"...Aurora doesn't discuss personnel issues but it complies with all laws."

Bull, they disregarded the law which protects our military personnel and disregarded any sort of integrity and decency.

A million? Not enough, make it five million. The corpocracy only pays attention when it hurts.

Fred, Your only hearing half of the story. Maybe he was a "marginal" employee on the verge of termination. The point is, we don't know. The laws regarding terminating employees "...because of his military service" (according to the story) are so crystal clear to employers that I find to believe they willfully fired him just because he serves his country.

Good point, Dave, and an important one to keep in mind. That said, he was three times deployed and had achieved the rank of Lt. Colonel. He certainly doesn't sound like a slacker.

There are two sides to every story...sounds liek this guy could be trying to take advantage of his miltary service. He could be just a bad employee and feels he is owned something because he served.

If he was terminated due to service - shame on them!

Would be nice if the reporter would do a little digging and find out more information rather than just buy what the attorney feeds them.

HR is always filled with weak kneed liars. I watched dozens of Vets have their re-employment rights violated and there wasn't a squeak from the authorities. The American Corproration can muster a dozen lawyers to get rid of a Reservist or Guardsman who didn't put in enough hours "in the cube". There is a simple solution. Investigate Aurora and make a determination. If there are damages award them. Fine Aurora appropriately and ban them from any transactions involving Government funds (at any level). Simple.

Soldiers in the Army Reserve are also given a grace period by the USERRA prior to returning to work, provided their absence due to military service runs longer than 30 days. Individuals absent from between 31 to 180 days have 14 days to return to their employers, while those gone for 181 days or more have 90 days. Soldiers injured in the line of duty, meanwhile, have up to two years before they are required to report back to work. Individuals absent for less than 31 days must report back to their employers on the next workday in order to be protected under the USERRA.

He missed grace peroids on the last couple of deployments which ended his protection under USERRA.
