how do you get rid of people tjat dont pay rent

I am renting a house and its to a family member on my husbands side. Their last payment was in july. How do I get them out without chaos?

Most landlords try an eviction notice. Thirty days and they're gone or the police will remove them.
But there will be chaos. There is always chaos when someone is evicted. They will probably trash the place out of spite, then you will take them to court, the judge will rule in your favor, there will be a judgement issued against them, but you will never collect: if they couldn't pay rent, they can't pay for the damages. So either way, you lose. You can get them out, but you will pay for it too. But of course, after you get them out and clean up their damage, you can start renting the place to someone who will pay again.

I used to rent a house and I had a tenant who got 3 months behind. I felt bad for her as she had fell on hard times so I worked with her as best I could. But I think she used that against me. I went online, printed out an eviction notice and sent it to her certified mail (this is important). This proved to me she received the notice. She was given 30 days. On the 29th day she called me and asked for more time. I told her I had been patient and she was coming up on the 4th month of no rent. I asked her if she could pay anything at all. She stated she could not. I told her I was sorry but had no choice but to proceed. I ended up getting her out but not before she destroyed the house. I'm talking holes in the walls, red stains (I'm assuming Kool Aid) on just about every inch of carpet, 3 windows busted out, commodes stopped up, the yard had trash thrown ALL over it and dirty diapers AND dirty feminine products all over the house. It was beyond nasty. I took tons of pictures and started the cleaning process. I noticed a stench and just figured it was from all the filth. I was wrong. For weeks I smelled it. I brought someone in to repair the holes in the walls and that is when we discovered 2 dead possums in he walls!!! This woman had picked up roadkill and put it inside the damn walls! I got her into civil court, I won the case. I have yet to see one dime. This was 3 years ago. They have tried locating her but have had no luck. I will likely never see that money again and as long as she is gone, I could care less at this point. Chaos can not be avoided in your case but you can't be taken advantage of either. Wow you got a crappy deal. This person said theu were moving in sept. First it was end of summer then sept. And they are still there. I don't make money on this house we are still paying on it and need somebody in there so we aren't paying 2 house payments. If nothing is done by the first of nov. I am doing the certified letter thing. Too bad I can't avoid chaos. But I will stand up for my rights. Thanks for the advice

As a former landlord of three properties, I would suggest to require proof of income (verifiable) and run a background check on prospective tenants in the future. Also, require three months of bank statements. You can also set a tenant up on monthly bank drafts, which is an excellent idea.
All of the horror stories mentioned above have happened to me, except for the road kill situation. I've had to take two renters to court, fell behind on my mortgage payments because of it and have still yet to collect a damn dime from the low lifes that I rented to. Thus, the reason that I am a FORMER landlord.
My lawyer suggested the proof of income, background checks and bank drafts for any future tenants. But due to the property damage and financial difficulty I succumbed to because I wanted to rent properties, I couldn't be a landlord anymore. I am in my thirties and my credit is ruined. My properties were ruined- all because of worthless renters who refused to pay.
I should have gone thru a rental agency or a real estate agent and let them fight my battles for me. If you don't want to handle all that and the stress that comes with it, an agency is your best bet.
Good luck to you. You have a long process ahead. You can get them evicted, but don't hold your breath for repayment. It's just not going to happen.

The bank draft thing is an excellant idea. These people have made us get behind on everything and they are supposely buildong a house that's been almost done for months now. They owe us a lot of money and I don't like us being behind just because they want to live rent free. Thanks for the message

Worst case it will take you about 40 days.
Ok, first, for non payment of rent you HAVE TO send them a letter telling them the rent islate and they need to pay it.
THEN, you send them a letter telling them they have thirty days...and like a previous poster alluded to you DO have to prove they read it so you need to send it via resistered mail, that way they have to sign for the letter.

Here's an interesting fact: No matter what day you send the letter, by Law the thirty days doesn't start until the day that the next months rent is due.
In other words, if you send the letter on the fifth of December and the rent is always due on the 1st of the month, they have until the frst of February on their '30 days'.
I have went through this and cannot believe the Laws give the deadbeats such lattitude but it is true. So, while everyone always says 30 days, it could actually take up to 60 day depending on when you send the letter. The thing is though once that thirty days does start ticking off you can rest assure that at the end of it the Sherrif will come and escort them out for you (of course you have to pay a small fee).

