quote: "The murder charge against Girvan is unusual because it is generally not illegal for someone to refuse to render aid to a person in need"
.....well, this is ridiculous in the first place, but for this case, it wasn't just refusing to aid, it was the preventing of others that did want to render aid.
and in California our Good Samaratin Law is being used for -legal fiction- in that statement made in the article, being generally not illegal to not render aid...
no, sorry, that law is there to protect citizens from civil judgements against them when they do try to assist in helping someone in need of help for life threatening situations. this was put into place because of the fact that people who tried to help a victim say, alongside a public roadway , and the person still subsequently was injured or still died, and they were being held responsible in some manner. People stopped helping others - would rather walk away from the scene of an 'accident' than to be involved. hence, the Good Samaritin Law was put into to place.
That law should not even be considered or used or brought up in this situation.
Look up the term 'legal fiction' and the laws--Good Samaritin Law and California needs a good overhaul in their laws if this is the case where someone in your own personal residence needs medical aid for any reason and you know it and you do nothing and you wait until 14 hours after that person dies and then call someone about it, or not, but they are found, and you did nothing not even calling 911, there is something very wrong with this - if this is considered to not be a problem.

Prayers for Andrew. He had a crummy life growing up. Pray that true justice is done and Drew is changed by his time in the Detention Center. May Miranda and her family know the peace of God.

lots of people have crummy lives growing up and they don't change at 31... sorry I have no sorry feelings for that man. He took my daughter from me. if he would at least own up and tell the truth......... he might be changed, but that doesn't seem to be the case, he is still out for himself..... and prayers for true justice is he should stay in prison out of society.... but thank you for the kind words for the peace of God. I pray for that every day.

this trial needs to proceed fully. to the extent that only a jury is the ones to decide on this case against girvan. it's the fourth of july and I see a year climbing on this case being delay after delay... it is a simple yet complicated case that needs to be concluded. this man became a menace to our society and it's our society that must judge what happens for him, not as he did for her, he took her life and now his must be judged by the people

a case against someone who attempted to murder another man in sept. 2007 is done and over, two men on trial, and it's done, the one who was acquited in this case, threatened lives of witnesses, after his acquital, so he's back in jail on new charges, my question is why is the murder of my daughter taking so long? how can the judge continue to allow so many delays, and they are never for lack of anything more than the p.a. didn't have time to get things done... waiving his rights to a speedy trial, over rules my daughters rights as a victim who no longer is even alive!
