wow goes to show you, 2 people have voted, one says yes, the author of the post and one says no....sometimes bandwagons do not always get jumpers. Ahhh did he bring charges against you or someone you know...or is this an opponent?

Innocent People are at risk everyday because of his office and the revolving door at the courthouse.

I don't know Mr. Gaither, but I can tell you from personal experience that some of the Asst. DA's here in Burke leave much to be desired, at least one of them did back in 2006. After my dh was assaulted by his own brother, and the brother was found guilty of assault, he was given 1 year probation and warned by the judge not to threaten or harrass dh or he would be jailed for 10 days. Before we even left the courthouse that day, the brother threatened dh's life in the lobby of the courthouse, and when we reported the threat to the Asst. DA (heard by the clerk at the window who was taking brother's payment for his fine), the Asst. DA did NOTHING. The brother also came to our house that same evening and made another threat against our lives, and when reported to the Asst. DA, he did NOTHING.
Of course, the same thing could be said about the sheriff's deputy who came to our house an hour after the original assault...he did NOTHING, even though he could see the marks on dh's face where his brother had hit him, and dh's brother was just a couple of hundred feet away, watching as dh made his report to the deputy. The brother had a gun in his truck, which was reported to the 911 operator, and the deputy knew this, yet the deputy did NOTHING, except to tell dh he would have to go the the magistrate's office and file a complaint. What if the brother had gotten his gun and shot both of us after the deputy drove away? This county needs a change about how they handle assault reports, especially when deadly weapons are involved.

your incident is unfortunate, to say the least. The root of the decisions made by these DA's are not founded in the law they swore to protect and defend. It realistically is in the budget that the idiots in the state legislature propose....i ask each of you who have never had to work in the law enforcement and/or the legal system this....What would you do if you were told to reduce the number of inmates at local and state units beause of cost alone. no longer are you permitted to enforce or protect the law that you gave several of your educational years to master. we are not in the buisness of being "personal" with you. Most of us do not like or dislike you in any way. Empathy is not something that most of us can muster because to have that, we first had to have lived the same life that you have lived, tyhat is impossible. We all come from different backgrounds and decisions, thats what makes this world function as it does. Live your life beyond reproach and weed out those that are instrumental in interrupting the path that you feel is positive for you. We each can provide or take away the necessity for having to visit a lawyer in the first place....just a thought/opinion!!

Well E, the fact that my brother, who is an attorney (and former Buncombe Co. Asst. DA) advised me to get a gun permit and pistol for my protection tells me that even he recognizes that the court and law enforcement system is flawed, and today citizens who do live their life beyond reproach have to be proactive when it comes to protecting their own lives, and not depend on elected/appointed officials to come to their defense when their life is threatened. I still wonder what the response would have been from the sheriff's dept. if dh's brother had killed us both that day, after they had the opportunity to arrest him on the scene, but didn't, for whatever reason they had.But I (and my dh) are legally armed now, and we will 'take care of business' if we are met with that scenario again.

and thus you and your "dh", whatever that is, will become just that, a statistic! I would never tell you to not protect yourself, we all should. I will say that you seem a little too frightened by this threat and in my experience, you would probably pull the trigger as a first resort instead of last. If you have never pulled the trigger on another human being, talk to those that have, it is not a good feeling. have you taken out restraining order? have you been to the sheriff's dept more than once or have you just proscribed the proper remedy at this point? I would never begin to understand what you are feeling, i dont know of anyone who wants to hurt my family or myself. I do recognize the law as a flawed system at times but the one thing i do know, is that if this brother now turns up harmed and an incident is created, even at his own volition, it now becomes a matter of legal scrutiny...i.e. premeditation on your and "dh" part. Be careful what you say to anyone at this point, if brother is this aggravated and the situation arises and ultimately one of you pulls the trigger, it can now be viewed as somethign more than "self-defense". We all have 2nd Amendment rights, and should have, but no right to play judge, jury...executioner!!!!!!

by the way...i menat to not post anymore "take care of buisness" comments online. In the matter of a legal or illegal shooting that involves a "brother" or any intimate persons, i as an investigator, would take your computer. If you do not believe that, even though you delete it, this information is stored and saved, take it to a computer specialist and ask him to retrieve data. I myself save every post and reply here, including this one, for mere factual/legal reasons. For your protection, do not threaten anyone or infer that you will respond to a threat with deadly force ONLINE!!! never a good thing and can bite you. I realize that you have a deep-seeded disdain for those in the legal and law enforcement professions and you surely have your reasons. Living life beyond reproach means not airing "dirty laundry" to "virtual" strangers online. I wish you safety in the future and a resolve to your domestic argument...peacefully!!!!

The 'threat' ie., domestic argument, has been over for years. And if you go back and read what I posted, you would see that I didn't threaten anyone. I was saying that if we are threatened with bodily harm we will be in a position to protect ourselves if need be. We aren't the kind of people to proactively use a weapon of any kind. In fact, even owning a firearm is anathema to either of us...we don't like to even have a gun in our home. But I am legally permitted for a handgun and I am not afraid to say that I am. BTW I am no longer frightened by that certain individual...over the years I have come to pity him instead. What he did to my dh was just the beginning of his loss of everything...home and family.

Yep, it does. It became evident to me and my husband that he is mentally ill, and he continued doing things to his own detriment and in the end he destroyed everything he had hoped to have...and now he has nothing.

Jay Must Stay must be Eric Bellas. Jay is the best thing that has happened to Eric. Eric is Jay's lead prosecutor. Eric is a horrible attorney who couldn't make a living in private practice because nobody likes him. Now he makes a living kissing Jay's ***.

Well..now I AM surprised. Eric Bellas is the prosecutor who refused to do anything about the death threats my husband received while STILL IN THE COURTHOUSE (post #3). I called and went to Mr. Bellas's office at least 5 times after the threats were made, and he wouldn't even return my calls.

Yep. Sounds like Eric "do nothing" Bellas. He and Jay get along real well. Neither of them like to work. At least Eric does try cases even though he loses most of them, unlike Jay who's never tried a case (not even a simple speeding ticket).

ahhh the bitter sting of jealousy!!!!! lol even think that he will get on here and see this...cause ultimately thats what you hope but if asked, I am sure he has never heard of this site...not many have. If it were not part of my job, i wouldve never heard of it!!!!

check out Hickory Daily Record toay. article on Jay Gaither's drunk driving episode. interesting, he admits he and his wife were inthe car. they had been out drinking (it appears heavilyt) with their buddy. wonder what kind of buddy was driving the car?

I just hope that District Attorney Gaither gets the help he needs. AA might be a good start, but looks like a stint in a rehab facility is what he really needs. Go get help before you hurt someone other than yourself.
