Some of you may be interested in knowing that several people in Blytheville and Gosnell have filed slander suits against members and guests. Identities were obtained using IP addresses supplied to the authorities by TOPIX. It is against their (TOPIX) use policy to state names and/or information that clearly identifies any person on their forums. If served with a subpoena, they do hand over information. Otherwise, they can be named as a party in the suit.

If you can prove what you say, then I suppose it won't matter. However, if it is hearsay or simple gossip, you may want to be a smidge more careful in the future...

Someone posted a link to an article on topix about them supplying ip addresses... I'm going to go copy and paste it... BRB

The forum I had originally seen about this in blytheville has been deleted (possibly because of the case?? IDK).

However, I did find another one with the following link. It relates to much more than slander (actually I should say libel because it is written, not spoken), but it does have a statement from TOPIX about answering a subpoena. http://www.wktv.com/news/local/80742622.html

That case was dealing with death threats not gossip.

hate to break it to you, but it is not against the law to post names on the forum. Also in order to win any type of court case for slander, defamation, libel or whatever, you must proved you were damaged by what was said or written. Embarrassment is not considered damage in a court of law.

As far as people from blytheville suing, you are nothing but a bald face liar who has nothing better to do than to spread false rumors.

As far as a subpoena to get the ip address, that is true but then you will need a second subpoena to find out who is using that ip address and then you have to prove who was actually on the keyboard when the post was written. This takes tons of money.

Finally when jerks like you get online and start spouting stupidity, you need to realize anyone who knows anything about topix knows you cannot believe the majority of what is on it. Anyone with any common sense (that leaves you out) would know to ignore it.

Now that you got a cheap thrill trying to fool local topix users with your lies about lawsuits, you can now take your hand out of your pants and start using two hands to type...but you may first need to wipe your hand first...

I'm sure someone could be caused a divorce, loss of employment, or other such problems by things posted on topix. If that were to happen, then that would be damage.

I do agree that getting the IP adress wouldnt prove who's using the computer. Several people use this one and I dont think there is any way to know who is on at what time except possibly asking every user if they were on. What dummy would admit it if they thought they might be in trouble? I could easily log in under someone elses account.

I am not sure if I agree with you. Everyone on topix knows what type of forum it is. If a person lost their job, got a divorce or whatever, I would imagine there was damage long before topix came into play. It would be tough to prove. This would be a civil matter so it would be expensive and would take years to prove.

I do agree with you on this. If I were to say something that could get me in trouble, I would not use my computer or I would at least use a proxy where my ip address would come from an anonymous source in another country. There is no easy way to trace that.

For those who get on here and falsify info. I do believe if you dont get punished by the laws of the Government will have to face the Highest Government... One who Laws should be obey'd. the constitution only says congress cannot make laws restricting speech. It says nothing about states and private business doing the restricting.

Something to consider, Those who use freedom of speech to say anything they want so they can hurt others will eventually cause laws to be past to restrict our speech. It has already happened based on the number of laws from cyberbulling to civil rights speech laws that passed recently.

I believe you're mistaken about everyone on topix knowing what kind of forum it is. Some people will believe everything they hear or read regardless of the source. Now, that being said, just imagine if someone who reads topix tells someone elses wife that he's cheating and everyone on topix is talking about it. There doesnt have to be any guilt for this to cause serious problems and even divorce. This to me is damage
