Surely you're not serious. The city of Paris is not immune from lawsuits. They've been successfully sued multiple times.

I know a lot of people who have sued the Paris police dept and either won or settled. Couldn't find cases online but this but I know a lot of people who have done it.

"A federal lawsuit filed in U.S. District Court for the Eastern District of Texas Sherman Division against a Paris Police Officer Mike Ford was settled out of court for $30,000 in October 2007. The lawsuit filed in Feb, 2007 on behalf of Lesily Goodman, alleged the use of excessive force and assault and battery by Officer Ford during an arrest of Goodman. Goodman suffered broken rib’s, a punctured lung, and other injuries after Goodman was walking down a street and Ford ran up behind him without announcing himself as a police officer or asking Goodman to stop and slammed him head first onto a concrete curb. Goodman was taken to Paris Regional Medical Center where he was admitted to ICU. The entire incident was caught on police video.
Although the city insurer Texas Municipal League paid Goodman $30,000 dollars to settle all claims, the Paris Police Department “Internal Affairs” cleared Ford of all wrongdoing. Ford denied he had done anything wrong."

That is cheap 30,000 for ICU wouldn't cover but a day or two.

You are so wrong in your recollection of the facts of this case. Lesily Goodman was, in fact, drunk as a skunk and high as a kite. He has a well known affinity to "huffing fumes" of anything, paint, glue, etc. He still gets so wasted it's an absolute miracle he's still alive: his brain is rotted for sure.
As for him innocently walking down the street - WRONG !- he had just wrecked his vehicle, jumped out and started towards his home. It was witnessed that he was seen wrecking out and getting out of his vehicle, when the officer came upon him, while Mr Goodman was trying to evade his imminent arrest. He tried to lie about being in the vehicle, but in fact, that's where a majority of his wounds occurred. He cried "foul" when he was arrested and got some attorney to help him claim "his civil rights" had been violated. Ha ! It was exactly the opposite, he was infringing on the rights of all the innocent victims of his drunken tirades, and there have certainly been plenty of them.
This guy has been in prison for years, every time he's paroled, he screws up and gets sent away again. You forgot to mention he got prison time for that arrest,(repeat dwi) didn't you? You also failed to mention his violent domestic behaviour, whereby he has "literally" beaten his wives(at least four, possibly more), to within inches of their death. This idiot sure isn't the victim by any means whatsoever !
His lawsuit just goes to prove there are flaws in the courts, which allows for the perpetrator, to benefit at the expense of the victims in our society.
He may have gotten some cash for all his lies, but he's certainly not any better off today than he was after his "settlement". Sometimes, it is much less costly to "settle" a lawsuit, than to have a trial. And, he certainly did count on that fact when he began to pursue the lawsuit. He may have "won", but he didn't come out exonerated.

In general, cities are immune from liability. As long as the City is performing a government function it cannot be liable under state law, unless that immunity is waived.

The Texas Tort Claims Act states that governmental functions are those that are “enjoined on a municipality by law and are given it by the state as part of the state’s sovereignty.” The Tort Claims Act lists all the functions that the state considers government functions. While this list is likely only applicable under the Torts Claims Act, it is a list that is used frequently to define government functions in general and includes a non-exclusive list of 36 functions which lists (in part) the following:

* Zoning, planning, and plat approval * Garbage and solid waste removal
* Police and fire protection collection and disposal
* Health and sanitation services * Street construction and design
* Building code and inspections

The general rule is that as long as the City does not waive its immunity, it is immune under state law as long as it is performing a government function.

Are you claiming that if a city employee ran over someone with a city vehicle, the city wouldn't be responsible unless they waived their rights and wanted to be sued?
