TAMPA - The operator of a chain of pain clinics has pleaded guilty to a federal drug crime and Medicare fraud.
Troy Wubbena, 44, who is listed in state records as director of Neurology & Pain Center Inc., ran pain clinics in Tampa, St. Petersburg, Lakeland, Sarasota, Orlando and Jacksonville with physician Jeffrey Friedlander.
Friedlander previously pleaded guilty to Medicare fraud and conspiracy to distribute several drugs, including oxycodone. His sentencing is scheduled for Aug. 13.
Wubbena, a physician's assistant, pleaded guilty to the same charges today. No sentencing date has been set. He could face up to 20 years in prison on the drug charge and 10 years for the Medicare fraud charge.
Last week, Wubbena pleaded guilty to prescription drug trafficking, for which he could face up to 20 years in prison.
He is likely to receive a lower sentence because he has cooperated with prosecutors. Some, if not all, of the sentences also are likely to run at the same time.
As part of today's plea agreement, Wubbena agreed to forfeit $317,000; he could also be ordered to pay up to that amount in restitution to the federal government for the Medicare fraud.
Authorities have described the chain of pain clinics, which have since closed, as a "widespread, significant operation" to illegally peddle the addictive drugs.
Although Wubbena is described in court documents, including his plea agreements, as the owner of the clinics, he seemed to deny that today.
When U.S. Magistrate Thomas Wilson asked whether he was the owner, Wubbena hesitated and then conferred with his attorney, Anne Borghetti, who told the judge the answer is "not really." No further explanation was given.
According to court documents, thousands of pain pills were sold to high school students and addicts statewide by pain clinic employees, patients and family members.
The operation, which primarily involved the pain drug oxycodone, relied almost entirely on blank prescription forms signed by Friedlander and filled out by Wubbena and other clinic employees, authorities said.
In last week's case, Wubbena admitted using the pre-signed forms. He and others he directed filled out the forms for oxycodone in the names of clinic patients and filled the prescriptions at pharmacies. Wubbena and others would then sell the tablets; most of the prescriptions were for 120 to 180 doses.
In today's case, Wubbena admitted conspiring with Friedlander and others to distribute the prescriptions to clinic patients without performing required examinations and tests.

Jeffrey Friedlander and Troy Wubbena are scheduled to be sentenced in August. Dr. Jeffrey Friedlander faces up to 30 years in prison. Troy Wubbena faces up to 50 years in prison. Both have lost their medical licenses and both have agreed to forfeit 300 thousand in illegal Medicare payments. Both are out on bail using their homes as collateral. Surprisingly, both of their homes used as bail are worthless as they both are upside down in them and all of their homes are in foreclosure.

TAMPA - The owner of a chain of pain clinics who admitted peddling more than 62,000 oxycodone pills on the street was sentenced today to 10 years in federal prison.

Troy Wubbena, 44, pleaded guilty to federal drug conspiracy for obtaining pain pill prescriptions without patients' knowledge and selling the pills.

Wubbena operated Neurology & Pain Center clinics in Tampa, St. Petersburg, Lakeland, Sarasota, Orlando and Jacksonville with physician Jeffrey Friedlander, who has pleaded guilty to Medicare fraud and conspiracy to distribute several drugs, including oxycodone.

According to court documents, thousands of pain pills were sold to high school students and addicts statewide by pain clinic employees, patients and family members. Wubbena directed the sales, keeping track of them on note cards.

Defense attorney Anne F. Borghetti said Wubbena has Attention Deficit Disorder and is addicted to oxycodone as a result of an injury suffered during an accident. She and Assistant U.S. Attorney Kathy Peluso said Wubbena has cooperated with investigators, providing information used to investigate pharmacies and other drug dealers.

"I lost my way in my ability to discern right from wrong," a tearful Wubbena said. "I was out of control and felt unable to stop.… I have no one to blame but myself. But it is my children who have paid the highest price."

Wubbena, a physician's assistant, is set to be sentenced Oct. 1 in another case in which he conspired with Friedlander and others to distribute prescriptions to clinic patients without performing required examinations and tests. Wubbena also pleaded guilty to Medicare fraud in that case.

The conspiracy relied almost entirely on blank prescription forms signed by Friedlander and filled out by Wubbena and other clinic employees, authorities said.

Wubbena and others filled out the forms for the pain drug oxycodone in the names of clinic patients and filled the prescriptions at pharmacies. They then sold the tablets; most of the prescriptions were for 120 to 180 doses.

"The use and abuse of these substances have become epidemic," U.S. District Judge James Whittemore said in passing sentence, telling Wubbena. "You should go to prison. You were the organizer of this particular conspiracy."

Justice was served yesterday for this little whack job- sentenced to nine years. If he pulls one of his hissy fit tantrums on some hard core con in the joint, like he did on his patients, they will need a spatula to scrape him off the floor. I am going to continue to monitor his status in prison, parole, etc and do whatever I legally can to ensure he serves his full sentance and never serves in the medical profession again-not even a bed pan runner in a nursing home. The State of Florida needs to be taken to task now for ignoring patient complaints - it is a miracle that "Doctor" Jeffrey Zoolander never seriously hurt a patient- no thanks to the Florida doctors protective society - otherwise known as the Florida state government. Have a fun new life, Jeffrey !

