Widow sues Disney Cruise Line in man's death

A widow from New York has sued Disney Cruse Line in federal court, blaming the company for her husband's death from injuries he suffered during a Mediterranean cruise last summer.

78,000 seems a little low for it to still be a story, I would have thought Disney would have made this go away already. The legal fees and bad press will cost much more than that.

Correct me if I'm wrong.

The story is heavily weighted.

Money will bring her husband back ? Or at least measure how much he was worth to her !

Wait till legal discovery has had a whack at it .

Disney is a Grade A target, and at 78 Y.O. the deceased may have had many other Problems , besides the obvious eyesight defects.

The suit seeks more than $75,000 in damages. Complaints generally never list the exact amount of money being sought. It seems however, that his widow would be seeking a large payout, possibly in the millions.

These frivolous lawsuits will eventually wreck this country. Disney provides an outstanding product for families to enjoy. Not sure that Disney provides "assisted living" type quarters for its guests. Let me get this right, the fellow is 78 years old, trips and falls and has an unlucky incident due to his age and now Disney has to pay. Ships are designed to keep water out. There are "lips" on most thresholds on a ship. This fellow should have been cognizant of his surroundings. Also, when going on a cruise, you are notified of the risks, ala Skiing. Hopefully, the legal system will quickly dismiss this suit.

Another selfish family member that only cares about the money and nothing else. It seems that every time someone dies or gets injured at Disney or any Disney-owned facility, Disney is automatically at fault. How rediculuos!

All shid have "lips" on all doorways into rooms.as well as interior hallways to keep water out. People need to be aware of that fact when taking a cruise. The only thing Disney maybe liable for is medical negligence that is all, because all cruise ships are designed the same way, and the family should have requested a handicapped room!

I just saw a news story about a similar incident with another cruise line. In the story, it was explained that all cruise ships hire health care providers who are independant contractors. That means only the health care providers can be held liable for any wrong doing, not the cruise line. The news report mentioned a number of large cruise lines where this is common industry practice-Disney Cruise lines was one of them. I hope this widow can get some justice and I hope we can get these cruise lines to change the way they take care of their passengers! Until that happens-spread the word and don't cruise-your life may depend on it!

Wow! How insensitive is this guy! Don't you have grandparents? Almost everyone who responed to this is really not at all caring about our elder generation. The issue of this lawsuit is not the fact that he tripped and fell. It's true that that could have been due to his age. It was the misdiagnosis, lack of urgency and care that ultimately cost this man his life. That is what Disney should be held accountable for. In my opion, what they are asking for is too little! If they were asking for 10 million that would be excessive-not 75K. How would you feel if the person was a 28 year old pregnant woman who tripped because she could see the floor and died under the same circumstances? Then you would be on her side, right?

Disney isn't responsible. As a person already stated. The medical staff are independant contractors, as on all cruise ships. Disney is not responsible, sad but true. We don't know exactly what happened. Knowing Disney, I am sure once they found out they made arrangments as quickly as they could to get him off the ship to get help.

Disney has evacauted people in the past and they have been fine.

What happened to this man is a tragic accident, accidents happen, DCL is not responsible.

Yes he was old, maybe had health issues, vision problems, etc. etc. What bothers me is that it seems they could have called a helicopter if they only had to travel 5 miles in choppy water. Disney has the money to spare. I have been on jury duty before (3 times) and trust me, smart jurors look at every angle to "the story". That's the one sticking point that I would look at.

78,tripped and split his wig. Why is this the fault of Disney?? For the idiot asking about the helicopter, Disney Magic does not have the facilities to land a helicopter. Also, your not in the USA a medical helicopter is not on call 24x7 in most countries. I hope Disney wins!
