For those of you who don't know, gasoline is being sold on the indian reservation and I paid 3.49 per gallon for regular as of yesterday.

Its not being regulated so you dont know what the real octane level is plus its not being done in a safe way.

I thought some government agency stopped the sale of gas on the reservation a while ago. It was deemed dangerous. I don't understand why they think they can do anything they want. Don't they make enough money from selling cigarettes and drugs?

Why do you refer to the gas and cigarettes as being bootleg? We fucked the Indians over time and time again. We purchased Manhattan from them for $25.00, and herded them onto little reservations. To give them a break we told them they wouldn't have to pay taxes and they figured out a way to profit from it. I gave the gas a try for $3.59 a gallon and my car will let me know if it's not any good by the mileage I get and if it hesitates. If you want you can continue to pay .30 per gallon more. I know of a Sunoco station in Melville that is selling regular for $4.09 a gallon if that makes you feel better and would prefer to fill your car up there.

The Indians are entitled to sell untaxed cigarettes on the reservation to other Indians. They are not exempt from all taxes although many think they are. They are subject to Federal Income, Excise, Social Security, Medicare taxes and NY sales taxes. I say bootleg because the word describes selling of a commodity without taxes. In order to sell gas so cheap, it must be trucked in from a lower tax state. It is a violation to enter NY without a manifest and Bill of Lading showing the FET and State excise taxes have been paid.

The people who live on Eleanor Avenue are in danger of a gasoline explosion and maybe even worse traffic day and night. Also, good luck to the people on Riverside.

Obviously they must have gotten approval before they installed the tanks and pumps in an area with surrounding homes. I'm quite sure they wouldn't have done it underhandedly and risk having to remove everything.

I would assume so, they do for cigarettes. As far as the gas is concerned I would think it would have to meet federal standards with the additives regardless of who buys it for resale. I think Costco and BJ's also sells gas at cheaper prices. The thing is you have to be a member and the Indians care less who buys it. I'm sure the gas is fine because the Indians wouldn't put themselves into a position for more lawsuits or trouble. Hey, if the price is right why not? I just feel the only way they can be selling gas so cheap is to either cut back on the octane, and/or be selling it without all the correct taxes being paid. There is no allowance for gasoline to be sold on the reservation without proper taxes. I hope the fire marshal gets out there and inspects the safety of the tanks/pumps. Were the tanks double walled, properly vented, attached to automatic shut off, fire arrested, etc.

Regardless of whether it's a reservation or not I don't think they would be immune to proper installation codes because of the fact it's in a residential area. I would think they would need a certificate of occupancy or something similar proving it meets safety standards. If something were to go wrong it could wipe out entire blocks around the reservation. As far as the contents of the gas, I don't know. If it is federally regulated I would think labels would be placed on the pumps. I would also think the pumps would show a label from the department of weights and measures to show the pumps were calibrated to dispense the proper amount of fuel. If I go there again I'll have to make it a point to look.
