This arrest is totally bogus and if Harpin has any sense he will sue the city into the ground.

The courts have restricted the meaning of the disorderly conduct statute in the Commonwealth to such an extent that it basically doesn't exist any more. Nothing short of incitement to riot counts as D.C. in the Commonwealth, and every last police officer statewide knows it. And if the D.C. charge was bogus, the Resisting Arrest charge is also bogus.

This guy should brutalize the city and taxpayers of North Adams until there's nothing left.

Except that this guy has been brutalizing tax payers for years! This feud with his neighbor is nothing new. They are always calling the cops up there for some stupid argument! Shut C St down and let them park on West Shaft Rd if they can't work it out!

In reading this article I am very confused. It clearly states that Mr. Harpin, who is obviously out of control of his emotions, verbally attacked and/or physically resisted, not only his neighbor but police officers and high ranking city officials. Yet in the article it states that no charges were brought against him for resisting arrest or disorderly conduct. It clearly states that he was disorderly and resisting. Perhaps this "private dispute" should be a public one if such obvious disregard for the law is being allowed by the NAPD.

"Bush said in the report that Harpin began yelling at the three men and slammed his house door on them. Cozzaglio convinced Harpin to open the door to listen to Green, which resulted in Harpin coming out of his house and screaming obscenities at the men. He was asked several times by Cozzaglio to stop screaming and to calm down., according to the report. Harpin then went back into his house and the three city officials walked down the driveway. The report says Harpin again emerged from his house once again and continued to scream obscenities at the mayor and police director, which led to him being arrested for disorderly conduct.

Harpin allegedly began fighting off the arresting officers and had to be wrestled to the ground by Cozzaglio, Bush and Officer John LeClair, according to the report, but police did not bring any charges of assault or resisting arrest. "

Hmmm. If he was Henry Louis Gates, the right wingers could claim that the police were "obviously" doing the right thing. But since he is white and in North Adams, the right wingers are getting all "libertarian" about it. "Arresting a man on his own land for doing nothing wrong...."

Odd, if you think about it. What is the difference? Oh yeah, Gates is black.

It sounds like a judge is going to have to sort it all out.

Seems to me the people are running the town up there maybe I can move in, fight with my neighbors have loud parties all night long, slap around a few City Council people while the police watch with not arrest taking place. Sounds like a good nesting home for me and my homeBOYZ. See ya soon nice guyz......

C st. Is a city street and LaChapelle and her latest live in boy friend have altered the end of the paved area so that the abutters on B and D street can not acces their lots.I have an original map of what was called the Brundage Farm subdivision when A,B,C,D, and E streets were laid out and they all are the same length and run all the way back to the Drury High School property.The city looked the other way as the C st. right of way was sealed off and it looked the other way as tar soaked rail road ties were burried on C st. I urge Mr. Harpin to remain calm and call the DEP and let them know of this hazardous material being used as a wall. I also urge Mr. Harpin to contact a good real estate lawyer and see where he stands. I had a right of way problem with a pushie neighbor and I went to Harris Arronson in Pittsfield and he set things straight for me.He is a well know lawyer who is well versed in real estate matters.And forn the record, I lived on B st and owned property there for thirty years and C street was never blocked off.The city is leaving itself wide open to be sued by all of the abuters whose property ir being denied access by this nonsense.

I have known Pam LaChapelle for approximately 3 years and in these 3 years there has never been a day that she has gone home to peace. She has retained lawyer upon lawyer, gone to numerous city council meetings, and had a personal conversation with Mayor Alcombright, ironically right before she helped spearhead a winning campaign, regarding her nightmare neighbors. Seems to me that everyone involved is passing the buck to save face and I agree with Jodi in asking why weren't any charges brought upon Mr. Harpin for his ever present psychotic state? Is there anyone in the Mayor's office or police office that would care to explain? Mr. Harpin, Ms. LaChapelle has already given you one gift in not pressing charges for the incident with her daughter's car...hell I think she has given you way too many gifts in turning the other cheek. Leave them alone, walk to your mailbox and gather the check that not only Ms. LaChapelle works for you to be able to collect but also myself, and get on with your life. I can't say that I would expect any more tolerance on Pam or Kurt's behalf. Time for some explaining North Adams!!!!!

I don't want the city stepping in every time neighbors feud. It sounds like the cops acted when things started getting beyond "dispute" and heading towards trouble.

Now a judge will start setting the rules that these supposed "grown-ups" should have learned in 2nd grade.

Sounds about right. The NAPD kept things from going too far, but the city decided not to pursue the charges after peace was restored. Bully for the Mayor and city officials present for showing some restraint in the face of some pretty aggressive behavior by Mr. Harpin.

