I am writing to you as my wife and I have grave concerns about the service and care given to our pet, Ernie (a 12 year old cocker spaniel) at Deer Run Animal Wellness Center in Midlothian, Virginia.
On Sept 3, 2013, Ernie had surgery at Deer Run Animal Hospital to remove a massive abdominal tumor.  Prior to taking him to Deer Run, we had taken him to Crater Road Animal Hospital in Petersburg and Centralia Animal Hospital in Chester. The vet at Crater Road, Dr. Deborah Kinney-Nay, strongly advised against surgery because Ernie had a serious heart mummer (grade 4).  However, her stepson at Deer Run, Dr. Marc Nay, agreed to do the surgery.
The week before the surgery we had in initial consultation with Dr. Martin at Deer Run. After performing an EKG (costing around $450) on Ernie his inclination was that he was a good candidate for the surgery in spite of the heart mummer. He estimated the surgery would cost about $1000. When we arrived on Sept 3 we were given another estimate ranging from $1456 to $1836.  The final bill after the surgery turned out to be much more than the initial estimate. It was $2379, well over the estimate.
On Sept 5, the doctor from Deer Run called and informed us that Ernie was ready to go home. My wife and myself were extremely happy to hear this and then went to Deer Run to take Ernie home. When they brought Ernie out, he was walking fine but then immediately started to collapse on the floor.  Dr.Martin said he was just weak and also the floor was slippery. After collapsing like this, we were fully expecting them to keep Ernie for further observations, but instead Dr. Martin carried him out to our car. After about 10-15 minutes of driving, he stopped breathing and died! They should have kept him in their hospital when he started collapsing in their office.
We really believe Dr. Nay should have concurred with his stepmother and refused to do the surgery due to his serious heart condition and age. For such a very expensive medical procedure, we were not expecting to have Ernie die 10 minutes after getting him back from Deer Run.

We recently posted a negative review regarding the services provided by Dr. Marc Nay at Deer Run Animal Wellness Center, Inc. for the care of Ernie, our 12 year old pet dog who died post-surgery. We were upset at the time of the posting and should not have published the statements. They were not intended to draw into question the integrity or professionalism of Dr. Nay, Deer Run Animal Wellness Center, or any of the doctors or employees on its staff. While this retraction is not to be constructed as an admission to the making of defamatory statements or insinuations, the negative statements were not warranted.

They did not catch a heart murmur in my beagle & she's dying. I wouldn't be so quick to retract your statement.

I read the other persons' comment and they were prewarned by another vet against performing the operation due to the "heart murmur". So what did they do? They did what a small percentage of pet owners do: They found a Vet who would perform the risky procedure. No doubt the tumor would have been fatal in and of itself...but pet owners (myself included) want to hold onto our dear pets as long as we can and make their existence as comfortable as possible.
This, however, was a poor judgement call by the pwner when they went (what I would call) Vet shopping. If you get sound advice from a trusted and accomplished Vet, take it...even if it isn't what you want to hear. If you have a diagnosis or treatment plan, you can always shop around for a Vet within budget constraints.

The retraction may be a case of too little too late.

The poster could be sued by the business in question for defamation as the comment was posted on an open, public forum, in writing....even though posted semi-anonymously.

The plaintiff would file the defamation suit against John Doe, and request the judge subpoena the poster's IP address from Topix, at which time the poster's identity would be revealed.

While sites such as Topix, Angie's List, Yelp, etc are exempt from retribution, the poster making the statement is not.

There is an interesting, recent, precedent concerning this in Virginia law here :

http://ideas.time.com/2013/01/07/yelp-reviewe...

While the court eventually sided with the defendant in that case, after countless thousands in legal fees, the matter is still not completely resolved.

The best course of action when asked by a site for your review on-line, is to keep your opinion, and your review, to yourself......they are protected, you are not.

Friendly advice to the poster that made the original post.....go to your original post and click on the report button......explain to the moderator that you are the poster of that post, and ask that it be removed......they may or may not cooperate, but it is worth a try.
