if there is a reason for him to suspect it then yeah he does. He drug tested me and my ex wife there at the court house about 15 minutes before we went in but we are in a custody battle and for child support. I passed mine she failed hers and I got my daughter. Good luck to you in your situation.

Does he drug test everyone or just specific instances where custody or the charges are relevant (trafficking, DUI, possession)? Surely they don't drug test everyone whose case is presented before the court? Seems time consuming and costly.. It doesnt seem to make sense to drug tests everyone lol

Haha.. No, I dont have a court date or anything, it just seemed like a waste of tax payer dollars to pop off a drug test for where it isnt distinctly relevant.

Sure you don't. Just happened to pop into your mind while watching celebrity rehab to ask about only one of the four judges in Montgomery Co. Happens all the time....

My son was in court for a traffic violation and Judge didn't like his eyes so he ordered him to have a drug test which he had to pay for himself. He wasn't on drugs he just has unusually light eye color. I'm certain it was unconstitutional but what can you do?

A judge has the discretion to administer a drug test to any person in his court. This includes defendants, lawyers and all other court officials. If he reasonably suspects that you are under the influence of any intoxicating substance, he will test you. Thank god, we need more like him!
