they smelled the burnt weed! nothing smells like pot but pot! read the whole story! and try it again !

If the article is accurate (perhaps a big if) the strong smell of "burned marijuana" is probable cause. Didn't really need to ask permission to search either the bodies or the car. It'll stick.

These cops are dumb as heck. Even if the cops smell weed..they can not search a car unless they are given permission. The case will be thrown out because of that. They might be able to get the guy on resisting arest, but that might equal 2 nights in jail. The only way a cop can search a car is if they had probable cause. Meaning they could see a joint in the ash tray for weed lying around from the window. They could of also called in a K9. Atleast with a K9 they could of cheated and had the dog show, by doing some whispers to get the dog excited. But they did not do that...so no case. The police will get to keep the weed and money...but they have no case aginst anyone because of invading the car with out probable cause or a warrent.

Bye bye fools ? Get ready to loose time and money fighting the system. If they win or loose, they are still gonna sweat it out and pay cashola. Lawyers don't work for free, especially for these types of fools and charges.
A nice introduction to the system fellas. Too bad the taser got stuck, they hurt like hell.
Now if they just knew how to park a car, and not smoke the dope with pounds inside ??????

Read the whole story...he saw the weed in the center console there for probable cause to search and news flash....they can search if they smell it too! It will stick! And btw "warrent" is spelled "warrant".

I'm not sure which law some of you people are reading. The smell of weed gives them the probably cause they needed - oh...yeah and the fact that the suspect tried to evade. This is law 101. But it is also correct that this little bit of weed was off the street until tomorrow. It's like talking a thimble to remove water from a flooded basement. Sure some water was removed...but not a lot. You either need a bigger thimble or turn off the supply (or legalize it).

They need to seize the parents house for knowingly allowing drugs in. The mother said she smelled the weed. The police will get a search warrant for the dwelling.

Some of the charges will get dropped, however they will have enough to get him a minor charge for resisting arrest after pushing the cop. But I have to agree with the original comment, they can not search his car without an appropriate search warrant, regardless of whether they smelt marijuana or not. Hopefully the did get a warrant, they story doesn't really say.

WRONG, stop trying to play jailhouse lawyer and educate yourself on real case law. The smell of burning pot coming from a car is plenty of PC.