Lonevoice, sounds like you were also screwed by this corrupt idiot. It is a wonder this never happened sooner. Every time I made a complaint about this jackass, it seemed liked it would go nowhere and justice would never be served. He always seemed to skate of be so slick and slippery that it seemed nothing could stick to him until now. Well, these counts that they've got him on, I have no doubt barely even scratch the service. Not only did he do illegal and immoral deeds, but also unethical...which goes without saying. I guess it does eventually catch up to you so far. I think it is just too bad he didn't get the whole 30 years instead of just NINE...I hope this doesn't mean he can get off early on good behavior, which would be some crazy irony since there is not one good cell or fiber in his being. I know there is suppose to be good, at least some in everyone, but this dude might be the one exception. Yeah, I too really hope he does one of his stupid numbers, like one of those hysterical fit of rage episodes while he's in jail and sees what it is like to feel helpless when someone is a bully and gets the last word and final say and he has no control over it, except to know that it was wrong and there was no where else to turn..since that is what he undoubted did to so many of his patient/victims...I think the justice most appropriate would be for his punishment to fit the crime and at 50+ years of age that should be at least how long the clown should have to suffer for lives that he's ruined and other conspiracies to commit fraud that he actually did. He has been misleading and falsifying patient records for decades and not just with regard to illegally prescribing medication indirectly. He has failed to protect his client patients best interests for years, putting their lives in jeopardy and serving them up as sacrifice to line his pockets by being a puppet, being influenced by outside agencies and companies, which they pulled his puppet strings to have him do whatever they wanted in both their mutual interests...DAMN THE SUFFERING PATIENTS! Now finally...If I get nothing else this year for Christmas, or even if I did, this by far would have to be the best gift of all...and that is really said, because I am not a persons who has ever felt so strongly and full of disgusted for another human-being, like I feel for him. I do not think that there could ever be another person on earth I could meet that could make me as sick to my stomach as this foul moron!!! I've wasted enough words, time etc.... on this looser. I just hope in the end, he learns from all of this, making amends for what he did would also be nice, but I won't hold my breath. I knew if not in this life, he'd somehow get some sort of justice, even if it only just begins to scratch the surface..as in this instance. Nonetheless, I'll take it, it's better than nothing and most importantly, he is (at least for now) off the streets and away from current, past and future patients/victims. I was a patient of Friedlander and it was a horrific experience. He pressured me and insisted I tried several pain killers, monthly MRI's and when I questioned why so much and so often, sat back and crassly said "if you are challenging my knowledge and know how and refuse to follow the suggested treatments, I can no longer see you as a patient. I left after being under his care for under a year. And to think im still suffering chronic headaches and just found this out when having to call today to try and get my records for my new neurologist. He was the last Dr I was treated under. How sad to wonder if I was properly diagnosed and cared for for my benefit or his.

I am so glad that Dr Feelgood (Jeffrey Friedlander) and his sidekick Roxie-Jockie (Troy Wubbena) are no longer a threat to the children of the world. Good Ridence!!!!! Jeff and Troy, I wish you 10 years of happy showering (pick up the soap) in the Pokie (pun intended).

Woman Facing Sentencing in Prescription Drug Case Dies

A woman who pleaded guilty to taking part in a conspiracy to distribute prescription drugs died before she could be sentenced, according to federal court records.

Last year, a grand jury indicted Sarah Ehresman and three others, including Lakeland pain-medicine specialist Jeffrey Friedlander, on a variety of federal charges.

They operated Neurology & Pain Center clinics in Lakeland, Sarasota, Tampa, St. Petersburg, Orlando and Jacksonville, court records state.

Ehresman pleaded guilty Dec. 1, 2009, to conspiracy to distribute controlled substances.

But prosecutors informed U.S. District Judge Elizabeth A. Kovachevich during a Nov. 5 hearing that Ehresman recently passed away, records show.

Prosecutors will obtain a death certificate and file a motion to dismiss the case.

Her other co-defendants took plea deals and have been sentenced.

Friedlander, 51, gave up his medical license and was sentenced last month to nine years in prison. He must also serve three years of supervised release.

How did Sarah die? And why did clinic Leslie,and the nurse from Sarasota who played doctor not face any charges? She was just as guilty of the crimes?

Seems like little freak boy Friedlander had an appeal going, until Oct. 2011. His attorney withdrew the appeal because "the appeal had no merit". I have never heard an attorney do something like that. It's like your Momma don't love you no more. Jeffrey must have both ran out of money and probably threw one of his patented hissy fits on his lawyer. If he doesn't sabotage's himself in the joint and end up serving his full sentence, then it's the life of an ex-con: minimum wage dead end jobs, being monitored by probation and the cops. I beleive everyone who is deserving gets a second chance. Let's see if Jeffy boy cowboys up.
