That bitch has a good lawyer with Mike Small. He has riddled the system with a million motions. All to delay the trial for as long as possible. Think it goes to trial next month April 17th. Unless it gets delayed again. She is at least rotting in jail as I type this.

Well when you have an innocent woman in jail then yes a lawyer is going to all he can do to get the charges dropped. If she was such a bad mom then why did she home school her children and revolved her life with them. She comes from a very good family and would never bring harm to her children. There are alot of lies floating around and I am tired of hearing them. This woman loved her children. Only god knows all you Hypocrites and your not suppose to judge anyone. That is God's job. What happened to all the evidence????? It is not there!!!!! Everything they accused her of from the get go seems to be reniged now. They want something so bad everyone is lying to make it look worse on her. But when it comes to it the truth does come out!!!!!! I love you Amanda and may god be with you

You must be as crazy as she is! Evidence has not been presented yet because of all of the delays. You must have misunderstood the media. They said that the mistake made was in sharing of information not in the gathering of evidence. A good mom does more than home school their children.

Small files Gutweiler motion, calls bluff

Amanda Gutweiler Hypes doesn't have to provide her three expert arson witnesses at a pretrial bail hearing, but she waives any objections and invites the state's two arson experts to testify, said Mike Small, Hypes' attorney.
Dr. John DeHaan, one of the state's arson experts will not testify since 9th Judicial District Judge Donald Johnson has ruled he cannot testify in any proceedings, Assistant District Attorney Rocky Willson said.

Hypes has a motion before the court to be freed from prison or to have a bond set.
It was the availability of grand jury testimony to DeHaan, among other things, that led Johnson to throw out the murder indictment against Hypes.
"Mr. Small would want to comply with that ruling," Willson said.
In a motion entitled "We call the bluff," Small said Hypes, "is perfectly willing for the court to hear testimony from her experts as to the astonishingly unprofessional and inappropriate manner by which the state sought to cobble together a nonexistent case against her."
He added that Hypes, "looks forward to the conference call and the hearing and suggests that while we're at it, we get available dates for DeHaan and (David) Icove so that the court can see first-hand the flawed and flimsy theory the state advances in its efforts to take Amanda's life."
Willson said he would have no problem with Icove, the state's other arson expert, testifying.
Johnson has already ruled that prosecutors will have a chance to question Small's three experts -- George Barnes, John Lentini and Douglas Carpenter.
In a related matter, Willson asked about the timing of a Monday Associated Press article that Small entered into the record. It was a story that first appeared in the Chicago Tribune in December 2004. The article centered around a case in Corsicana, Texas, and among the experts it quoted were Lentini and DeHaan. They were on the same side there, but they are opposing experts in the Hypes case.
Hypes is accused by the state of murdering her three children -- Jessica Gutweiler, 3; Luke Hayden, 6; and Sadie Plum, 10. They died in a house fire in January 2001. She was indicted in April 2002 and turned herself in in May.
She has been in the parish prison since.

personally I know Amanda and her current husband Josh. I had the opportunity to talk to her about the deaths of her children before she was ever charged and after that conversation I concluded she is not the broke up mother her lawyers portray her as. She never once shed a tear while discussing their deaths and as a parent I find that difficult to take in. If she is so innocent why the lack of emotion. What about the father's of those kids? Nobody seems to mention their loss along with the children's grandparents. This is a tragedy that could have been prevented, why leave small children alone in a house so you can go out. If her children were her life as she claims why not take them with you exspecially children so young. She may/may not have intended to kill them but leaving them home alone shows neglect in their deaths. The courts will decide if it was murder. But you can't deny she is to blame for the deaths of those small kids.

Saying you are "Home schooling" your children doesn't mean that they are learning as they should, and neither does it show that the parent loves them. It could be that the parents are afraid of what their child will reveal about their homelife if they go to school.

I didn't see any tears at her son's funeral either/

Her attorneys have done all they can do to prevent this case from going to trial. If she is so innocent, what do they have to fear. Let the trial begin.

Well Goldie if you didn't see any tears you must be blind!!!!!I was there through the whole funeral and I saw copious amount of tears not to mention her almost passing out when we took her up the steps. And after the funeral I talked to her up until late at night!!!!! I can't take up for her for leaving the children home alone. Although everyone is quick to judge as if they have never left their child at home. I know it happens everywhere!!!!! Oh by the way if you was at the funeral they you would of known that the three children were barried together and the funeral was for all of them!!!!!!!! Not just her son!!!!!!! As far a home schooling she done a very good job with her babies!!! All I can hope for all you hypicrytes that one day something happens to you and no one believes you and you are fighting for what life you have left!!!!!!! The justice system is what it is and all this was expected....One time the prosecuter will have it delayed. The next time the Defendent will have it delayed it all has to do with evidence. Well I hope you have enjoied my input. I just hope you will learn not to judge so harshly cause one day it may come back and haunt you!!!!!!

I went to school with her, and she was a couple screws loose then, how coincidental is it that she leaves her kids alone and they burn up.....Get real.....

