Wrongful Convictions -- Stealing Lives One Person at a Time

Together, www.FreeKelseysMom.com and www.Raye-of-Hope.org are hoping to educate the public about wrongful convictions by holding a rally on June 21, 2008 in Harrah, Oklahoma at Heritage Park. Oklahoma City, OK (PRWEB) May 23, 2008 -- The recent release of wrongfully convicted Cynthia Sommer has brought awareness to the imprisonment of the innocent. The trend of crime lab mistakes, judicial errors, and incorrect eyewitness accounts is spreading nationwide. These contribute to years being stripped away from those who are mistakenly confined in a system that promises "Justice for all." Together, www.FreeKelseysMom.com and www.Raye-of-Hope.org are hoping to educate the public about wrongful convictions by holding a rally on June 21, 2008 in Harrah, Oklahoma at Heritage Park. Oklahoma's own "Innocent Man" Dennis Fritz and Tabitha Pollock who was exonerated in an Illinois Supreme Court after six years in prison are among scheduled guest speakers. Ultimately, we want to educate the public of this very real epidemic of wrongful convictions.

To quote Sommer's website, "Putting an innocent person in jail is the legal equivalent of a plane crash." Unfortunately, these "plane crashes" are part of a trend that is being seen across the country. With high profile cases such as Sommer's making the nightly news, the public is now opening its eyes to the reality that wrongful imprisonment can happen to anyone. In Oklahoma, awareness of our "injustice" system has gone virtual with the websites www.FreeKelseysMom.com and www.TheTruthAboutKelsey.com. These sites are in support of a woman named Raye Dawn Smith. Free Kelsey's Mom members believe Smith has been wrongfully convicted by a one-sided media blitz that altered public opinion and led to an unfair trial. During the trial, Richard Smothermon, District Attorney for Lincoln County, Oklahoma, stated that he believed Smith's daughter, Kelsey Smith-Briggs, was sexually assaulted and murdered by Mike Porter, Smith's ex-husband and Kelsey's step-father. According to Smothermon, Smith "should have known" Porter abused Kelsey. (Oklahoma Case(s) CF-06-00033 & CF-07-00134)Smith now sits in an Oklahoma prison waiting for her appeal to the 27-year sentence she received for "should have known." Her trial was based on the accusation that her allegedly enabling the abuse led to Kelsey's death. Just like Mike Porter's conviction was a punishment for allegedly enabling the abuse led to Kelsey's death.

If there was enought evidence to convice her, Smotherman would have charged her to begin with!

The investigators presented Smothermon with an arrest afidavit for Raye Dawn in late 2005.
Smothermon asked for the public's help and any information they may have regarding Kelsey's abuse/neglect.
Smothermon waited for a multi-county grand jury to hear all the evidence before he charged her with anything.

If anything that makes the charges seem more plausible IMO because Smothermon was thorough and didn't rush into charging anyone.

They knew it was a homicide the day after Kelsey's murder but Porter wasn't even arrested until a week later.

I think Smo took his time and because of that
I think the convictions will stand.

Ya Smotherman had to get his ducks lined up, and find people who would lie or make their stories larger than life. He also had to give Kathie her chance to threaten his position as DA, and for her to meet with some of the prosecutions key witnesses to get the story "straight" with everyone. I see now Shonya..good lookin out!!!!

Also I wanted to point out that if there was enough evidence to convict Porter of murder I don't think Smothermon would have offered him the Plea deal.

Even Raye Dawn's Attorney Stephen Jones stated
this about D.A.Richard Smothermon in Raye's appeal,

"and though he charged Mr. Porter with murder, he knew or suspected that the evidence was insufficient to prove him guilty beyond a reasonable doubt in a fair trial," Jones said in the appeal.

So let's see if they can convict RD of murder "beyond a reasonable doubt" in her next trial if she gets one. Any bets? LOLLOLLOL The last jury would have convicted her of murder had they that option. The next one will.

Even Raye Dawn's Attorney Stephen Jones stated

Didn't Smothermon say DURING HIS CLOSING ARGUMENTS at Raye Dawn's trial that he didn't charge her with murder because the evidence wasn't there to support it.

Wasn't that AFTER Mike's plea, AFTER the 2nd Autopsy? AFTER all of the evidence had been reviewed?

So it only stands to reason that he wouldn't bring murder charges against her when a new trial is granted.

I would suspect that when she is granted a mistrial, Smothermon will try to do a plea deal with her just to avoid another trial.

I hope you don't have money riding on that. She will not be "grantedd a mistrial". And RS will NOT be offering her a plea deal, why in the world would he want to "avoid another trial"? Is THAT what she is counting on? That she will eventually be offered a plea? LMAO He has nothing to fear from a new trial, he didn't use everything he had in the first one. She won't get a new trial, but if she were to, her sentence will most likely be longer.
And here is why it WOULD "stand to reason" why he would bring murder charges against her the next go around.

C. A person commits murder in the first degree when the death of a child results from the willful or malicious injuring, torturing, maiming or using of unreasonable force by said person or who shall willfully cause, procure or permit any of said acts to be done upon the child pursuant to Section 7115 of Title 10 of the Oklahoma Statutes. It is sufficient for the crime of murder in the first degree that the person either willfully tortured or used unreasonable force upon the child or maliciously injured or maimed the child.

Did you NOT READ THE PART where I said that RICHARD SMOTHERMON said during the closing arguments that he didn't have evidence to support a murder charge? Get over it already, that is just wishful thinking on your part.

And exactly HOW would you prove that she acted willfully or maliciously?

I would be MORE THAN EXCITED to place a wager that she is granted a mistrial based on the 2nd motion for mistrial that has been turned into the the Appeals Justices.

You really should keep up with a case you wish you knew so much about. The second motion for a mistrial has been STRICKEN by her own attorney. At the present time there IS NO motion for a second trial.

Really? That is THE SAME THING Michael Porter said when he was offered a plea with LESS prison time!!! Interesting to know that "shows the integrity he has in himselfand the truth!!"

No, you stick up for RD, I do not stick up for Porter. He is guilty too. But so is your Prison Princess, Raye Dawn. Porte is sitting in prison where he belongs, so is RD. Porter himself stated that him knowing and not doing anything about it, was just as bad as if he did it.(something to that affect)

He is sitting in some prison cell, in some state, QUIETLY serving out his prison term. he at least admitted SOME responsibility, which RD has not.
