Wset Palm man rearrested in 1999 Palm Beach Mall murder case

Authorities on Friday arrested a West Palm Beach man who has remained a suspect in the slaying of a Chick-Fil-A manager for eight years. Although prosecutors dropped murder charges against Jesse Lee Miller Jr. in 2001, citing inconclusive DNA evidence, new information prompted a grand jury to issue an indictment in the May 1999 killing. 'I'm definitely happy he's in jail and that we're going to be able to bring him to trial this time,' Nancy Widell, mother of slaying victim Nicholas Megrath, told WPTV-Ch. 5. The sealed indictment charged Miller with first-degree murder, robbery with a firearm, burglary with assault or battery while armed with a firearm and armed kidnapping. Police found Megrath, 18, on May 1, 1999, sitting in a chair with duct tape around his hands, arms, feet, upper body and mouth at the restaurant in the Palm Beach Mall. He was shot in the head. Over the years, investigators have charged three men with Megrath's death, including Miller. Only one man, Otto Wright, was convicted. The third man, a Chick-Fil-A employee held in jail for a year, was released after a witness recanted statements that the employee admitted taking part in the robbery. A judge sentenced Wright to life in prison in 2003. Detectives interviewed Miller early in the 1999 investigation. Megrath's co-workers told police that Miller had a grudge against Megrath because he reported Miller for selling food after hours. Miller's hours were reduced and he was later fired. A restaurant employee told police that on the day of the killing, Miller walked by the front counter, pointed at Megrath and said, 'I'm going to get you.' Miller told police he was with his girlfriend when Megrath was killed. Police originally arrested Miller in September 2000 after a Sheriff's Office crime lab report found DNA that could have been his on a ski mask outside the restaurant. But later tests could not prove the DNA was Miller's. In November 2001, prosecutors dropped the charges against him because they lacked enough evidence for a conviction. On Friday, members of the Palm Beach County Sheriff's Office Tactical Unit and the U.S. Marshal's Service went to arrest Miller about 3 p.m. at his parents' home in the 800 block of Handy Avenue in West Palm Beach. Miller tried to run, and a Sheriff's Office sergeant tackled him, said sheriff's spokesman Paul Miller. 'We've been looking for him since April,' Paul Miller said. Authorities transferred Jesse Miller to West Palm Beach police custody, the agency investigating the homicide. 'He just arrived,' said West Palm Beach police spokesman Ted White. 'One of our detectives will interview him.' White was not aware of what new evidence or information led to the new indictment. According to the State Attorney's Office, one of its investigators developed new information with the help of the Forensic Document Examination Division of the Forensic Laboratory for the U.S. Postal Service. A spokesman declined to elaborate. In the past year, state records show Miller has been arrested on charges of violating probation and failing to appear in court on a misdemeanor count. I was Nick's step-father at the time of the murder. I can tell you the family went through hell. Nick was a great young man. Jesse Miller is just as guilty as Otto Wright. Maybe finally justice can be served and these two low-lives will get their just dues. And furthermore, Nick had not a racist bone in his body. The only racism is that of the black community trying to protect one of their own. Let justice be served whether one is black or white.

If you were arrested at a very young age and told to admit something in order to be released from jail what would you do? What gives anyone the right to blame anyone for anything without proof? Innocent people are murdered and innocent people are jailed. Who will defend these people? It is careless to blame people for something that can cost them their lives just as it is careless to take away a life in an instant. I pray that all who are guilty and all who are innocent receive swift justice!!!

Sad...Nick and some friends of ours all decided to get jobs at the mall at the same time. I don't know if this other person is guilty or not, nor do I prentend to know, but I look at the facts logically and make my decision. It's sad to see such a tragic thing happen to someone so young....

I would like to see this individual, if found guilty, to be broiled alive in hot chicken fat. It would make me feel better, and, it may send a message to other would be executioners that this kind of behavior will bite them in the nuggets.

My sincere condolences to the families and friends of the innocent victim, who died while working to provide for himself and his family. It is such a needless and senseless killing.

We need to show that Florida is not tolerant of this behavior.

All i'm going to say is that they had the right person the first time but let him going by blaming the wrong person and now this person has left state. I haven't been able to get a peaceful sleep knowing that the wrong one is being accused and the killer is on the loose. I'm just going to leave it in the hands of the Lord and pray that he works this out for the sake of the innocence since i'm too afraid to come forth.

I can understand why you would feel that way but, do you really know what happened and who actually did it? I will tell you this though they did have the right person the first time but let him go and now he's not even here now. I'm just going to leave it in the hands of the Lord for the sake of my life.

ok everyone who says that they are going to prey and let the lord do the right thing well all i am going to say is that the lord has spoken and the right guys are in jail if otto was not the right guy then the lord would have not put him behind bars now i am not saying otto was the one who kid my brother but he was there and he could have stoped it or left and now that they got the shooter things are coming to a end and closing will be here for my family

Bobby, Please don't let your anger cloud your heart. If you remember, I went to the mall and had the unfortunate job of telling your mother of Nick's murder. I was married to your mom even if it was a bitter divorce. I was involved in the whole process for two years after Nick's death. Nobody will ever take away the hurt and pain, but we can remember Nick for the fine young man he was. Let's pray you can follow in his footsteps and become an even finer young man and not allow all of this to bring hate out of you. I wish you all the best.

evidence is evidence. its 2008. research has developed new ways in the past 10 years to link defendants to the crimes they commited. its a sealed indictment so let the man stand trial. this should definatly be interesting since the EVIDENCE must be pretty convincing... getting a 2nd indictment after initial charges were dropped due to insufficent evidence is always harder then getting the first. besides... i dont know anyone who runs from the police when they are truely innocent. thats comming from 4 years of recovery work in palm beach county. let justice be served in palm beach county, palm beach county style!- liesse marshall

I knew Nick and his family and I prayed everyday that the true killer would be brought to justice, and that time is finnaly here. My love and sympathy go out to his parents, sister and brother and thier loving families who never had the opportunity to meet one of the kindest people I know.- Dom

As far as your comment "you don't know who runs from the police when they're truely innocent" well let me tell you that you don't know what the hell you're talking about because it's more to that then what you people think. You're just reading what the news article says and going by that but you really don't know anything. But like i tell everyone only Nick, God, and the people involved knows the truth.
