Jury couldn't reach a verdict was split 9-3. 9 for 1st degree 3 for 2nd degree

he probably did it but he looks 12 so i guess the jury did not want to send him away for 40 years on 1st degree conviction

No there were three dumb asses that could not see the proof right in front of them. i was a juror and voted for 1st and stayed that way. when you have a confesion how much more evidence do you need.My deepest empathy to the victim's family hopfuly justic will be served.

To Pissed Off: I can see why you would be upset. First of all you took the time to do your civic duty (like you had nothing better to do)and then put up with "the three liberals." Why was it declared a mistrial instead of a hung jury? Feel sorrow for the victim's family my deepest sympathy.

Not sure why it was, that was the judges decision im preety sure it will go to a retiral. I mean it was clear as day that the reason for the murder was attempted robbery. The real thing that pissed me off was one of the three said that he deserves a second chance. And me having children of my own i thought what if it was your kid he murdered in cold blood for a stupid reason would you want him to get a second chance? People make their own choices and if you do a horrable crime you should get the MAX sentance possable even without the attempted robbery this basterd should be HUNG. just so its clear i was not using personal feelings in my decision the eviedence the prosecuter presented was way beyond a reasonable doubt to me.

Thank you for representing our American public in this matter. Many would see your viewpoint as conservative,but many of us see it as one way of making it clear to these criminals that our society isn't going to take this crap. Here in the AV it's gotten worse. The spin doctors will tell you in their stats that compared to last year many categories of crime are down, but you tell that to the victim's families. I agree with your feelings about if it was your own kid. This is a horrible loss to his family. Again, thank you for being there and making a decision that would have been many of our decisions!

Just so you know, this retrial is going on right now. I was a potential juror but they never mentioned it had already been tried once.

Trial is over. Trial previous is not mentioned to allow new juror's to start with a fresh slate, no influence by previous outcome.

Guilty first degree murder with special circumstance and knife use allegations found true. Sentencing on December 13.

Judge sentenced defendant to Life in prison without the possibility of parole.

Yeah!!! Now why in the hell wasn't that POS found guilty the first time around!! This sure would have saved us taxpayers a lot of money.

Ans to Sierra.. Few of the jurors felt that the defendant was young and should receive a second chance. ( Second degree = 25 years w/ parole ) Resulted in a Hung Jury.
