we spoke to our lawyer the other day they turned down an offer that was a little more than what the big settlement was when you broke it down they said that amount was not good enough for the injuries that my wife has.

I spoke to Atty. Jacob Flint in St. Louis on 2/27/13. Said he had been talking to one of the attorney's for Bard and was getting ready to make a demand and wanted to touch base with me to see what I would be willing to settle for w/o going to court. He thought I would be better off not to go to court as no way to know how long it could go on and what the final settlement would be. After talking he was going to call the attorney and call me AM. Never did hear back so I called him on 3/13/13. Said he was having a hard time tracking attorney down and was to talk to him that day and would call me as soon as he knows something. To date I have never received any further calls. I had a ring break and I am in constant pain, but my hopes are diminishing that I will ever actually see any $$. There is always an excuse. Very frustrating and depressing to be treated like this.

I guess I could fire him but then they have all my medical records and I would be starting afresh with a new law firm. I don't even know at this point if anyone else would take it. It should be a clear cut case when the medical records clearly state " the ring was broken". My only salvation was that it was in fatty tissue and had not punctured a vital organ. That did not ease the pains I was having and now after all these surgeries I still have pain. I am hoping soon there will be a settlement. If I don't receive contact again very soon I will email him. I have all my past emails as a record.

Take 5 minutes per day and send him an email, copy the local barristers society, consumer protection agency, or newspaper. Lawyers do not like bad publicity.

Jean, was told possible end of month but possibly May. I'm contacting my lawyer for updates every two weeks. We just want closure. My Lawyer has been great. I've contacted the main lawyers a few tines, too. Remember, your lawyers are working for you, for a good sum of money. They should treat you nicely and answer your questions without making you feel bad for asking. You have a right to know where things stand, etc.

Thanks "Wants This Over". I agree with you. They get a big chunk of any settlement and they are not the ones suffering from the Mesh. I plan on calling mine tomorrow. I did not realize we could call the main attorneys. Would that be Donald Migliori or Leah Donaldson at Motley Rice?

yes. They are the ones informing your attorneys. Very nice people. If you email with all of your info they will reply or call.

After I sent a long email to my attorney last Fri. he called me and apologized for not contacting me. He said the other side won't settle until all of his clients at his firm are settled on. He is telling me this will be all over w/n the next 6 to 8 weeks. I certainly hope so.

Jerry, I would put in my calendar and follow up with him in exactly 6 weeks. They need to know you are on top of this. If nobody is bugging them they will work for their clients that are.

Jerry, unsure of who your firm is but I was told all had signed off and the paperwork was all in, thus the settling of the 10 percent. Unless you are in a different group awaiting your first settlement this is confusing me. I was told by lead attorneys they had everthing now with our group so hopefully you get clarification and settlement soon! Keep us updated. I'm contacting my attorney again Monday for another update. We are supposedly scheduled to be finished with ours within the next 2 to 4 weeks. My Mom died over this, my Dad is very, very ill and I'd just like to see it settled before he goes. He deserves to see this finished after what we have all went through. Good luck to all of you. I've got mixed feelings about all of this, it's really hard to be ok with anything about it at all...even after a settlement :(

This would be my first settlement. I have not received "anything". I have been communicating with my Atty. Jacob Flint at Carey, Danis, Lowe in St. Louis. I usually email him and save these for my reference. I have a whole file full of STUFF. I assume he is in communication with the other side. If he isn't then he would be lying to me. It is in his best interest to get all the $$ can so they will get a larger piece of the pie. They get a large percentage. He does seem sincere at this point, but after 4-1/2 years I am still nervous. The $$ won't make my pains go away. I would much prefer having my life back the way it was before surgery. I have my calendar marked for the 6-weeks. Time will tell. I'll keep all posted.

My case was scheduled along with all other cases my firm is representing for settlement confrence well over 1 month ago. I have yet to hear anythimg from my attny . All e mails and calls are being ignored. It was suggested on this site to contact The lead at Motley Rice and they may have some information. Does anyone have e mail for Mr Miligori ( spelling )Also what info they would need. Seems like " The silent treatment" is common practice from reading posts on this site.
Has anyone been explained why this seems to be common practice to ignore clients after going to settlemnt confrence ? I would hate to think its because they are just being rude, and moved on to bigger and better things Attnys are making a bundle off of each client and we deserve better than this