Just Google Eviction Law Tennessee and you'll get all the info. Look at two or three sites too, as every site does not necessarily tell you everything.

I feel your pain and I wish you good luck on resoving your problem asap.

Ohhhh and say you have officially strted that 30 day clock ticking on them? If you accept any money from that point on, it cancels the eviction and you have to start the whole eviction process over again. That's how the Law is written.
I know it sounds crazy but our Legislature continues to coddle the deadbeats and losers of our society and take their side over the ones of us who are responsible and pull our own weight.

Something I learned, as a naive Landlord is never let the renters get more than one month behind without taking action. They are just not going to pay you two, three or even four months rent when they get that far behind when they can just pack their stuff and move in somwhere else for the price of the first months rent there.

They know what they are doing, they know they do not have to move out until you do the Eviction on them and if you do anything 'mean' to them or cause them any sort of serious trouble the Court WILL penalize you and even reward them, sometimes out of your pocketbook.

I have no wish to be a Landlord ever again, I got tired of feeling emotionally and phisically ill just because I was so often made to feel like I was oppressing those I rened to by asking for the rent and having to listen to lies and get the run around week after week after week. I'm done.

I know what you are going through. It's sooooo frustrating, when all you want is what you are rightfully owed and they act like it means nothing at all while they continue to lounge around in YOUR property.
I realize that renters deserve some protection against Landlords who would collect rent and then just kick someone out for no reason so they could immediately do the same to someone else then someone else but it amazes me how when someone fails to pay the rent they owe for one, then two, then three months or more the Law rewards them with a whole extra month to freeload off he Landlord. It's nut!!
Going to collect the rent should be a happy day for the Landlord but nooooo it's a day that these non paying deadbeats make us dread. Isn't that as crazy as it gets? On a day when someone is supposed to be putting money in our hand we have to dread that day arriving because we know more than likely we are going to stand there while they lie right to our face again and we don't collect a cent? And those deadbeats have the audacity to try and make it look like you are being hard on them when all you are doing is asking them why in the world they won't just pay you or leave. It's a different story every month about how their employer failed to put some of their time on their check or this or that or something else, blah, blah, blah....lie after lie.
Tell a renter who is way behind sometime that they have no right to be there and just watch as they act all nuts like you just said their mother has sex with animals or something similar.

I cannot be a Landlord any more, it requires having too hard a heart and I'm not that way.

How about fixing the crap that's wrong with it. Like a water leak, stove, electric and so on. Maybe the rent gets paid thru the high electric bills. State law if the owner has been notified then tentants can hold rent until its fixed. This is just my opinion. I have a friend who lives in a relatives house. She had to do all kinds off work to it and get rid of there millon and one roach bugs. Something goes wrong all the time like the bathroom floor falling through, the stoves messed up, its fuse after fuse blowing every other day.

Proper procedure... send written notice registered mail give them 14 days to vacate..after the 14 days go to the clerks office in the justice center pay $167 dollars & a court date will be set for you & the tenant. Make you next tenant sign a lease include language explaining how & when you will evict for breaking the lease. this can give you the right to put their chit at the road because they signed the lease.

they are not good they let a couple in without deposit. than 1 month goes by 2 month goes by i call my attorney to represent me. my attorney tells me he can not rep me because he was rep my tenant .he said he had in a suite against Caterpillar for 100.000 they had collected . but did not pay there rent .i had the police there with me to evict. as the renter passed by he said this was a miss under standing . when he left he had all new furniture. they usually travel light. And if they have kids it is harder.

do not rent to three girls . they moved in with a 2 year lease. on the seventh month . the one girl called up and said the other 2 girls had left she was leaving to go into military. said there was smell coming from the basement and that they could not living there any longer ,she said it was mold. i waited 21 days hoping they would have moved out . when i had a experienced rooter man come out to the total cost $ 5.000 he had found tampons backed up. she calls the health depart on me we now have a court date set for July 22. let see what plays out. they left house 21 days prior . now they said i did not serve them with a notice. even though you do not know where they are.
