Pullicino has extensively researched the issue and asserts that elderly patients, who could live longer, are prematurely placed on the LCP and it has now become an assisted death pathway rather than a care pathway. On average, patients submitting to LCP die within 33 hours.

Rochester teacher misconduct case is a perfect example of why tenure system should be trashed

Parents in the Rochester school district have had their fill of the bureaucratic nonsense and union protections that are giving dangerous teachers continued access to their children.

The final straw goes by the name of Valarie Yarn - a physical education teacher who district officials cannot fire despite credible allegations she stalked her female co-workers and used her position to force female students to undress for her hands-on exams.

"We will go upstate (to *Albany*) and see what we need to do there ... to get some legislation to protect students in our school district" if local education officials don't respond appropriately, he said.

His argument is fundamental to the safety of students and a productive educational environment. It's clear that the current system favors employees over the students they're entrusted to protect, Flagler-Mitchell said, and it's gone on long enough.

In a defiant raspberry to the city Department of Education — and taxpayers — disgraced teacher Alan Rosenfeld, 66, won’t retire.

Deemed a danger to kids, the typing teacher with a $10 million real estate portfolio hasn’t been allowed in a classroom for more than a decade, but still collects $100,049 a year in city salary — plus health benefits, a growing pension nest egg, vacation and sick pay.

Mayor Bloomberg and Gov. Cuomo can call for better teacher evaluations until they’re blue-faced, but Rosenfeld and six peers with similar gigs costing about $650,000 a year in total salaries are untouchable. Under a system shackled by protections for tenured teachers, they can’t be fired, the DOE says.

New York has no mandatory retirement age for teachers.

That let rubber-room granddaddy Roland Pierre make a mockery of the system. He finally retired at age 76 last year — 14 years after he was yanked from PS 138 in Brooklyn and never taught again. Criminal charges in 1997 that he molested a sixth-grade girl

Teachers Agree: Bad Apples Stay
A study conducted by Public Agenda in 2003 polled 1,345 schoolteachers on a variety of education issues, including the role that tenure played in their schools. When asked “does tenure mean that a teacher has worked hard and proved themselves to be very good at what they do?” 58 percent of the teachers polled answered that no, tenure “does not necessarily” mean that. In a related question, 78 percent said a few (or more) teachers in their schools “fail to do a good job and are simply going through the motions.”

When Terry Moe, the author of Special Interest: Teachers Unions and America’s Public Schools, asked teachers what they thought of tenure, they admitted that the Byzantine process of firing bad apples was too time-consuming: 55 percent of teachers, and 47 percent of union members, answered yes when asked “Do you think tenure and teacher organizations make it too difficult to weed out mediocre and incompetent teachers?”

The Bottom Line
Most teachers absolutely deserve to keep their jobs and some have begun to speak out about the absurdity of teacher tenure, but it’s impossible to pretend that the number of firings actually reflects the number of bad teachers protected by tenure. As long as union leaders possess the legal ability to drag out termination proceedings for months or even years — during which time districts must continue paying teachers, substitute teachers to replace them, and lawyers to arbitrate the proceedings — the situation for students will not improve.

Even Al Shanker, the legendary former president of the American Federation of Teachers, admitted,“a lot of people who have been hired as teachers are basically not competent.”
“The Rubber Room”One of the most scandalous manifestations of teacher tenure was the so-called “Rubber Rooms” of New York City. According to The New York Daily News, at any given time an average of 700 teachers were being paid not to teach (they instead reported to “rubber rooms”) while the district jumped through the hoops (imposed by the union contract and the law) needed to pursue discipline or termination. A city teacher in New York that ends up being fired will have spent an average of 19 months in the disciplinary process. The Daily News reported that the New York City school district spent more than $65 million annually paying teachers accused of wrongdoing, in addition to the cost of hiring substitutes.

After the embarrassing Daily News story and an expose in The New Yorker, the union agreed to end the practice but refused to expedite the dismissal process. Instead of whiling the days away doing nothing, the teachers were assigned to do clerical work and perform other semi-useful tasks. How did the union and its members respond? They filed grievances against the district.

Paying Teachers to Do Nothing
New York City was once home to the infamous rubber room — a place where teachers awaiting disciplinary measures were sent to twiddle their thumbs while still receiving full pay as their grievances went through the system — but now it has an even bigger problem on its hands: The city spends more than $100 million every year paying teachers who have been excessed but have yet to find jobs.

The ironclad union contract requires that any teacher with tenure be paid their full salary and benefits if they are sent to the “Absent Teacher Reserve pool,” according to The Wall Street Journal. The average pay of a teacher in that pool?$82,000 a year. Some of the teachers have been in the pool since 2006. According to the Journal, the majority of teachers in the pool had “neither applied for another job in the system nor attended any recruitment fairs in recent months.”
