This will certainly go down as an unfortunate accident with no charges based on it being dark and the pedestrian being drunk or impaired. However, drivers continue to drive blindly without regard to peripheral vision. It's as if they have blinders on and expect nothing to move in front of them. When they do see something, they expect that something to get out of their way. You can observe this when a squirrel or duck comes into the street. Some people will brake to avoid killing the animal. Others never lift off the gas and assume all will be clear. It's almost a game with them. They don't change their rules when the obstacle is human.
