The mother of a girl who fractured her ankle while playing kickball during summer school at Dakota Meadows Middle School has reached a financial settlement with the Mankato School District.

Let's make the kids stay inside with helmets and yellow safety vests to protect themselves. mAybe before we put them on the bus or send them home we can bubble wrap them too.

And to think they used to let me play on a swingset, jungle gym, and teeter totters, let alone play kick ball....... what terrible teachers..... what were they thinking?

I guess pixels are free, but I hope ink and paper weren't wasted on this story. A news item only to people in the Mankato school district, and even there a 25k lawsuit isn't a particularly huge deal.

Another money grab. I'm glad to see that this was nothing more than some spare change. Kids got hurt on the playground all the time when I was in school. Just a fact of life. Nothing to sue over. The school would likely have had to pay the medical bills anyway, but to go so far as to set up an annuity payable when the kid is 30? this family should hang their heads in absolute shame.

The teacher chose an extremely slipery and dangerous item to use for a base. Next time try something like a hat.

So who would mommy sue if she was playing kickball in the street and slipped on a rock? Or god forbid maybe tripped over her own two feet? She was playing kickball and got hurt, shocker of all shockers but that does happen every day. You know mom exercise? Yes hard to believe but some people actually think this is normal everyday behavior. Get a grip, this was a stupid lawsuit and these types of suits are going to keep happening as long as people are allowed to get money for their own stupid actions.

That lawsuit was absolutely ridicules and should have be thrown out of court. The mom played the lawsuit lottery and won and the tax payers lost.

Obviously you would have known this to be dangerous, I don't think that most of the rest of us would. In hindsight, of course we can see it may not have been the best choice...... oh it does say on the side of the folder box "Do not use as a base, as it may cause a slip or a fall".

Let's be realistic, when I was a kid we used anything we could to mark a base...boat cushions, pcs of wood, bottles, etc. I hardly think many of us would think that a file folder would be so dangerous, let alone be the topic of a 'pain and suffering' lawsuit.

I am not saying the school should not cover the medical attention, but I do not agree with the annuity.

So mommy has UCARE which is provided by State, her girl has a typical accident in phy ed and for some reason after all of her bills are entirely paid for by the State, she has to find herself a bottom feeding attorney to file another action against a school district. All so she can get herself some more free cake. Pathetic.

This mom must be a founding member of Keep Our Own Kids Safe.

Accidents happen, I wonder if this same mom allows her kid to play on the swingsets? Or how about running, the poor kid might trip and get hurt. What if the kid walks outside and a rain drop hits her in the eye!

Let kids be kids, let them get their boo boo's and their owies. That is how they learn to live in the world. What lesson did mommy teach her daughter?

Because it was a school activity and an object was used out side of it's intended use, the school becomes liable.

I am wondering if she would have been able to sue if an actual base was used instead of the file folder.

A beautiful thing would be to pay the lawsuit of which the lawyer gets a third and they don't get their money for years, but then deny the UCARE medical claim entirely that would be ideal !
