How do we get in touch with any law suit that is against them, I paid for this warranty on my new home and acutally need to use it!!!

I'm in Tulsa Oklahoma, have a home warranty with Durr ,air conditioning is broke and all i get is a busy signal , guess by listening to everyone else i'm screwed.

Im in Oklahoma ,have a warranty with Durr, it expires in June and my air conditioning is out, guess I'm screwed and wasted my money according to what everyone is saying.

Yes, JLE, you are basically screwed, but we need to make sure that Durr does not get off from this scott-free. Make it a point to every day contact at least one consumer advocate, state's attorney's office, or law enforcement official or reporter. If we keep on pursueing this, at least we can hope for justice if not compensation.

My husband and I had the same problem with UA Durr and we are only out $200.00 but i did inform my realtor and was told they are using another name now, as soon as i find out what it is i'll be sure and tell everyone.

WE HAVE BEEN IN OUR HOME FOR A YEAR AND HAD UA DURR FOR OUR HOME WARRENTY,WE HAVE CALLED SERVERL TIMES. ONLY TO NOT GET OUR CALLS RETURNED ,MY HUSBAND FILED 2 CLAIMS AND THIS TIME OUR AIR IS OUT . WE HAD TO CALL (BEL AIR A/C AND HEATING SERVICE)THEY CHARGED US $120.00 A HOUR PLUS A $50.00 FEE TO OPEN UP PARTS WEARHOUSE BECAUSE IT WAS ON THE WEEKEND.... WHO DO WE RECOVER OUR MONIES FROM THIS WAS COMING OUT OF MY HUSBANDS ACCT EACH MONTH!

Check this out, UA Durr received 92,000 in taxpayer money. I wonder if Durr paid that back yet? The govt might not mind if a several thousand customers and contractors get screwed out of their money, but they might care if it is them. Contact your congresspeople and articulately and politely request a thourough investigation! Also contact the IRS.

I saw the handwriting on the wall in summer 2007 when they failed to replace the pump for my pool. (I had paid for full coverage.) I threatened legal action, but didn't follow through. I should have.

We are also a contractor out of central Alabama that did work for Durr as well. He owes us upwards of $10,000. We have also contacted an attorney, and were also told that it falls to the home owner to assume the responsibility of that debt. Good luck with your suit. |

I haven't seen any indication on the court database that his company has filed bankruptcy as of yet. You will spend more than 10K trying to collect from homeowners (and possibly very little payoff as it will just make customers angry). Durr may have the money as he just came into his inheritance. |

I absolutely CANNOT believe this. We bought our house 7 years ago with a homeowner's warranty through Durr. They had sent someone out here a few months back to replace our garage door opener with a new one - we were happy with the work but not so happy when the contract installer gave us a bill for $75 when our "copay" is and has been $50 for the past several years. We had not received any renewal paperwork stating that our copay would now be $75, but figured that this still wasn't bad, and the auto debits just kept pulling the money out of our account every month. Then, earlier this year, we had to have our A/C unit raised. Again, no problems with the contractors, but our warranty on the central unit had supposedly run out, and the runaround the contractors got from Durr about whether the unit should be replaced or repaired because the coils were corroded probably should have clued us in that something was amiss - that was just in February and March of this year! Well, our garbage disposal started leaking tonight, and I tried to log on to Durr's internet website to request service only to find the link no longer existed. When I called their telephone number, I only got a pre-recorded message that the number is no longer in service. Obviously, further investigation led me to this website. I checked our bank account to see if the debits are still automatically coming out for our contract with them for the home warranty, and it appears that the last payment withdrawn was at the very end of January. I must confess that I had gotten so used to seeing the debit every month for the home warranty that I had long since stopped checking to be sure that it had been paid. I don't go over my bank statement with a fine-tooth comb every month and generally am only alert to strange transactions I don't recognize, so I didn't notice that the automatic withdrawals had stopped. Like everyone else, I was also in the dark about them going out of business. Like everyone else who has posted here, I'm very disappointed and upset by the handling - or lack thereof!- of the situation. This was handled very poorly, and if not for my garbage disposal breaking down, I'd be completely unaware of Durr's demise. There really should be a law - if there isn't already - mandating that companies going out of business notify their customers of their impending demise so that folks can secure goods/services/etc elsewhere. When I'm done with this post, I'll be visiting the links provided in earlier post to log complaints too. There were several posts and I didn't read them all so if I'm being redundant in my question, I apologize, but does anybody know if the deadline referenced in earlier posts to switch to another home warranty company has been extended???

