Anthony's attorney says she wants closure

What is bankruptcy?

Middle District of Florida Bankruptcy FAQ

ORLANDO -- A new chapter has been filed in the Case against Casey Anthony. It's now chapter 7 after she said she has no money and filed for bankruptcy.

The filing could delay civil cases she’s still involved in since a jury found her not guilty of murdering her 2-year-old daughter, Caylee.

We spoke with the attorneys representing clients in two defamation cases.

They said even though their cases are put on stay until the bankruptcy court judge rules on this bankruptcy filing, they will move forward to get some restitution from Anthony.

Court Document: Casey Anthony's petition for bankruptcy

The civil suits against Anthony from Zenaida Gonzalez, Roy Kronk and Texas EquuSeaqrch are just some that will be put on hold due to the filing.

In the 60-page document, Anthony claims she owes almost $800,000.

The filing came on the same day an appellate court threw out two of her four convictions for lying to law enforcement.

Previous Story: Casey Anthony has $1K to her name, bankruptcy documents show

It could be a delay tactic for one of her civil cases, namely the Zenaida Gonzalez suit, which was to start in the near future.

News 13's Legal Analyst Mark NeJame thinks that might be the case. NeJame is also listed as one of the creditors in Anthony's bankruptcy filing.

“It’s definitely a strategy and a commonly used one," NeJame said. "You see many people filing for bankruptcy to avoid litigation, which could in fact wipe them out or keep them tied up for years.”

NeJame said he's never even spoken to Anthony, although he did briefly represent her parents in the early stages of the murder case.

How will this impact Anthony's civil cases?

Attorneys could continue seeking litigation in bankruptcy court or ask the bankruptcy judge to allow the civil cases to proceed in state court.

Matt Morgan, who represents Gonzalez, said although Anthony has no money, the recent filing will not affect their defamation case.

"We believe that at some point in the future, Casey Anthony will profit from a book, movie, or other related deal,” Morgan said.“It makes logical sense for her to have all of her liabilities discharged before she profits."

Kronk, the meter reader who found Caylee’s remains, is also suing for defamation.

"The lawsuit on behalf of Mr. Kronk always realized that collecting money would be difficult or impossible, but it didn't stop (us) from filing suit to prove that Mr. Kronk had nothing to do with the murder of Caylee Anthony," said Kronk’s attorney Howard Marks.

Only certain debts are discharged in bankruptcy court.

However, the attorneys said they are trying to collect damages they hope are not dischargeable in bankruptcy court.

When Gonzalez and Kronk’s defamation cases go to trial, a jury will determine the exact amount of money they would be awarded.

Even if Anthony does not have the amount at that time, but does sign a movie or book deal within 20 years of the judgment, Gonzalez and Kronk will still collect their sums before Anthony.

Anthony's legal team speaks

One of Anthony's defense lawyers, Andy Chmelir, said his client was looking for closure and that she actually feels bad she can't pay her legal fees.

“To some extent she feels, she feels bad that she's having to have all these legal services provided to her and she is unable to compensate anyone. So, she wants closure more than anything else," Chmelir said Saturday.

Chmelir said as for the future, Anthony is not able to make plans, but the pending litigation wasn’t helping.

“She doesn’t know. She can’t make any plans right now because right now she has various lawsuits that are ultimately going to require her presence,” said Chmelir.

Chmelir also said Anthony doesn't not have any book or movie deals.

That bitch never felt bad about anything except when she didn't get her own way.

This is enough to cause any sane person to doubt our legal system.

Lisa, I'm losing patience with this baby killing skank. She's probably trying to get pregnant again, one more way to thumb her nose at the world.

We all saw her celebrating the death of Caylee. It continued until her skanky ass was arrested.

It will be interesting to see what's behind this latest skeme.

Ii wonder if Bozo directing it from behind the scenes.

Casey Anthony:‘Her story is her own,’ attorney says; but it plays everywhere

— posted by halboedeker on January, 28 2013 5:40 PM

During our interview last week, Jose Baez said that the Casey Anthony coverage taught him there should be a clear distinction between legitimate media and tabloid media. Anthony’s former defense attorney said tabloid media lean toward entertainment.

“This case, more often than not, became entertainment to people,” Baez told me.“I think that’s one of the things that piled onto this tragedy.”

But it’s so very hard to distinguish between legitimate and tabloid media. All media have learned they have to be more entertaining in the Internet age.

