BTW, in criminal court a trial by jury has to be decided upon unanimously. Of course this would be impossible in the Senate. The outcome for Clinton may have been decided by the election. Had the senate gone to a substantial majority for Republicans he'd have eaten it.

This also separates trial by jury from trial by Senate as the jury is picked by lawyers who base their selections out of experience. The charges heavily influence who a lawyer might strike or pass in terms of basic demographics.

They're the same, only different.
