I stopped by Arby's this evening around 7 thirty because I noticed the now hiring on the sign out front. Just so happened the owner and his wife were sitting in the dining room working on what appeared to be the schedule. I approached him and simply asked "are you still needing help" and his immediate reply was "I am only Hiring GIRLS"....I was so stunned by this response I only said O.K. and left. Although a lot of other responses came to mind. He never asked about my Education, experience or anything remotely concerning the Job. He denied me so much as an interview simply on the basis that I have a PENIS!!!

Either ur lying or he can be shut down with one phone call. It's on labor law posters anywhere. U can't not get hired based on gender. He can't do that. Call labor board and he's fired

I know How illegal that is and he was pretty straight forward about it!

Go back with a voice recorder and try to get him to repeat what he said, then the evidence will be on tape for you. If what you said is true he is violating the law big time!

Get over yourself...You are not going to do anything that amounts to a hill of beans. What purpose does it serve getting your boxers or should I say panties in a bunch. Just be happy you don't work there and find a place that would respect your gender more - LOL Maybe he already has too many guys working for him or the lst 2-3 guys he hired were worthless... or for all you know he is gay, finds you cute and does not want to be tempted..Get over yourself.. Blah Blah Blah..."I am an american and deserve every opportunity to work as anyone else no matter my gender, race or religion" The only mistake the guy said was saying what he was thinking...

Joe, yo are right. I was a hiring manager for many years. If what you say is true then it is illegal. The guy may have many reasons for not hiring you, but what he said was wrong. I have a list of things that you can and can not say in the hiring process as of 2007. That is the last time they sent a revised list. It is a long pamphlet, but very informative. Everyone who hires people should have this. Once someone asks you(or applies) for a job and you cant say or ask certain things until you have turned them down or hired them because they are prospective employees and are in the hiring process. You cant ask them if they are married, have children, or even if they have reliable transportation. These are no longer legal because it is discrimination. Telling someone that you only hire women definitely falls into that category. BTW, it doesn't make it legal and ok to turn someone down then offer illegal reasoning.

Trust me I know the business and know it's illegal. I just thought the People of this town should know who they are doing business with when they eat at arbys...I hate scum like that.

You are wrong about that. It varies by state, but in KY, it is perfectly legal to record someone without their knowledge as long as the person recording is a party to the conversation. As far as the owner getting into trouble, the most that is likely to happen is bad publicity for him. The human rights people are only going to get involved if public money (tax dollars) is involved. Otherwise, Hooters would be out of business.

He does only hire women, and the only reason my niece got hired was because when she went in there to ask for an application she had a v-neck shirt on. He wasn't even looking at her face, he was looking at her tits. She worked 12 hours for him and once they found out who her boyfriend was he never called her back and it took threatening him for her to get her check.

I sure would not want to battle wits with a genius like you. It is you're not your as in "You're a dumbass and not your a dumbass." What a tool you are and no wonder he did not hire you. Besides, people like you feel they are entitled to something as in a job just because they apply. Please take all of your time and try to push the issue so that you can make an excuse for not finding a real job. Here is an idea, if you really want to get back at him, go work for one of his competitors, move up the ranks, do such a tremendous job to become manager and crush his business with your great management of a competing store. Wait that might actually take work, it is so much easier to bitch about it and maybe even sue to get some money that you never worked for.

In KY, ONE person needs to know that a conversation is being recorded, NOT both or all parties. IF interstate phone lines are NOT being used, only KY laws apply.
