Dose an employer have the right to fire you over a post on facebook that had nothing to do with the company or them. Also The Employer Told Me I could not Use whistleblower law on them. I think they have rip my rights from freedom of speech and my privacy. Comments on your thoughts please.

yes they can. If you are representing a company or business and you are posting on a public forum in a manner that does not represent your company or business in the professional or positive manner they expect employees to represent them they have every right to terminate your employment. Some companies even have policies around this very topic. People need to represent their employers professionally in the public view; this obviously goes for some professions more than others but is always important.

I Had An issue at my job so i used my rights towards them and now they are retaliation on me

Call the unemployment office and ask. They will tell you facebook is the #1 reason people get fired these days. Sad but very true. And they can get away with it as well.

In WV you are a at will employee.They can hire you or fire you at any time.Remember you are paid for your time and service.Not to create problems.

Always remember people to keep your Facebook private and never friend a co-worker or boss. Then you shouldn't have these problems. Under all circumstances always set all your social networking sites to private. It's none of their business what you do or say in your personal life, but they will try to use it against you if they see it.

Hey, "private," if you're a person who is so stupid that you carelessly posted something on FaceBook that your employer shouldn't have seen, then the company was smart to dismiss you.

Does your company have a policy against you utilizing social networking? I don't understand why you would be fired if you didn't post anything related to your job, fellow employees, or the company you work for.

Yes, West Virginia is a work at will state, but Federal laws against discrimination, whistleblowers, etc. offer some protection.

What exactly did you post that they used as a basis for terminating your employment?

Did you get on Fb on company time?? Some employers have a zero tolerance for that. Thats silly if they fired you for that, but jerks will be jerks. They were looking for a reason to let you go, and that was their excuse.

nothing was said about company or anyone.
The Hand Book policy didnt even match to the handbooks that we have. we checked 4 books and all was the same but the company policy book they had said no social networking, Our Company policy employee book says nothing about social networking. we have check 4 books we think that it was a set up by the paper. look like it was made up and it was false and not real,

Please don't tell us the name of the company, but what kind of company is it?(Such as it a manufacturer? or a retailer? or a food service organization? or a building contractor? or a consulting company? or a school/college? or a ____?)
