Salinas police said they are investigating the theft of what was thought to be a military assault rifle from the home of City Councilwoman Gloria De La Rosa.
Whether the gun is considered a true assault weapon under California law depends on whether it features a detachable or fixed ammunition magazine, law enforcement officials said.
If it has a detachable magazine, it's then considered an assault rife and just possessing it is a felony.
If it has a fixed magazine, however, it's just a rifle and is perfectly

Although the SPD determined the weapon is an "illegal" AK47 and therefore subject to felony charges the Salinas D.A. says "no" charges will be filed against De La Rosa.
Well, that's understandable, she's a mexican Salinas council member. The Mayor, the other city council members and the SPD will cover her ass because she's a mexican. Gun laws in Salinas do not apply to the doosh bags that run Salinas. They only apply to the common peons. As the D.A. said, ignorance of the law is no excuse. However, it has now been proven to be a viable excuse for council member De La Rosa.
Nothing like a double standard...
