It is considered difficult to prosecute because unless authorities catch someone in the act of crossing the border, it is easier to just deport them than spend the time and money needed to prove how they crossed the border. Even in border states, first-time offenders are rarely prosecuted because the court system would be inundated with millions of cases.

Well this is total BS coming from this US Attorney. I work in a US Attorney office in a border state and we prosecute EWIs (entry without inspection) all day long, about 100 a week. While it may be a misdemeanor offense, they are arrested, booked and spend time in jail until they are sentenced.

DONAL CRESITELLO FILES FOR U.S. SENATE RUNBY MAX PIZARRO

TRENTON - Morristown Mayor Donald Cresitello today filed petitions to run for U.S. Senate in the Democratic primary.

"We've collected 1,300 signatures and we hope to collect another 200 by noon," Cresitello said this morning.

This afternoon, Cresitello told PolitickerNJ.com that supporters of his delivered over 1,300 peititons to the state Division of Elections office at about 20 minutes to four.

Cresitello's opposition to illegal immigration -- an odd stance for a Democrat -- has won him attention far beyond Morristown.

U.S. Attorney Chris Christie recently criticized him for "grandstanding," Cresitello has been popping up on New Jersey radio station 101.5, a popular spot for right wing rants, and was also interviewed on television by Lou Dobbs, an anti-illegal immigration fireball.

All this is fine and good for Cresitello up to a point. His immigration views are to the right of most registered Democrats, and will only go so far in a party primary.

No matter the spin, the mayor is still a huge underdog in his primary fight against incumbent Frank Lautenberg and challenger Rob Andrews, a congressman from Camden County.

furthermore, while it may be true that just being here in the united states on an expired visa would not be a felony offense - just a civil one.
in most cases, if someone is here illegally, and they are working, then, the fact that they are working could be a felony offense. if an illegal wrongly uses a social security number to obtain work, that is a felony. it's called immigration fraud. refer to the above document for more info.
the exact violation is - INA,§1546 of the U.S. Criminal Code.

I always try to use supporting documents when in a debate. it makes for a better argument.

Our Capitol contacts have just informed us that Dianne Feinstein
(D-CA) is attempting to attach an amnesty amendment for
illegal farm workers to the Iraq supplemental appropriations
spending bill.

Details are still coming in, but we do know the bill would
provide legal status to 1.35 million illegal aliens working
in agriculture by granting them five-year visas.

Tentatively called the Emergency Agriculture Relief Act of 2008,
this is a slight-of-hand, scaled-down version of Feinstein's
AgJobs amnesty bill that she had previously introduced.

We have been told that her amendment could be voted
on as soon as tomorrow (Friday, May 16)!

this entire issue gets clouded with rightesness and our not appreciating or understanding how one currently can enter our great country legally. my belief is that wide dissemination of the steps required to achieve legal entry with the removal of barriers of "required" payoffs by the applicant (my perception of the real world these people face) would clarify the issue and encourage adherance to the law, and would encourage people who want to assist immigrants trying to enter our great land to render proper guidance and help and in a legal manner. my experience, and the implied evidence is that the immigrants from south of the border are hard working good people. that does not remove the error of their ways if they are here illegally. so how does the system direct these people to "right their wrong"? and yes, some of these people are "bad dudes", just like some second or third generation americans are "bad dudes". i for one would appreciate being directed to a legitimate source to find the answers to my questions of how to come to the great USA legally. perhaps i'm naive, but my belief is a better understanding of the facts could unite most of us and serve as a guide point for us -- and "them"