YOU MAY AS WELL FORGET GOING AFTER THEM. I GOT RIPPED OFF BY A CONTRACTOR FOR $34,000. HE RIPPED OFF 26 OTHER PEOPLE FOR SIMILAR AMOUNTS. HE IS IN LOUISIANA STATE PRISON FOR A MINIMUM OF 10 YEARS HARD LABOR AND JUDGE SAID HE HAS TO PAY RESTITUION TO EVERYONE WHEN HE GETS OUT. FOUR FAMILIES WENT AFTER HIM IN CIVIL SUIT AND WON JUDGEMENTS FOR WHAT WE LOST. WE HAVE NOT SEEN A DIME SINCE 2006.

Durr is Bankrupt and as a corporation their personal property is out of the picture. However, if they knowingly took money from customers and knew they could not honor a contract or renewal of same, they committed fraud which is a felony in every state including Louisiana. If found Guilty they could receive 10 years per count. However, if the cost is under $500, it is not a felony. As a homeowner you are responsible to the contractor, not the insurance company unless they contract the services directly for you and you did not sign anything for being responsible. Most cases you contact the contractor directly with an insurrance claim number. You pay a deductible and insurance company is billed for the rest. The same is for the contractor, if you paid him and he does not perform the work it is contractor fraud and is a felony if you lose more then $500. In LA it is 10 years per count and restitution upon completion of sentence. The contractor can not put a lien on your home without going through court process in which you are notified to appear in answer to a lawsuit of some sort. Contractors hope folks will pay the bill, and most who owe little will pay rather then go through with the agrivation. This will have a trickle down problem on most home warranty companies by losing their customers that will cause them to go bankrupt also. Pretty soon the contractors will be out of business also because we will hire the immigrants from Mexico and other countries to perform the same work at a much lower cost. Thank God for the immigrants from Mexico and Honduras or a lot of work would not have gotten done durring the Hurricanes in the southern states. A lot of the local contractors were not available. It was also the American Contractors that committed most if not all the Contractor Fraud. May they rot in jail. |

The IRS and FBI will not even investigate what you mention, I have been there. They are so busy with bigger fish to fry. After Katrina, I was ripped off by a black contractor from Philadelphia for $34,000. He was a storm chaser and Con Artist. He hired immigrants from Mexico and Honduras. The immigrants worked hard, but were no expertly skilled. He paid them little and started a Pyramid Contractor firm. There were plenty of early customers he used to prove he did good work at a reasonable cost, not low, not high. He conned more than 26 people including lawyers and police officers, even a police captain black and white it did not matter to him. He conned businessmen and engineers. He was good, but not good enough. He got someone else for $85,000 which was the worst of all of us. He did not incorporate for obvious reasons he was a crook. We had him arrested and sued him and his female friend who provided us with a letter claiming to be the VP. We all won judgements against him civilly. None of us got our money in the class action suit. He is serving ten years hard labor and has to pay restitution. The folks that got attorneys had to pay court fees and other fees as part of the agreement with any attorney. He had about 30 counts against him with a maximum of ten years of hard labor per count, but the DA plee bargained with him for ten years minimum for his guilty plee. We were not happy, but he is off the street. It is believed his mother in Philadelphia has the money tucked away. |

Oh yeah, forgot main thing. We told the DA he should also be held on federal charges for income tax evasion. He at first said you are kidding. I said how do you think they got Capone. The FBI was not interested in going after this guy for Income Tax evasion. No wonder Illegal Drugs and Guns are still on the street. It amazes me how people can own a mansion filled with furniture and electronics, have automobiles, pickup trucks, motorcycles, etc... and show no means of income.

This UADurr character is shameful the way he dishonestly screwed over his customers. I can't believe the Catholic Church would allow him to continue on as a minister, but maybe they have low standards!
