We are presently in a mess due to a local supposed contractor who was paid in full and did not finish the job, and the job that he DID do is having to be torn out and redone before the room addition on our house falls in. We contracted this contractor on January 6, of this year for what was supposed to be a two week start to finish job, and to this present day, the job was never finished and we have hired a new crew to come in and fix the mess. I have many many pictures of this mess if you want to see them. If any of you have been involved with any renovation contractors in New Tazewell or in the surrounding areas and would like to join us in a lawsuit to stop this man and his crew from ripping off anybody else, feel free to post here and I will get back to you. If he has done us this way, I am sure that there are many others like us out there that feel there is nothing that they can do, but there is. and if you want to know the company name, just let me know.

PLEASE PLEASE before you hire anyone from New Tazewell to do any work for you, post their names here, and I will let you see some if not all of the pictures I have of what was supposed to be my dream room.

Tony's Lawn care!!!!! His office is in a dump of a trailer on Hwy 33 just past walMart.

Ok, so you hired a Lawn Care company for a renovation? If thats the case, I dont feel half as sorry for you as I did before.

He owns a contruction and renovation company. He is more widely known as Tonys Lawn Care. That is why I used that name.

You're not alone. I wish I had read this post sooner. Unfortunately, I listened to others and did not stop my parents from hiring Tony Wade to do their roof. He has still not finished their roof after three months. It amazes me that he continually gets away with this. I have notified him that I will contact a lawyer if the roof is not finished by Monday 12/08. Their front porch is now a sheet of ice and I am EXTREMELY concerned that someone is going to get hurt before I can get it fixed. He's a thief and prays on the elderly.

I must sympathize with you, but try giving him a contract last January to build a room extension on your house and it still was not finished last month. We were distraught what to do because the sheetrock looked so bad around the windows and he said he could frame them, at our cost of course and then when I gave him another 968.00 for him to finally finish the room, I went inside the house to shower to get ready for work only to come out and he and our money was gone. The room was ready to fall in and we had to hire another crew to come in and fix it and finish it. We had to tear out everything he had done and buy the same materials again to get it fixed. And this is the worst part, when we tore out part of the sheetrock, we did not find new insulation, that he was supposed to buy, but our own insulation that he had taken out of our roof to use!!!!!! If anyone here does not believe me, I have color pictures to prove this. the room is finally done and we have gathered our bills together and we are going to a lawyer. When the new crew came in and started to tear out his shoddy work, the ceiling that he had filled AND painted was cracked so bad we could not figure out why it had done this, but when the front section of the room was tore out, there was absolutely nothing holding up the room and most importantly the roof!!!!I am personally going to see that he does not do this to anyone else. If you want to you can join us in a class action suit, because I am sure that there are others out there that this crook has swindled. And by the way, he has a 700 Kawasaki four wheeler of ours that he does not have the title to, that was supposed to be partial payment for the room, so if he tries to sell it, he does not own it!

You know, as for a contractor doing shoddy workI had a horror story myself. Police refused to help in fact thinking it was funny. They tried to tell me that my problem was a "civil" matter. Had I took their word then I could have sued a deadbeat guy and got judgment and collect 100% of NOTHING. I took the criminal law approach. When someone misrepresents himself to you so as to CHEAT you out of money, he is a criminal. I stacked 6 criminal summons on him and got the theft over 1,000 bound over to the Grand Jury. i went there and got his butt indicted for a felony theft. Within 3 months he was paying me back in monthly payments and withing 4 months had ALL my money back, no thanks to the "system" but to having the wits to take on adversity. If you are in Tennessee contact Nashville or go to your county clerks office and file for a lost title. Within a couple weeks you will get a NEW title thereby voiding out the old one. Then, grab any cop and take him with you to the dudes home and get your motorcycle and stuff back. If he refuses arrest him on the spot for theft as a citizen (if the cop refuses to) and then turn him over to the officer. It works. People seem to have this strange mindset that we need other people to do things for us. Police owe the general public absolutely NO duty. Look up the massive caselaws on that. The police owe a duty to the government only. In fact, if they saw you being beaten to death IF they didn't run over and help you they are not neglegent as they owe us no duty to protect or serve us. Get a new title, get your vehicles or lock him up. It's that easy.

The fact of the matter Tony never did have the title. While he was working on the room, he asked if he could go ahead and take the 4 wheeler because he had some fencing to do. We never gave him the title and we still have it. He has no proof of ownership at all, period. That was the only smart move we made in this deal. When you have to work for a living you cannot stand over a supposed contractor and watch every move they make. But one thing I do have is every bill for the material we bought BOTH times, and a heck of a lot of pictures starting with what the room looked like when he left, during the tearing out phase and repair and the finished product.

