The dog provided the probable cause. It is not considered a "search" have a dog walk around the exterior of a car. Anything observable from outside the vehicle, including anything that can be smelled by a trained dog, is not considered a "search."

Thanks Mark for pointing that out. I wish more people understood the law.:)

The US Supreme Court case Illinois v. Caballes (2005) provides for exactly what Mark is saying regarding what is and is not considered a search.

that you people don't know your own rights. The guy's just doing his job, it's in the description, get over it. I bet you wouldn't be saying that if someone you cared about died tomorrow because he hadn't arrested that guy and that guy drove into and killed a loved one because he was high huh? gps is just anouther excuse to make a traffic stop, why not tax and regulate not incarcerate! it will cost us big bucks to babysit this guy for 10 years when i bet the same amout would come from taxing it!

So where are you suppose to mount the GPS?
I agree w/legalizing pot! People are never gonna stop smoking/growing it so it will be a continuoues battle. Legalize it that way the state can make money off of it like booze and cigarettes, which to me are way worse then pot.
That sucks for the guy that got pulled over and busted though.

to all of you bashing him and our law enforcement, go take a leap of a cliff, he and his partner was doing their jobs and found a deadbeat that can't get a real job like some of us have. Most of you are the first person to say good job to the law enforcement if they are there for you and your rightful property, but bash them when you screw up and deserve a visit from your local cop or parole/probation officer.
