This woman killed my brother because she made a decision to get behind the wheel drunk. How could u not stop and help a person u just hit. What if she would of stop just saying! What if my brother was still alive? How can u just go home after doing such a ruthlesss thing? She ruined his wife, kids, parents and siblings lives. And she only got charged with failure to stop and render aid???? She killed my brother! And went home to sleep afterwords while his body laid lifeless on the rd. WHERE IS THE JUSTICE. Plus she already has a driving with intoxicated and marijuana charge from march. WOW..

My deepest, and dearest Condolences to you and your family. There is far too much of this happening now in San Marcos. The city leaders are just as responsible for the tragedy as they continue to allow the growth of bars to open all over town, along with the sales of alcoholic beverages which are easily and readily available. It's damned shameful that nothing is being done to control this growing problem, and even sadder still, that the problem of traffic fatalities in San Marcos are climbing due to drunk driving. and city council, nor the police officials doesn't seem to place attention to it. It just seems to go ignored. Sadly this will not end, as it is a growing problem that will continue as long as the issue continues to go ignored.

Cheri, I am so sorry for you and your family's loss. I worked with Rick for a short time at the Sign Company, and my brother Mike works there now. Rick was a good man and a hard worker, and it was obvious to everyone he loved his family. He will be missed. I know his good friend Carlos has a hole in his heart right now. Just remember, he is still here, in a different form. God bless his soul.

Regarding the criminal who killed him, she should be charged with vehicular Homicide. The injustice here is obvious. You and your family need to bring attention to this, call tv stations, news papers, websites, and get people to call the San Marcos police to let them know they are wrong. Just because she is a white, wealthy, young female collage student does not mean she should be able to run someone over, and go on with her future, while the children of that victim now have no father. I am the first one who will call, anyone else who reads this sad story, needs to do the same. Cheri, if you need anything, contact us through US signs.

I have checked into similiar incidents involving DWI homicides.
Jennifer Mckernan should have also been charged with "Driving while under the influence of alcohol, fleeing the scene of a crime, hit and run, and vehicular homicide". Failure to stop and render aid is just one charge of the charges most people get. FIRST CLUE SHE WAS DRUNK, SHE DID NOT KNOW SHE JUST RAN OVER A HUMAN BEING.

If she gets a slap on the hand, what kind of message does this send? Am I allowed to drink, drive, run someone over, leave that person there to die, go home and claim I didnt know? Does this apply to everyone? or certain people. Or, only in San Marcos?

What a coincidience that on that same night in San Marcos, Another drunk ran over several people and injured them, and the charges were relatively the same. So, It doesnt matter if you injury someone, or kill someone while drinking and driving if your in San Marcos, the charges are the same? Something is fishy here.

I would consider getting a lawyer and sueing in a civil court, because if the legal court fails Rick, than maybe there will be justice in a civil case. Even if she does not have any money, it could bring attention to this, and save some other innocent person from the same fate. Just saying. God bless the Rodriquez Family!

my brother was not drunk! From what I was told he was walking because he got into an altercation with his wife when they were out with sum friends. So like most of us when we get upset, u walk-it off. I'm his younger brother and I still have a lot of unanswered questions about that night . He may have been drinking but I believe it wasn't enough to stumbling down the side of the road! As for walking somewhere he shudnt have been, that intersection if fairly new and the city should've added sidewalks and crossing plus more lighting!
