Looks like the company should be the one in the dock. Why is it ordinary people are punished for the mistakes corporations make? However, when the shoe is on the other foot the company tries to ignore it?

This man needs to be cleared as he did not steal a thing, the company failed to do their job. Should he have reported it yes, but he should not be punished for their mistake

This guy was getting paid around 100K per year for a company that he never worked for. He should have said something earlier even though it wasn't his fault. Prison time and criminal record is not worth it especially he has that kind of income potential.