Pam LaChapelle blocked off C Street with railroad ties, because she wanted to display her harleys, where she used to park her cars.

Isn't Mr. Harpin the son of City Councillor Marie Harpin? Isn't he on Disability because he didn't put down the outriggers on a brand new crane? Didn't his mother, City Councillor Marie Harpin, sue the City of North Adams? Is this the same guy that was stabbed in a drug deal in Albany? The City has no obligation to provide Marie Harpins son with access to his back yard.

Actually, the charges were pressed by the NAPD and DA's office since the boy admitted to throwing the rock. In better days, when people were held accountable for their actions, when I threw a rock and broke a window, I fessed up to it, as did this little lad, and had to pay for the repair. This, of course was done by working for the money by mowing someone elses lawn. The mowing may have been a little uncomfortable, since my butt hurt from the spanking (OMG kids actually used to get spanked for something like that).These days however, we teach our kids to lie about the incident and use the system to get out of it. Even to the extent of letting the child go in front of a jury of six. Well, we agreed to let the fee be lowered from the actual repair cost to a level that would not have it at a feloneous event and keep the boy from going in front of a jury. We are soooo bad. Unfortunately, six people had to miss work for this. Kids should definately be kept out of disputes and not groomed into acting out.

Barrett was always up in people's business. He'd park the city car, get out, stand with the door open and start yelling into the city cell phone to "Get somebody down here!"

If the property owner approached Barrett he's start his classic tirade about "rules."

But usually nothing would happen until Morocco, Meranti or Leo showed up and did the dirty work.

After reading this article, I feel I need to write about a few of the comments made to help clear the air about this on-going, nonsensical, issue. This whole mess began, as many do, with all good intentions on our part as well as the part of the city planners and governing bodies. After receiving a notice back in early 2008 that the city, in a very pro-active way, was soliciting comments concerning the upcoming improvements slated to be made on W Shaft Rd as well as the feeder roads joining it, Pam LaChapelle and I wrote a response informing the city we were totally in support of any "improvements" the city was about to undertake and wished to meet at our lot to discuss improvements we were willing to make without cost to the taxpayers of NA. The City Admin., Engineer and Highway Super. made an appointment and we met in a timely manner. I told them of my plan to increase the parking area available to us by excavating into a hillside on Pam's property so two vehicles could be parked. At this time Pam had both of her daughters and their friends at the house quite often. The improvements were approved. Well, we rented equipment to clear the land and prepare the site. Mr. Harpin attempted to file a stop order on the work we were doing on Pam's own property. Since that time, to make a LONG story as short as possible, we have been brought into court on numerous occassions for unsubstantiated claims, harrassed many, many times, there has been damage to our vehicles and property as well as material stolen from the property. I was even assaulted and my life threatened, which cannot be discussed since it is presently being heard in court. All this, while Pam was being gracious enough to "allow" these "neighbors" to utilize her property to access W Shaft Rd. Well, the last straw was the third time I found the car I had just given to Pam's daughter, my stepdaughter, with the air let out of a rear tire and she had driven home from work that way. Now, that made the hair on my neck stand up since she could have been killed or hurt someone else if she had lost control of the car, and access was denied. The city brass responded as is outlined in the story with all good intentions. But the situation went from bad to worse. I am told the city went to court the following Monday and had our access to W Shaft Rd designated as a Public Right Of Way (ROW). Now, Solicitor DeRosa, your quote that "C Street is a public way, which is plowed, paved and marked like ANY OTHER STREET IN THE CITY" is very misleading. Pam's property, which has been signed as C St. for years has been maintained by she and myself more than any city worker. It is only 15 feet wide. For years, I parked a Dodge Diesel P/U truck with a plow and removed the snow with it. I purchased a LARGE snow thrower to maintain our driveway as well as the sidewalk along W. Shaft Rd. I used to clear from E St to the bottom of the hill since an elderly neighbor walks to catch the bus daily to attend church. This practice stopped when the police were called because I was clearing the sidewalk at the bottom of W. Shaft Rd. The responding officer commented how nice it was to have the sidewalk cleared. It is a city ordinance to maintain the sidewalk in front of you home, you know. Before I arrived 6 years ago, Pam would shovel for the exercise and continues that practice today. The city has plowed and applied sand on occassion, once even hitting her home and knocking the nice brick chimney down from the house. It was replaced though, with an inexpensive cinder block affair. We really hope the last attempt we are making to resolve this nonsense, without cost to the already overburdened taxpayers, will not meet with such adversity. AS for the comment made by Mr B St now on D St, Pam and I are married and I have been here for 6 years. This is a fourth generation property and you, nor anyone else, ever had access over it, except for 88 W. Shaft Rd. We have photos. Grow up.
