p.s. Mariisa: Trust me, I'm not trying to be difficult--it's just that I've said essentially the same thing in as many different ways as I know how to say it.
A. I don't know if Higbee's guilty or not, in terms of our criminal statutes at least.
B. I doubt seriously that he's going to undergo a spiritual awakening of some kind and then enter a guilty plea to the charges
C. Given A and B I can't think of any other way to resolve issues of guilt or innocence without the help of a jury.
If there's something I'm missing please let me know.

I just hope our families are safe on the road when these officers are doingA BUCK-TEN as admitted by the commander under oath? really, none, do you think this gives citizens and other officers (who I am sure could not believe that
crazy comment) a feeling of security we are talking about essentially a rural-based area not street of LA with high crime and high- speed chases. If the commander has that point of view and he is the one teaching his officers- Wow, is anyone safe on the road? Oh, if there was a speeding car as you said this officer was chasing, was the outcome worth it/ do two wrongs make a right? A stop sign is a stop sign- period. |

there is no such thing as a "no contest" or "nolo contendere" plea in New Jersey. A criminal defendant must choose between "guilty" or "not guilty."

Mariisa: I have never adopted the view that there was a speeding car. I've said repeatedly that I was not there and I don't know exactly what happened. I did mention once something along these lines: "The speeding car, if there was one ...." Elsewhere I noted that a speeding car was the defense theory--but again I don't know and that's why we have juries, to determine witness credibility.
As to your specific question, I have no problem with a cop speeding if he/she is able arrest some dangerous individual who might have gone on to take some innocent family hostage, to facilitate his/her escape. The scenarios are endless. Now that I've answered your question, when are you going to answer mine about any alteratives to putting a case before a jury? |

enough with the jury stuff- we are talking about the people who are supposed to be protecting us making good judgements I am talking about getting to the root of the problems so no one else is harmed over making bad choices. Yes, unfortunately some cases need to be settled in court with judge and jury it is a little scary however some of the people selected in the cattle- call post cards- knowing some people personally who have served on a jury- and their educational
and vocational background -I would not want my fate in their hands |

I live in northern Illinois and we just concluded a trial that is strikingly similar to that of the troper who hit the two girls at twice the posted limit. you can read the full story with many comments if you goggle rrstar. by the way the sheriffs deputy got off, but my opinion is he was improperly charged. I urge you to check this out we have quite a lot of outrage over the verdict in this area

I think it is really terrible that this case has
been dragging on so long. The two girls poor mother is a saint for patiently waiting for a verdict. Why don't they proceed already and let her have closure and try to get on with her life without her daughters. If I were their family I know I couldn't remain silent about this trial or lack of. |
