Info on fraud and Rico applicable to bad faith insurance carriers.

Fraud:
In criminal law, a fraud is an intentional deception made for personal gain or to damage another individual; the related adjective is fraudulent. The specific legal definition varies by legal jurisdiction. Fraud is a crime, and also a civil law violation. Defrauding people or entities of money or valuables is a common purpose of fraud, but there have also been fraudulent "discoveries", e.g., in science, to gain prestige rather than immediate monetary gain.

Additional Note:
Per the California Department of Insurance, the above note would apply also apply to the denial of disability benefits by an insurance carrier in the event they carrier deliberately lied about, discarded, omitted, misrepresented information in the course of reviewing a claim of disability for the purpose of denying that claim.

RICO Statue violations have also been found to be applicable to bad faith insurance carriers, example can be found in the case below.

Humana v. Forsyth (1999), which subjected the insurance industry to liability under the federal Racketeer Influenced and Corrupt Organizations Act (RICO).

Definition of RICO
The Racketeer Influenced and Corrupt Organizations Act, commonly referred to as the RICO Act or simply RICO, is a United States federal law that provides for extended criminal penalties and a civil cause of action for acts performed as part of an ongoing criminal organization. The RICO Act focuses specifically on racketeering, and it allows for the leaders of a syndicate to be tried for the crimes which they ordered others to do or assisted them, closing a perceived loophole that allowed someone who told a man to, for example, murder, to be exempt from the trial because they did not actually do it.

RICO was enacted by section 901(a) of the Organized Crime Control Act of 1970 (Pub.L. 91-452, 84 Stat. 922, enacted October 15, 1970). RICO is codified as Chapter 96 of Title 18 of the United States Code, 18 U.S.C. 19611968. While its original use was to prosecute the Mafia as well as others who were actively engaged in organized crime, its application has been more widespread.

Thanks for your post.

I have excellent claim review records and I am currently completing an extensive binder of back-up documentation that clearly proves my allegations of The Standard's bad faith claim tactics to be true. I have far more than just a claim file. My claim review process and claim file has been investigated so well that an attorney has little left to do in "proving" my bad faith allegations against this insurance carrier. It is important to note that I was a private investigator for 7 years before coming down sick with fibromyalgia, and I also have over 25 years of administrative office experience that has enabled me to investigate and record the bad faith tactics throughout the months.

Standard Insurance Company Sucks. Currently fighting with them to receive ltd benefits for husband dying of cancer. don't know whether to appeal their decision or just get a lawyer.

I have been fighting with The Standard since January to receive disability insurance! They don't return calls, their claim representatives are rude, and they drag their heels! I would love to know who to report them to and how to go about filing criminal charges against them for fraud and theft! They take your money every month for premiums, yet when it comes time to pay out for a claim, they are out to lunch! 7 months of inaction and denial of my claim has caused MAJOR problems, and I can only imagine how many others are going through this with them! Something needs to be done!

I had a situation arise whereby Standard issued LTD policies in Washington State. Due to my own research and discovered that the Washington State Insurance Commission did not allow Insurance policies to have Descreationary Authority Clauses in their policies. Standard was in violation of State Laws by including these clauses in policies issued in Washington State. My son had an LTD policy thru his employer with Standard. I filed a complaint with the Commission and eventually received an ammendment from Standard that retracts the clauses. This event may not mean much to most people but it is of critical importance if and when you are denied benefits and file suit. This allows the claimant to have his case reviewed under the De nova standard rather than the Arbitrary and Capricous standard. Arbitrary and Capricous standard is a very hard standard for a claimant to prove. To date there are 19 states that have outlawed Descreationary Authority clauses and the number is rising. The NAIC ( National Association of Insurance Commission) issued a guidance for State Insurance commissioners to issue a ban on this authority. This was in @ 1994. Only 19 states have agreed to do so. The Insurance Industry is fighting this requirement because they want to continue accepting premiums and denying legitimate claims. I can be contacted at tpequip@usit.net.

I have been fighting The Standard since July 2012. They are ignoring my calls now. I have multiple medical problems and my doctors can't believe I have not been approved. If there is a class action suit, I'm in!

My husband has been labeled as "totally disabled" by 4 different doctors. Yet the standard hasn't paid and neither has workers comp. even our attorney is exhausted trying to get something done!!!! It's all a scam! I'm convinced of that.

I used to work for Standard. I am not defending them in any way but I think one of the huge problems with that company is the Peter Principle. That's the one where a person rises to the top of their level of their incompetency.

I saw that all over the Standard as the people in charge took over from those who knew what they were doing were replaced by those who got there by means of politicking and chronism and just knowing how to play the game. IMHO, Ness is a perfect example of this as well as the rest of the others on top of the heap today. He knew no more how to rum a major insurance company than my cat. And I think she could have done a better job.

They do not know insurance. They do not know the laws. They pile on layer after layer of highly paid upper management while the lower paid peons do the grunt work with antiquated equipment that went out with the 20th century.

Many middle management people have no idea what their jobs are. The sit there all day making up flow charts and computer models going nowhere. Salespeople sell products that can't possibly get off the ground but they are not lying, they simply don't know they are selling items that don't exist.

Ness claims the company looses money to the high volume of claims. Not true. It's due to things like clients cancelling million dollar contracts even before they begin because Standard can't even get them off the ground. I wasn't supposed to see this when I was there but I did.

The Standard solution is to lay off more employees which they did. 100 this month. Many long timers.

All any one can do is discourage their company from buying into their product.

I too, am being screwed by the organized crime scheme known as "The Standard Ins Co." How do I participate in a class action lawsuit against this scum scammer of a Co? Mine is disability Ins I paid 20 years. They won't pay me 1 month of disability. Gary
