this was posted on the brantley county blue and gold message board . u can also read the satilla forum and get brantley news the county has a website now but can't find addy right now.
This is the "actual" ordinance that was revised at the last meeting and was voted on and approved unamiously by all 4 commisssioners present at that meeting help week before last.(Yes we have 5, Ronald was on a mission trip in Hondorous)
ORDINANCE 2009 -___
BRANTLEY COUNTY, GEORGIA
REGULATION OF OFF-ROAD VEHICLES (ATV)
AN ORDINANCE TO ESTABLISH THE REGULATION OF ALL-TERRAIN VEHICLES WITHIN THE UNINCORPORATED AREAS OF BRANTLEY COUNTY, GEORGIA AND FOR OTHER PURPOSES:
BE IT ORDAINED by the Board of Commissioners of Brantley County, and it is here ordained by authority of same, as follows:
SECTION ___-2. SHORT TITLE.
This Ordinance shall be known as the "BRANTLEY COUNTY OFF-ROAD VEHICLE ORDINANCE."
SECTION ___-3. DEFINITION.
“Driver’s license” means any license to operate a motor vehicle issued under the laws of the State of Georgia or any other state.
“Entity” shall mean a person, a limited liability company, a partnership, a corporation, company or any other recognized legal person under the State of Georgia.
“Off-Road Vehicle” or “ATV” means any motorized vehicle designed for or capable of cross country travel or immediately over land, swampland or other natural terrain and not intended for predominately on public roads. It includes, but is not limited to four wheel drive vehicles, a vehicle equipped with three or more low pressure tires and with a seat to be straddled by the operator and with handlebars for steering control or other steering or seating configuration.
“Operator” means any person who drives or is in actual physical control of an ATV.
“Owner” means a person, other than a lienholder or security interest holder, having the property in or title to an ATV.
“Private Property” means the real property owned by individual or entity in which ad valorem taxes are assessed and paid.
“Private road or driveway” means every way or place in private ownership and used for vehicular traffic by the owner and those having express or implied permission from the owner, but not by other persons.
“Public Street” or “Road” means the entire width of the right of way of a road (including the shoulder of the Street or Roads) publicly maintained and when any part thereof is open to the use of the public for purposes of vehicular travel.

“Restriction on Property” means no ATV shall be operated on church, school or public recreational areas at any time.
“River” or “River Bed” means any portion of a river or bank of the river owned by the State of Georgia, or owned by a private entity.
“Sidewalk” means that portion of a street between the curb lines, or the lateral lines of a railway, and the adjacent property lines, intended for use by pedestrians.
SECTION ___-4. LICENSE REQUIRED.
(a) Those persons who are 16 years of age and older may drive an ATV on the Public Streets or Roads and those areas accessible by the public of Brantley County, subject to provision of subsection 4(c) as to distance and speed, including the shoulder of the Road or Street, unless such person has had his or her license to operate a motor vehicle suspended or revoked by the State.
(b) Those persons who are 15 years of age, but not yet 17 years of age may drive an ATV on the streets and those areas accessible by the public for vehicular traffic of the County, subject to the provisions of subsection 4(c) as to distance and speed, provided he or she has in his or her possession a Class D Provisional License issued by the State pursuant to O.C.G.A.§ 40-5-24, as may be amended, and has not had his or her Class D Provisional License suspended or revoked, and if he or she shall is accompanied in the ATV by a person at least 21 years of age who holds a valid motor vehicle driver's license.
(c) This Section shall not apply to anyone holding a valid Class C License.
(d) In addition to a license, an ATV Operator will agree in writing on their application to only operate an ATV on roads at low speed and such operation shall be a limited trip with no more than one (1) mile duration. The distance provision of this subsection shall not apply to an operator of a Commercial ATV, which has a commercial sticker and is registered with Brantley County.
SECTION ___-5. REGISTRATION.
(a) Before any ATV may be used or operated within the unincorporated areas of Brantley County, it shall be registered with the Brantley County Tax Commissioner’s Office and receive a decal from Brantley County signifying its registration.
(b) There shall be a fee of $_________ for registration for ATV’s used for commercial purpose and a fee of $________ for ATV’s used for pleasure and such decal shall be attached and displayed on all registered ATV’s so as to be plainly visible. The decals for a commercial ATV and recreational ATV shall have different colors. The registration shall be valid for a period of three (3) years provided there are no changes in the insurance coverage and no violation of the Ordinance has occurred warranting the revocation of this Registration by the Magistrate Court of Brantley County.
(c) Registration shall be accomplished by means of an ATV registration application in a form prescribed by the Board of Commissioners and shall be accompanied, when filed, with evidence of public liability insurance coverage in the following specified limits for such occurrence:
TABLE INSET:
Bodily injury liability $50,000.00
Property damage liability $50,000.00
Automobile bodily injury $100,000.00 each person
Liability $100,000.00
Automobile property damage $50,000.00