Looks to me as if you need to review some of the evidence that was presented pubicly, as well. If this is true, then imagine the evidence not presented to the public. It's not that I want something so badly. It's just that I want the truth!

ALEXANDRIA, La.(AP)- Three children who died in a fire
allegedly set by their mother appeared to have been trapped
upstairs by smoke from flames that ignited on the floor below and spread quickly, an arson expert's report said.
The children's bodies were found on the first floor, but they
likely fell after they had died of smoke inhalation and when the
floor beneath them collapsed from extreme heat, the report said.
The accused 31-year-old mother, Amanda Gutweiler Hypes, says she
is innocent in the deaths of Sadii Plumm, 10, Luke Hayden, 6, and Jessica Gutweiler, 3. The report by John D. DeHaan in some respects matches her version of the events of Jan. 9, 2001.
Hypes has said she returned from a 15-minute trip to the bank to
find fire spreading through the lower floor of her home. She says she entered the home and called upstairs to her children, then ran to a neighbor to get help when the children failed to come down.
But while DeHaan found that the fire began downstairs while the
children were on the floor above, he also concluded that the fire likely was set with use of accelerants and possibly in multiple places on lower level.
The rapid spread of the fire trapped the children, he said.
"Multiple points of origin or the use of an accelerant are very
strongly indicated," DeHaan's report said.
Hypes has insisted that the fire was not arson and did not
spread as rapidly as the state claims.
On Monday, defense attorney Mike Small said he would not respond
to the specific findings of DeHaan's report, which was only
recently filed in court, until arson experts hired by the defense had a chance to review it.
"I absolutely believe she had nothing to do with the fire that
killed her three children," Small said.
DeHaan's report differs somewhat from findings by the State Fire
Marshal's Office, which concluded the fire was deliberately set.
The Fire Marshal's report said burn patterns and the reaction of
a dog trained to detect the smell of gasoline indicated that
gasoline was used to strengthen the blaze, including at the base of the stairs.
DeHaan did not base his report on the burn patterns cited by the
Fire Marshal or the reaction of the dog. Instead, DeHaan relied on descriptions of the fire by witnesses and what could or could not have caused the fire to spread so rapidly.
DeHaan's report also stated that direct evidence of gasoline was
found only in nearby soil and not in the remnants of the home.
"No residues containing gasoline were recovered from within the
floor slab," DeHaan said.
However, DeHaan did say the rapid spread of the fire "is
consistent with the use of some type of accelerant."
Had the fire only begun in one room, it would not have spread so
quickly and caused such damage in such a short time, DeHaan said.
And if there had been a "smoldering fire" from an electrical
appliance or a burning mattress, the children would have been able to escape or telephone for help because such a fire produces smoke before bursting into open flame.
There was no emergency called, and DeHaan noted that it "would
not be possible" for Hypes to have gone into the burning house to
rescue her children without suffering serious injuries.
Hospital personnel told detectives Hypes was not burned and
showed no signs of smoke inhalation.

And if you read the paper after that when they scraped the foundation they had to renig that she set the fire with any accelerants. They was none found. So again believe what you want to I know that I am standing by my friend. Because I know that she did not set fire to that house. So I guess we will see what the court says and can't wait till she comes home!!!!!

I know one of the fathers and I know how heartbroken he was when this happened and through it all. he was always upset when this was mentioned and everytime they delay it about kills him. I think she did it and after someone above posted she didn't seem upset, I really believe it now!

Well I am here again!!! Objective I am glad to see that someone has some brains around here.... Yes I am her friend and I will take up for her where as your maybe someone that has heard about the story and still staying objective... I know in the news that women say that they didn't hurt their kids and then say they did!!!! I know that is why people are quick to judge. All I ask is everyone give her a fair chance to a trial.... I am not one to say that she shouldn't left the kids home alone.... but in my heart I know this woman didn't hurt her children on purpose. And as far as this Waiting person I don't doubt his heart is broke.. All I can say about that is that I hope one day his heart has peace with all that has happened... I know that I am a mother of two beautiful little girls (not so little now) and if anything ever happened to them I would just die... But this woman that would babysit my oldest one when she was young was wonderful with her... I could of not asked for a better babysitter... My child didn't want to come home when she was there... So just to let you know that I am not just another news reader that wants to judge I knew her first hand.... So when you decide to judge make sure you know that person before you make judgement....Even though no one should judge one another leave that to God.......

DEAR MEL, I WANT TO THANK YOU FOR YOUR INPUT. IM GLAD TO SEE THAT SOMEONE IS NOT BLINDED BY THE FALSE ACCUSATIONS AGAINST THIS WOMAN. SOUNDS LIKE THE ONLY EVIDENCE YOU HAVE IS HERESAY, WHY DONT YOU LOOK MORE INTO THE FACTS? WERE YOU THERE WHEN THIS TRAGEDY HAPPENED? DO YOU KNOW THAT YOUNGLADY PERSONALLY?
