So my transmission went out on my van. A friend tells me her ex FIL has been doing them for 35 years and he could do mine quick and a lot cheaper than a shop. I call him. He quotes me 1150,about a 1000 less than the shops I was talking to. So he gets my van. 600 for parts. 3 days later he neesds another 400. I don't hear from him for a week,he won't return my calls. Nothing. I go to his house twice. Last night he calls and says its ready. We give him the rest of the money. We don't even get home the transmission does same thing and goes out. He gave us a reciept also writing he covers his work for 2 years. Also the engine was making a strang rattle sound? Either way we get it back up there,he is already gone and when I call says he will look at it. Aside from just whoopin his ass,what are my legal options here?? All I want is my van back fixed. At this point I'm pretty sure that won't happen.
We have sunk over 2000 in this van in 3 weeks.
Anyone know of a good buy here pay here place??:((

Call Matt Sexton, he's an attorney here in Morristown and one of the very best. I used him in a law suit of a similar situation and not only did we win judgement for the cost of the repairs but they had to pay for my attorney's fees as well. Also, if you can prove fraud in general sessions, "which it sounds pretty fraudulent to me" you can file criminal charges on him directly afterwards and he'll be headed for jail.

Of course, I wouldn't stray away from the idea of beating his ass in addition to suing him. In fact, if it were me I'd have already had his legs broken like the one in my case.

Thank you so much. It makes me feel better to know that legally I have the upper hand. However it doesn't give us a ride now. I will call him Monday. It is very fraudulent. His reciept says warranty on transmission. He told us 2 years but he didn't write that. Also he wrote on the reciept that the engine knocked and was 3qt low on oil before rebuild. But he didn't say anything about a knock until yesterday. He wrote that on there after he got all the money. The van ran fine until the transmission suddenly went out. My husband and a friend went over there to talk to him right now. I'm sick over this whole thing.

Thank you sam. I wouldn't make something like this up. My husband went to talk to him he said he would look at it and make it right today. We will see. If he doesn't ,I will post his name. I thought he said he was working in a shop but doubt it. He has worked at almost every transmission place at sometime or another. I don't know...I guess this is what I get for trusting people.
