As bad as I hate what berkline did to the employees. There is no use in suing them.first tn is a right to work state. They can fire you at any time for no reason at all. Second they are filing for bankruptcy! Even if you did win any money. They would just add it to the bankruptcy and would not have to pay you a dime. I have been threw what you all are going threw myself. As hard as it is. Just let it go! Its over!

They still have to obey the law and it states you have to give your employees so much notice before you close a business down.

Get over it? There is still money owed to people that they might not see. The people that were there long enough to get vacation pay might not get any of it. Berkline did their workers wrong. I don't think you know the half of it.

Sorry but no they don't. Like I said before. I have already went threw this very same thing. I had 430 hours of vacation and sick time saved up. I couldn't even get that. Go to TN.GOV and click on labor laws.

I am sorry to say I do know. I got the shaft from a company the same way. They owed me 430 hrs. I didn't get one penny. And I could not get a lawyer to take my case.

Your right TN is a "right to work" state, but the employer has to follow the laws..All them employess have rights, and the 60 day law was broken by JERKLINE,,,,,i would sue the hell out of them

Bullshit. Who works that many hours without pay and says nothing? There are already lawyers involved in the Berkline case, big time lawyers who started the lawsuit. That would be because federal law was violated by Sun Capitol the owner of Berkline.

If a lawyer or law firm wouldn't take your case, that means you didn't have a case. They only take case's where their a chance of winning, because they are working for free untill they WIN or it settles.

Ok let's hear who these big time lawyers are? There is no damn 60 day notice law. Your boss can walk in and fire everyone there on the spot. I know what its like. Like I said I went threw it. But I am not going to fuss with anyone about it. All I ask is when/if you go to court. Please come back and tell me.

NO UNION...NO protection!! The employees should have voted in Union Representation there and all the other "now closed" factories in the area, at least it would have made Berkline follow a few rules! IF and WHEN industrial jobs pick up again, it would be smart to have a union!!

The Worker Adjustment and Retaining Notification (WARN) Act, Public Law 100-379, is a
federal law that was enacted on August 4, 1988, and became effective February 4, 1989. WARN
requires employers of 100 or more employees to give a 60-day advance notice of a plant closure
or mass layoff.
Under WARN, employers are required to send a written notice to the Dislocated Worker Unit
(DWU) of the Tennessee Department of Labor and Workforce Development. The DWU can
assist employers and employees by implementing the state’s Rapid Response System, designed to
provide information quickly that will alleviate some of the anxieties and problems caused by a
workforce reduction. The Rapid Response Team is comprised of the following departments or
offices in state government: Labor and Workforce Development; Economic and Community
Development; and other departments of state government and private contractors when
appropriate. In addition the Tennessee Career Center System provides an entire spectrum of
dislocated worker services. Career Center personnel can design programs for employees that will
enable them to take advantage of the many resources available to facilitate their reemployment.
Tennessee’s “Plant Closing and Reduction in Operations” Act, T.C.A.§ 50-1-601 et seq., applies
to employers employing at least 50 but not more than 99 employees. That law requires covered
employers to notify the DWU at the time the employer notifies its employees of the reduction in
operations. The law only affects reduction in operations affecting 50 or more employees.
Although layoffs or closures affecting fewer than 50 employees are not covered by either the
federal WARN Act or Tennessee state law, employers are strongly encouraged to file a notice so
their employees can receive all possible services and benefits from the state.
Early warning and a well-organized transition program with both employer and employees
working as a team can minimize the traumatic effects of worker dislocation.
Enclosed is information explaining WARN and the procedures of the Rapid Response Team. We
would like to assist you in making this adjustment as smooth as possible.

Berkline told us about WARN the day they called us together to tell us we were closing and our insurance was terminated that day. We never got the warn paper. if you went "threw" this, why didn't Terry Terry and Stapleton meet you at the TN Career Center like they did with us? Which factory did you go "threw" this?When you don't have a clue about something, keep your mouth shut because we were not fired like you, we were laid off for lack of work. FYI, we already signed the lawsuit papers and you can read about it in the papers when we win.
