Ky. man charged with stalking local ex-wife

HUNTINGTON — A northern Kentucky man returned behind bars Tuesday charged with stalking and threatening to kill his ex-wife, who lived in Barboursville.
Mark A. Smith, of Newport, Ky., was arrested Tuesday after a local FBI agent charged him with interstate stalking, according to documents filed in U.S. District Court.
The criminal complaint indicates the allegations stem from an incident in April 2009. His ex-wife had driven to Newport to pick up the couple’s 5-year-old son on April 5. She then returned to her residence in Barboursville.
Shortly thereafter, the ex-wife received 62 text messages from Smith within nine minutes, the complaint states. It charges she also received a cell phone call that lasted five minutes, during which the ex-wife told the FBI that Smith had threatened to kill her saying,“he would rather their son have no mom than a bad mom.”
The ex-wife called 911 fearing that Smith was en route to her house, according to the complaint. Dispatchers informed her law enforcement could not respond until he arrived.
That happened at 12:40 a.m. April 6, the complaint states. The ex-wife and her boyfriend noticed a car pass by. A few minutes later they heard glass break in a back door.
The complaint states the ex-wife and her son hid in a bathroom and she called 911, while the boyfriend cut Smith’s arm with a knife to prevent him from getting inside.
Smith proceeded to break other glass in the residence, including a concrete object that landed on their son’s bed, according to the complaint. It further states the Cabell County Sheriff’s Office arrived at 12:47 a.m. and took Smith into custody charging him with misdemeanor destruction of property and domestic assault.
Smith was incarcerated at the Western Regional Jail from April 6, 2009, to Sept. 23, 2010. He was released upon a magistrate’s decision to reduce his bond. The ex-wife learned of his release by checking the jail’s website and then called the county’s victim/witness coordinator, according to the complaint.
The FBI then moved to file the federal charge on Tuesday. Smith’s second court hearing is set for later this week, according to court documents.
The complaint states Smith and his ex-wife had been in a long-term relationship, which included a five-year marriage. They divorced in 2008. The document details a long history of domestic violence, which included the ex-wife obtaining three domestic violence petitions against Smith.

Yeah, really...getting kinda old hearing about all of the Ft Thomas and Dayton people getting arrested here lately.......
