I'm wondering, why didn't the police confiscate the man's clothing in an attempt to find DNA evidence where this supposedly actually happened to him?

Look back at the original story. The woman says that she DID NOT spit on this guy. Witnesses at the scene corroborated her story. She DID NOT SPIT on him.

What "no witnesses". Do you not understand English? There were witnesses and they confirmed the lady's story.

And, even if she had spit on him, that did not give him the right to beat her down like he did. The man is a bully and a criminal. He assaulted this woman after nearly injuring her child. He assaulted her because she was black and she was not subservient. He assaulted her because he is a coward and she was a woman. The fact is, regardless of her actions, he assaulted her and beat her severely. In front of her child no less. We are supposed to live in a civilized society and behave accordingly. This was not civilized behavior and there is no justification in the world for what this man did. None whatsoever.

The restaurant gave police a surveillance video. The company said its policy is to give surveillance video to police and other law enforcement agencies only.
Tashawnea Hill said West punched and kicked her so hard a week ago that her head still hurts.
"I have knots on my head," Hill, 35, told CNN Wednesday.
Troy Dale West Jr., was arrested for kicking Hill and yelling racial slurs at her in front of a Morrow Cracker Barrel. West is out of jail, having posted a $12,150 bond.
Police charged him with beating Hill, an army reservist, in front of her 7-year-old daughter.
Police said witnesses, as well as a surveillance video, have confirmed her account, which the FBI is investigating as a possible hate crime.
West is white. The woman is black.
A police report said West admitted striking Hill "after she spit on me and accused me of trying to hit her daughter with a door." Hill's attorney Kip Jones told CNN that did not happen.
Jones also told CNN he was "convinced this was a hateful, racist attack ... based on the N-word, the B-word, etc."
"The language was vile. It was racist. It was sexist. It was completely offensive, completely unprovoked," Jones told CNN.
Witnesses told police that Hill kept telling West that she was in the Army.
“She kept saying,‘Sir, I’m a United States soldier, don’t do this,’” Morrow Police Capt. James Callaway said.
Hill said Wednesday that she is still in shock.
"I haven't been able to sleep since then," Hill told the Associated Press. "My major concern is that my daughter is OK. Mommy will heal up. Mommy will get better, but she's the future."
West told Morrow police he became upset because Hill spit on him after accusing him of trying to hit her daughter, according to the police report. But several witnesses said they never saw Hill spit on West.
West was charged with cruelty to children, a felony, because he beat the woman in front of her daughter, Callaway said.
He is scheduled to appear in court at 3 p.m. Sept. 28 for a preliminary hearing.
Morrow Police referred the case to the FBI Civil Rights Division, saying it may be a violation of the Federal Hate Crime Law, defined as a "criminal offense against a person or property motivated in whole or in part by an offender's bias against a race, religion, disability, ethnic origin or sexual orientation."
The FBI investigates hate crimes when it receives a complaint from what the agency deems a reliable source: the victim, a witness or another party.
West could not be reached for comment. His mother told the Associated Press that her son would never hurt a mother, especially in front of a child.
"This just doesn't sound right," Johnny West said.

I'm not disagreeing with you or the article, when I said "no witnesses" I was talking about the reports that said "no witnesses saw her spit on him"....but again, If you were around to "witness" this appalling act, wouldn't you do something to stop it? It's very questionable to me that someone "witnessed" this altercation from beginning to end without intervening. If they have the guy's shirt, there's a good chance a DNA test would show spit if that's what happened and then we'll all know what really went down. Personally, they could lock this guy away forever for all I care but I still think something other than what's being told happened to set him off.
I disagree and I point to the recent rape of the teenaged girl in California while numerous people stood around, watched, and did nothing. This happens all too often. It can be disbelief or it can be not wanting to get involved, but people will stand and watch something like this and do nothing. A sad but very true statement about people.

Maybe this woman has the same eyes as this man's wife and she hit him one too many times the night before.

You know...I haven't seen a single report corroborating your statement about West's shirt and her DNA

Maybe the DNA got there when he hit her. It could easily have been her blood. Or, if it was saliva, maybe it flew out of her mouth when West hit her. DNA on the shirt does not prove that she spit on him deliberately.

Again, the witnesses at the scene all stated that the woman DID NOT SPIT on West.

And, again, even if she did spit on him, it did not give him license to brutally assault her, which he did. We are supposed to be civilized people and civilized people do not physically assault one another. Especially in front of a child. A child that West almost injured as he charged out of the door of the Cracker Barrel.

Several years ago I saw a black guy beat up another black guy outside that same Cracker Barrel in Morrow and he didn't even get arrested.

Its perfectly legal to hit someone who spits on you. Spitting is assault. Go spit on a cop and see what they do to you.

West was arrested for the assault. The woman was not. The woman was an innocent victim. West lied about her spitting on him in order to justify his actions. He knew that he had stepped way over the line and was grasping at straws to mitigate his guilt.

The fact remains that West savagely beat this woman in public and in front of her child. How can you justify and tacitly condone such an action?????

And yet if both people had been BLACK, you wouldn't even be talking about it!

Why not go and visit a shelter for battered and abused women, and see if the husband or boyfriend is still in jail.

Another case of "Negro Emotionalism"!

Blacks kill each other on a daily basis, and yet nothing is said.

Georgia born, Georgia bred, and I bleed Georgia red. My mother and both sets of grandparents came off the farm from Middle GA (Laurens and Jasper Counties).
