If you don't have enough cash to pay a platinum lawyer to unplug a judge's ears and unblock his/her eyes, you may as well wear a clown outfit to court and speak in gibberish, because the outcome would be the same in both cases-you lose!

I agree with the first comment. The parking spot clearly was not safe otherwise her car would not have been damaged. However now people know this landlords name and hopefully will remember not to rent from him.

Seriously though, why wouldn't her car insurance cover this? Or her renter's insurance? Or her ice hazard insurance? Or her AFLAC?
Oh, that's right, you pay into insurance companies for years and when you try to use it, they say sorry, you're not covered for that. Now i remember.

She should claim the damage to her vehicle through her own auto insurance. That is why you have auto insurance. Being poor, and a single mom,(the most overused excuse for EVERYTHING), is no excuse for not being responsible for your self.

I question what kind of liability insurance this landlord has... If my tree blows over during a storm and strikes the neighbors house, my insurance covers the damage.... Sounds to me like her attorney was the jerk here.... She sued under the wrong premise as a tenant and should have sued as an outside party.... If this had happened to someone visiting a tenant would the judge rule the same way???? I don't think so...

If low income she probably did not carry collision (which pays for damage to one's vehcle). Liability, which is required is cheaper. I am a bit surprised at the ruling since the car was on the landlord's property and he didn't clear the roof, it seems he should be liable-guess that is one of those gray areas of the law.
