Just a little of what our citizen of the year has done. The citizens of Murray want our award back. We want to give it to Mr. Griffin.

Defendant Charles A. Jones (“C. Jones”) asked Plaintiff David Griffin (“Griffin”) to invest in certain businesses in Murray, Kentucky in 2008. After Griffin invested in two businesses in 2008, C. Jones created a web of companies that he controlled and by which he implemented a scheme of undisclosed, self-dealing to funnel significant money for his family’s personal gain that Griffin had invested in the companies for legitimate purposes. Through this scheme, C. Jones created a lavish lifestyle — complete with, among other things, a $7.5 million house, a lake house, a 30-foot boat, trips on private jets, and numerous civic and charitable donations to promote his family’s stature in the community — that cannot be maintained without his continuing, unfettered control over the businesses and their steady flow of additional money. The Joneses’ continuing control over the businesses will result in further harm to the value and assets of the businesses to the detriment of Griffin and ultimately to the point the businesses no longer remain viable.

During 2010, Management caused South Eastern Book to pay over $4.3 million in “management fees” to Management, which far exceeded SEB’s net income and EBIT. Management also caused SEB to make over $143,000 in “charitable contributions” in the Joneses’ name. Management, C. Jones and S. Jones did not inform Griffin of those payments or donations by SEB.

When the Companies faced an operational cash flow shortfall, Management and/or C. Jones called or emailed Griffin and his employees to request additional investments to cover those expenses.(Griffin Aff. at ¶ 15; Morgan Aff. at ¶ 7). Those requests were made with assurances that revenues were increasing and the future value of the Companies were expected to be substantially more valuable.(Griffin Aff. at ¶ 15). Management and C. Jones concealed, however, the significant sums being transferred to Management and used for the Joneses’ personal gain.(Griffin Aff. at ¶¶ 16, 17). When Griffin would send money to cover operational expense shortfalls, such money initially went directly to SEB.(Morgan Aff. at ¶ 8). C. Jones, S. Jones and/or Management then moved the funds around various companies at their discretion without accounting to Griffin.(6)

I read the court docs where Griffin has already picked a person from Nashville that is a turn around specialist. Ya'll posted part of the many pages updated in the courts and file on March 6th. There is definitely a former CFO or accountant that has given Griffin much of the information. Most likely someone fired not long ago. He specifically states that Chuck asked for a $50,000 check to be given to one of the schools. the person questioned Chuck about taking it from CBR, because the check would not be any good...and followed that up with, shouldn't that come from your own account? Chuck said no, from CBR. Anyone can read these new docs. They tell a story from start to finish and how Griffin hopes to have an independent party take over and save the company that would report directly to the court. The Docs even mention selling the companies. The bottom line they all lost money. Had "management" not been draining the accounts of millions, most could turn a profit. The scheme is similar to a ponzi scheme, in that Chuck has gone back to investors for more money the past 10-15 years and the dollars kept getting bigger. When Stuart Bain wanted out and Chcuk knew it was coming, he had found a whale, not a fish. He convinced Griffin that the companies had this incredible value and growth potential and he bought out Bain for two million. If Chuck would have had two million dollars in the summer of 2008, why would he have not bought Bain out himself? It's simple, he had no money and he had found a huge Backer that he could drain. Griffin has incredible assets and simply wants to try and figure out a way to not lose 30 million in cash and repay 15 million in credit lines with whatever is salvageable from the companies. I'm not spell checking or re -reading this, so someone from Chcuks camp...go ahead and tell me how poorly worded and full of mistakes this Document is.

I personally do not care for Chuck but on the other hand it's kind of cool money was getting funneled from Nashville to Murray. It sound like this fellow did a poor job researching his investments and is getting what he deserves.

The fact that Chuck didn't buy Bain out in 2008 speaks volumes. Excellent point!
