GREENWALT FAMILY STATEMENT

Phoenix, AZ (Sept. 14, 2010)– The following statement is provided by Thomas Greenwalt on behalf of the victim, Joe Greenwalt and the Greenwalt family:

“I find that Judge Fields ruling in this case today is pejorative, shameful and a true miscarriage of justice and the law, not only for Joe Greenwalt’s case but for homicide victims and victims of violent crime across the United States. As I have stated previously Judge Richard Fields prejudged this case well before seeing any evidence or hearing from a single witness, thus creating a prejudice for himself, against the case that could not be undone. Judge Fields in his ruling and his actions sought to redefine due process, as guaranteed in the Constitution of the United States, where no redefinition was warranted or necessary.

Judge Fields ignored multiple confessions, by David Wayne Droegemeiere to separate parties, that he committed the murder of Joseph Patrick Greenwalt as charged in the indictment down to describing the murder weapon which is 100 % consistent with the facts and evidence. There were two rock solid disassociated confessions, two people who would never meet in a lifetime telling the exact same story that David Droegemeier told them about murdering Joe Greenwalt. The judge absolutely ignored substantial amounts of evidence gathered and lawfully presented by the state in this case to instead, lament and to speculate to the loss of items that never have been proved to exist in the first place.

In 2009 David Droegemeier was given multiple opportunities by investigators to deny making these confessions. David Droegemeier not only refused to deny making the separate confessions, he confirmed to the investigators that he had made the confessions.
In conclusion the entire legal community and the public should take notice of this case and the presumptive ramifications it holds for homicide victims, their survivors and victims of violent crime in this country.

The bottom line is that due process is a constitutional right of both the victim in this case, as well as the defendant. There is no statute of limitations on homicide. There- fore unless someone’s constitutional rights have been impeded by the state in this case, which they have not, then this case was a viable lawful prosecution that deserved no less than to have the facts heard by a jury. I am thankful that Judge Richard Fields is no more than a single spoke in the wheel of the American criminal justice system, and despite his ruling I continue to believe in the fact that justice will prevail in this case, it is anything but over.”

It is over, he did not do it. What evidence could you have when all of it was destroyed years ago. You must not have a consience if you can try to frame an innocent man for this.

It will never be over for the ones he left behind, broken, bruised, heart sick with sadness,
always wondering why? For God sakes WHY??
So you don't think we have a concsious? We are not trying to frame anyone. It's been
too long. We need answers. David has the answers. Just tell us David what happened that
fateful day. We deserve to know. Even if you never serve a day in prison, we need to know.
Write down everything that happened that day. every detail. Then put it away in a bank security box, only to be opened on your death. His death changed me forever.

my father did not commit this crime. Im sorry for your families loss but you at this point are just trying to find someone to blame. You are not seeking justice by convicting an innocent man. I'm sorry the murderer was never found but that does not mean you can convict an innocent man.

Respectfully, I have an entirely different opinion on your father’s culpability regarding the murder of my brother Joe Greenwalt on May 5th, 1976. You believe that David Droegemeier did not murder Joe, I believe that he did. Instead of arguing this point with you in this forum I would rather politely suggest that you educate yourself on the facts of the case before directing future posts to me personally. I have personally served as a witness and as a court recognized investigator in Pima County Superior Court in regarding the State of Arizona’s prior cases against your father for this crime. David Droegemeier, your father is subject to prosecution for this crime for the duration of his natural life. The State of Arizona is still charged with solving this homicide and there is no statute of limitation for criminal homicide. I am presently researching the practicality of preferring civil charges of wrongful death against your father for Joe’s death. This isn’t all happening for no reason, instead in my personal opinion it’s happening because your father murdered my brother.

David will also have many great days of freedom, never to enter into a prison cell for the rest of his life, because all his sins have been washed away by the blood of our Lord Jesus Christ. David has not, and will not ever enjoy peace eternal or otherwise while on this earth even for one second. God is powerless to diminish or mitigate the righteous adjudication that awaits David for his heinous act of cold blooded murder. The State of Arizona is well invested in the legitimate prosecution of this murderous coward and will be so invested until he is in prison or dead. If david wayne droegemeier is truly a changed man, may the Holy Spirit compel him to want to put this legally behind himself. Have this adjudicated, if he's guilty, pay his debt. And start his prison ministry.

Been reading the court documents...the accused confessed. Not only to authorities, but to loved ones because his counscious was eating him up at the time, obviously.