Why not swear out a "Criminal Summons" on him for stealing your 4 wheeler. After all, he took it under a "deception". Deception is a key element to a theft charge. If the theft is over 1,000 (which the 4 wheeler is) then that's a felony. He can go to state prison over that. Nobody like jail. Use the courts legal criminal system to your advage and then step across the hall to the civil division and attack his possessions. Hey, don't waste your money on lawyers, go after this guy yourself and force him to pay up whether to you or HIS attorney fees.

I may do a series on the topic of "how to use the criminal summons to your advantage" as well as a few tried and proven ways to "get even" legally. So you say, to forget the lawyer, and charge him with theft. Will the legal system allow me to get the four wheeler back? I was wondering, why should I pay a lawyer to do what you say I can do for myself...... keep talking, I appreciate the way you are trying to help!!!!!

yes you can get the 4 wheller back just call the poiice dep and tell thim you wont some one to go with you to pick it up and sho thim you have the pappers for it if you dont have the pappers you wont beable to get it tho

Yep, there ya go. Just be sure you can show "ownership" of the 4 wheeler (title). Now he will probably rant and rave about how he did this, for that, bla bla bla, but that is NOT for police to decide. That is something civil and he can go to the courthouse and try to sue you or something. In any event, they communicate to him and to you to tell all of that to the judge as their only dog in the race is to RECOVER what appears to them to be YOUR stolen property. Want to do this without police? Simple walk into your courthouse to the circuit court clerks office and raise your right hand and swear to a "criminal summons". It costs you nothing at all, unless the charges are dismissed or something. Then that would be only the "cost" and cost generally are less than 100 bucks or so. But by doing so, you get a FREE lawyer. The state will by law have to assign you a lawyer from the "District Attorneys Office. It is they who prosecute all crimes against the peace and dignity of the state. And theft is against the peace and dignity.

No matter how it turns out, even IF you gave him the 4 wheeler for some sort of payment for 'ALLEGED" work then your position could be NO BY HELL I DIDN'T. HE STOLE IT. From all accounts that I have read here, it seems a reasonable mind could conclude that you have been raped financially by a swindler disguised as a contractor.

Just as this poster said, be sure to take police with you. This is Most important. Take them with you as you do not want to be on HIS property where he holds all the favorable cards. At most, all you did was "lend" this guy a 4 wheeler. Either that or he stole it because they will ask you "well Hank, just how did he come into possession of YOUR 4 wheeler IF you didn't give it to him, or sell it to him". That old law called "Larceny after trust" fell into all those catagories of theft and were all sort of gathered up and placed under just "THEFT" which at the end of the day is all it is anyways. You trusted him and he decieved and stole from you. If you have a wife, well, it made her a nervous wreck and the worry of it all....add all that stuff in as "punitive" IF or when that time comes.

Also, any sort of adversity is stressful as hell. Trust me on that one lol. But you stay calm, have a game plan, stick to it, and educate your mind in reading things, asking around and use the Internet to find anything you want and you'll be able to hold your own. Most legal battles are fought and disposed of rather quickly because for 1,500 bucks you may be lucky to get 10 hours of time from a lawyer. So most people just take it and live with it. Well, people like us DO NOT, right? LOL

Remember, sometimes we must think outside the box and stand up for ourselves. Lawyers are GREAT, just expensive as hell. But if you are able to understand rules, procedures, etc., just as in learning how to change the brakes on your car, or learn to play chess, you can surely be able to handle your own in the small claims court of your county and in Tennessee, that court is generally the Sessions Court Judge. And for those people that say Abe Lincoln's old ramble of..."a man who represents himself has a fool for a lawyer" well, you'll find that the only ones that say that have a law degree. Naturally, they do not want me and you to read a Court Rules book and learn a few latin words. Just as Instant Oil change shops don't want us changing our on oil...

just make shore you dont go to his house a lone and i know him and dont like him i worn you his old lady is a smart ass dont let her walk on you she will try to just make shore you have your pappers with you and you have the police as well do not i repet do not go to his house a lone i hope you the best and if i was you when you get it back make shore you keep it locked up where no one can get to it i know tony and like i said i do not like him and do not trust him i cood tell you things that wood make you hair stand up on end lol but we wont get in to that lets just say what you do rong will come back home to you and i will be glad when he gets his good luck to you

this seems like a civil suit or civil court action, not really police work.
First of all, if the "office" is in Burchfield, hat's a red flag. Second, have you seen the lawn care work? my dog shits better mulch!

If anyone doubts what truthbetold is saying there is a glaring example of Tonys work right on the side of HWY 33!!! Just drive by the recycling center across from LLI's truck garage. He "built" the fence surrounding it. If you will notice, it is uneven and leaning over in many places. One good windstorm and it is a goner!
