Its makes you wonder about our system, Jerry I have been waiting 7 years. The last time I called my attorney I ask what category my class my case was in and I probably was talking to an aide, he said I have no idea what I was talking about. Unfortunately it too late to change attorneys. I will be calling again this week and demand that I speak with attorney this time and see what happens.

If this wasn't so serious, it would make a great movie of unfortunate incidents. I had no idea of what my case was valued at until about 8 months before it was settled. I called the attorney at the bigggggg firm and he answered the phone himself. He told me he would have to call me back with that info. At least now he knows not to answer his phone.
Mostly during the whole time, I heard "I don't know" and "I'll call you back" I must not understand or I'm stupid. When someone says "I'm going to settle and pay X amount to the defendants", doesn't that mean they have agreed to pay you and they will be in touch with your attorney? I include all of you in my prayers and hope you get this over and done with soon. God Bless

Randy, The settlement wasn't great but the attorney's office pushed for no repayment to insurance companies. So I got a little bit more. I did buy a brand new car and move and the car was not an expensive one. But Thursday, I'm having hernia repair and the Doctor is going to put a new mesh in. Wife has form all fixed up to get all of the important info and wants him to sign it. I may wish I didn't do this but there could be a big problem if I don't.

good luck with your surgery. I've had 3 and need another. Not looking like mine will settle any time soon. Cant get any info out of my attorney.

Ten surgeries. Three times mesh was placed,problems developed. Drs would go back in to fix it. One mesh was in for almost a year. It balled up around my intestines. Part of my bowel had to be resectioned. I'm giving it one more shot. I've had so many bowel blockages, wife had a bag packed beside the door. Y'all take care and God bless you. It doesn't matter how big the settlement. It's not enough for all the pain and suffering.

I spoke to my atty. last Fri. She was taking stuff home over weekend to work on. Says we are getting closer to settlement. Just waiting for the new counteroffer. Like "Thank God" said, no matter what it is it will not be enough for all this pain and suffering. Life will never be the same. I'd be in good shape if it were not for "MESH". I won't take pain meds. so I drink. Depending on my pain level, it may be a Vodka night or a wine night! I live alone so no one to do my work at this house but me.$$ won't take away pain, but it will help me financially. I feel bad for anyone who is dealing with all this pain from mesh. Those bastards should have to go through our surgeries to find out what it is like. My prayers are out there for everyone involved. I'll keep all informed as I hear something.

Wow, my husband just got the papers in the mail for the next to nothing settlement what a joke. All the pain and suffering he went thru and hospital bills and surgeries and that's it? He's so disappointed. Why even sign. He's waited seven years!

I spoke to my atty. last on 4-7, was told they are still doing counter offers and trying to get the most $$ they can. Suzie you are making me real concerned. I know these cases are in different classes so not sure what class your husband fell into. I thought (5) years was a long time and now I see your husband waited (7). I am now having problems with the Parietex mesh that was used on last surgery. Not sure where or when this will all end. Can't your husband hold out for more $$? What happens if he refuses the settlement? My prayers are with you. After awhile you just wear down.

I received my settlement offer letter today. All I can say is this an April Fools joke? My god, this amount does not even begin to cover my loss of income during all my surgeries not to mention how my entire life has changed because of this crap.

Sooooo spoke to my attny . Finaly its normaly paralegal , not in the loop admin or answering service. I went in as a catagory 1 got a offer in Jan that cat 6 were recieving and was like NO finaly talked to someone who says they are actualy a attny. You have to have hard proof evidence ( pretty much removed mesh in hand or Doctors notes documenting BARDS product ) to confirm that it was their product that caused damages. It cost to much in depositions and court cost for representation to fight mfg . Soooo you get offerd a small amnt not even close to what damages we have incurred or court mattrix, and law firms accept or encourage you to accept stating that " we could lose if we go fwd ' so take what you can get . Win situation for law firms all the way around. Minimal work for attnys. File a couple of docs and respond to a couple of letters 1/3 of your settlement and they are good to go Kinda like a legal ponsey scheme.
I am just now hearing all this after several years of waiting and asked why did you even take my case in the first place and response was ' just be happy you are being heard ' Take what you can get . Which at this point i am happy to do . Tired of this whole mess.
For reference I had 6 surgeries and obstructed bowel resection. My stomach area looks like a rode map with divits and scars all over.:(

Very sorry your having more trouble. Just don't expect much. You could hire your own lawyer if you can afford it and if you can find one that will take the case. My husband is tired of it after seven years and felt he would get nothing if he didn't sign so he went ahead and signed it. Saying a prayer for you too.

You would think they would at least cover the cost of the surgery to remove them. My husband had two put in him that had to be removed!

What I don't understand is they want to pay my insurance company back out of my settlement yet my medical has exceeded the 6 figures and they are offering 5 figures so basically I'm going to have to pay out of pocket the remainder of my medical. How is this fair?
SMH ... I too have a road map on my abdomen and a am permanently deformed. I have lost the ability to have sexual relations and I'm still young. This is not fair for me or my husband. We have asked other attorneys to represent him for loss of consortium but they tell him my attorney should have claimed this in my case. I'm just so lost with all of this and our judicial system.

They have put me in category 3 because they had no proof the ring broke but I do have confirmed fistula, fold, balled up, wrinkled mesh with permanent damage. The last surgery the dr had spent 8 hrs in surgery removing tissue that the mesh was so embedded in that he had no choice. If the ring didn't break then how did this mess happen?
I told my attorney I want a trial. I want to tell a jury my story of how the drs say I'm a miracle to be alive.

Well, just got call from my atty. What a slap in the face! After 5 years, all this surgery and still having problems, my settlement is about enough to buy a rundown shack! I tried to ague with him but attorneys have an answer for everything. He said if I refused the offer and took it to court I could be slapped with allot of expenses and fees and end up with less. The other atty. I had been dealing with left so I am left with this one to deal with. I finally agreed. What else am I going to do. At 67, I am finding it hard to keep up with my home maintenance so looks like I will be making big decisions this year. These mesh cases are a joke and the only one getting rich is the attorneys. Oh, by the way my case was classed as a 2. Good luck to everyone else.

My wife has been dealing with these issues since 2005. Her case is class 3.
She received a letter last week with a proposed minimum settlement amount. It is much less than what she was expecting. Our lives have been destroyed and she may end up with enough to buy a used car.
She is permanently disabled and disfigured, endless hours in the ER, multiple hospital stays, and of course the ongoing issues she will face for the rest of her life. I'm sure you all know how it is.

Nearly 10 years of our lives we will never get back. For chump change. A terrible thing.

To South County, I can certainly sympathize. I am so sorry for your wife's dilemma. We live in a great country, but there is so much crap going on in the medical community that is simply disgusting. So many people miss DX and others having surgeries that destroy their lives. My mom was a vibrant lady in her elder years, but was killed with pills. I won't hardly take a pill after I saw what she went through. People are quick to judge others, but a walk in our shoes might make them see things in a different light. The small $$ we are getting is nothing. We all suffer now from both physical and mental pain. The good ole USA atty's and corp's are the ones getting rich. My prayers are with everyone dealing with this mesh mess.
