Kids do not realize the real life consequences that can happen once they post pics on their online social network pages or sending them through their cell phones. They are giving away rights to that picture. It is out there for all to see and do whatever they want with it. Parents need to be talking to their kids about not posting their personal information for all to see and that means their pictures. I know the kids involved in this and I certainly hope they do NOT get charges on their records, that will follow them for life. This is NOT child pornography. This are kids who made bad choices. Let them learn a lesson from this, not ruin their futures by charging them or shaming them. Officials need to know what the laws are out there for. They are there to protect our kids, not to punish them for being immature. I certainly hope law enforcement is not going to use them as examples. This will only cause more suffering, trauma and embarrassment. Not help them in ANY WAY!

I think if they were in possesion of child pornography, they should be charged with possession of child pornography!! The law does not state that those under a certain age cannot be charged. If they are not charged, than anyone should be allowed to be in possession of it, right? Thats what I though you would say.... NO!!! But it's ok if they are kids? Kids can't commit crimes?? Whatever!! These kids should be charged with possession, and be required to register as sex offenders, just like ANYONE who is in POSSESSION of CHILD PORNOGRAPHY!!!!!!!!!!

The child porn laws were written years ago to protect children from commercial pornographers who would force children into sex acts then sell the photos/video for a profit. The basis for child porn laws is they are kids and they are not mature enough to fully understand the implications of sex. They can not legally give consent to nude photos. The laws were designed to protect kids from adults. I do not understand a law that says you can't give consent because you are to immature, and we must protect you, then says you are adult enough to understand what you are doing and you should be punished like an adult. You can't have it both ways. In this case if they charge the person who originally sent the photo, they are the perpetrator and victim of a crime they committed against their self(possession of child porn). That's like charging a person who tries to kill their self with attempted murder. Doesn't make any sense. Lawmakers need to change the laws for juveniles and sexting. The intent of the law has not kept up with the new technology.

1 I had a long talk with my daughter after this story came out. I told her it was the equivalent of leaving her house in the morning naked from the waist up and walking to school and staying that way all day at school. If she is too immature to know that is wrong, then she should not have a phone that takes pictures. I agree with the others...the laws need to be changed for ALL! It's too easy for anyone to get child porn on their computer even if THEY ARE NOT LOOKING FOR IT. These kids are being given "toys" that they are not ready for. That being said it will happen a lot more unless we start using them as examples. We are being to easy...they need to know reality...distributing child porn is a serious offense and they need to be taught a lesson. They need to be registered like all child porn offenders. Don't say "but they are just children"...sorry about that but they want to grow up and have grown up priviledges...if you are going to play then be ready to pay. As long as the government keeps online web sites that knowlingly distribute child porn we are all in danger...THEY NEED TO SHUT THEM DOWN..THEY KNOW WHO THEY ARE BUT DO NOTHING. |

Well if they are going to charge anyone, it should be the girl who initially sent it. None of this would have happened if she didn't choose to send it.!!! Its a good life lesson for her to learn, especially since sexting has been all over the news lately....

These cases are soo sexist. The boys are always charged for having this stuff on their phones and the girls are looked upon as the victims. Where's the personal responsibility and gender equality? It's the same kind of jacked up justice a teenage boy gets for having sex with his teenage girl friend. |

As far as charging a child with a felony they better make sure the intent is there. Felonies can and will make life very diffacult to succeed in life. From what I read the child that sent it to everyone should be charged not the girl or the original boy.
Besides you can ask any lawyer, judge, or law inforcement that the laws were not written for these children. |

For Kenosha: Sorry but she intended to take the picture, intended to send it to her boyfriend, he intended to send it to his friends.
ALL VERY INTENTIONAL!!! They are too immature for most of these toys. We say they are adult/mature enough to handle these situations but when they do something like this then we treat them like a 2 year old that doesn't know any better and we feel sorry for them. It's a double standard we need to stop. They need to know the results of such action. How many others were sent those pictures across the country? Her face and body could end up on numerous porn sites simply because some kid thought it would be cool to send to a cousin in another state. How does she feel about that? I'm sure she is embarrassed and ashamed of herself but she did it intentionally. I just hope my daughter and her friends learned a lesson from this and don't do that. I hope many kids learn from this. They will but only if they are shown what happens. It will be interesting to see what they do to her and her boyfriend. This is possession and should be treated as such. |