Just consider: Baez will appear on “Dr. Drew on Call” at 9 p.m. Monday on HLN, and many would say that Dr. Drew Pinsky epitomizes tabloid TV.

People magazine used to be dismissed as tabloid, but it continues to break news in the Anthony story. People reveals that Anthony has been living in Cape Canaveral since late last year and has reconciled with her father, George.

On Monday, Charles Greene, Anthony’s attorney in the civil trials, was giving some very personal interviews about Anthony’s decision to file for bankruptcy. She says she has $1,000 in money but is $800,000 in debt.

Greene told WESH-Channel 2’s Amanda Ober that Anthony wanted emotional relief from people seeking money.“She’s living on the kindness of friends, for the most part,” Greene said.“So there are people that believe in her that will see her through this ordeal.”

(Does Casey sound like Blanche DuBois?)

Anthony did not watch the recent Lifetime movie “Prosecuting Casey Anthony,” Greene told Ober.

WFTV-Channel 9’s Anthony DiLorenzo reported that Anthony’s team had passed up lucrative offers to sell her story.“Of course, Caylee. What really happened, no matter what happened, is a very sad and a very troubling tale and she’s not ready to talk about it,” Greene told DiLorenzo.

WOFL-Channel 35’s Shannon Butler reported that Anthony can’t find a job in Central Florida and added that Greene would not be able to talk about reports that Casey has reconciled with George.

“No book deal, no contracts, nothing’s going on,” Greene told Butler. Greene turned to the camera and said,“Her story is her own. It’s a very private story, and nobody, nobody knows it, nobody’s going to know it for a long time,” he said.

That sounds like a confessional, which is very tabloid.

But the Anthony story plays in all media — legit, tabloid, television, newspaper, Internet, phone, blog. And bemoaning that fact won’t change it.

No one knows anything for sure these days in the journalism business, but I do know this: The Anthony story has kept a lot of people employed because viewers and readers remain interested.

Casey Anthony: I'm flat broke

From ASSOCIATED PRESS

TAMPA, Fla.— Casey Anthony filed for bankruptcy in Florida on Friday, claiming about $1,100 in assets and $792,000 in liabilities.

Court records show that Anthony, who was acquitted of killing her 2-year-old daughter Caylee in 2011, sought Chapter 7 bankruptcy protection in federal court in Tampa.

Her listed debts include $500,000 for attorney fees and costs for her criminal defense lawyer during the trial, Jose Baez; $145,660 for the Orange County Sheriff's office for a judgment covering investigative fees and costs related to the case; $68,540 for the Internal Revenue Service for taxes, interest and penalties; and $61,505 for the Florida Department of Law Enforcement for court costs.

AP

The filling also states that she is a defendant in several civil suits, including one brought by Zenaida Fernandez-Gonzalez for defamation in Orange County Circuit Court.

Fernandez-Gonzalez claims her reputation was damaged by Anthony telling detectives that a baby sitter by the same name kidnapped Caylee. The detectives were investigating the 2008 disappearance of the girl, who later was found dead. Anthony's attorney said details offered by Anthony did not match Fernandez-Gonzalez and clearly showed Anthony wasn't talking about her.

Court papers list Anthony as unemployed, with no recent income.

An attorney for Anthony, David Schrader, did not immediately respond to messages from the Associated Press.

Anthony lists about 80 creditors in the 60-page court filing. The claims largely cover fees for legal, medical, psychiatric and forensics consulting or services. But one claim covers a debt for scuba diving services.

According to the courts, the aim of seeking Chapter 7 bankruptcy protection is to be discharged of most existing debts — essentially to obtain a fresh financial start. A trustee may have the right to take possession of and sell non-exempt property and use the sale proceeds to pay creditors, but Anthony lists little in the way of assets. A debtor may still be held responsible for some obligations, such as taxes and student loans.

The filing came on the same day that a Florida appellate court set aside two of the four convictions she faced for lying to detectives during the investigation into her missing daughter.

Though Anthony was acquitted of killing Caylee, jurors convicted her of four counts of lying to detectives, and her attorneys appealed those convictions. Anthony was sentenced to time served for the misdemeanors.

She was sentenced to a year of probation after her release from jail for an unrelated case. For her protection, her whereabouts have been kept secret since she was released from state supervision last year.

So, we now know for sure what we thought all along, Baez didn't pay the taxes out of her blood money, he kept it all for himself.

No fine or costs associated with a criminal investigation should be allowed to be wiped out in bankruptcy.

We all know her parents are feeding her money, blood money.
