily injury;
(4) causes the telephone of another to ring repeatedly
or makes repeated telephone communications anonymously or in a
manner reasonably likely to harass, annoy, alarm, abuse, torment,
embarrass, or offend another;
(5) makes a telephone call and intentionally fails to
hang up or disengage the connection;
(6) knowingly permits a telephone under the person's
control to be used by another to commit an offense under this
section; or
(7) sends repeated electronic communications in a
manner reasonably likely to harass, annoy, alarm, abuse, torment,
embarrass, or offend another.

UNFORTUNATELY,#1 can go both ways. If someone text you something and you text back, you are both harassing eachother but in Pearsall, they don't investigate properly and it won't take much to get harassment charges filed... my advice would be to talk it out with this person and if they don't want to settle things... plainly ignore it. Eventually it will go away. More than likely if they are harassing you, they are hurt by something you did, so make sure not only to point the finger.. remember to look at the 4 pointing back at you.

Freedom of speech doesn't cover what you think it does. Read the Bill of Rights first then bump your gums. Also of you're told to stop calling someone and You continue it is harassment. Speaking of the constitution, everyone has a right to know who is speaking ill of them. And freedom of speech doesn't cover anonymous entities.

Because they aren't the proper route. You need to go back to Pearsall PD and tell them you want to file charges for harrasment and want a warrant issued for the person's arrest

to the right offices unless they know the
other person and are protecting them which
is usually the case. If they don't know
the office they should direct you, then
they shouldn't be working there, those
officials should hire competent people that
know their jobs instead of morons.

Free speech has limits. Sounds like your one to harras and stock people. I dont know this person but if you are being harrased cussed at stocked. When a person doesnt stop ignoring wont do stop them. Why wait til physical harm is done. When things could have been prevented. Make statements everytime you get harrased. Make sure you get copies of your statements keep for you records. If anything goes wrong and cops try and deny you ever made reports you have proof. Its sad that our law enforcement dont do their job unless getting paid under the table. They wont even turn on their camaras in their vehicles only when they feel like it. A waiste of our tax payer money. These so called JP Elected official need to step up and do what they were elected to do. Not when they feel like doing it

I disagree with you "Hmmm". There's usually 2 sides to every story and while I believe people shouldn't be harassed, there is a fine line. Simply calling someone a b**** or an a**hole could be considered harrasment. I don't agree with that. But if someone threatens to go slash your tires- that is way different... Anyway.. it's no skin off my nose

JP's office handles traffic violations, civil matters such as evictions & small claims. They also issue warrants on complaints brought in by officers. They do not have the authority to issue protective orders or restraining orders, though people think cause they do. It is only common sense to call a police officer to take a complaint and if there is enough evidence then he will take complaint and follow through and request a warrant and protective order if needed. People shouldn't assume that judges have full authority to do motions on there own. Complaints must be file in order for a judge to take action. So its not that personnel is not competent its they are not allowed to give out legal advise and that is a law and can be confirm through the judicial committee judge and staff ARE not allowed to give you legal advise. You must obtain advise from a license attorney.

They all have given legal advice judges and their secretaries. as for the JP not being able to do protective orders is not true. They do deal with them who do you think signs the orders. Of course there is a process but in the end the judges are the ones who sign off on the orders.
