Topix Post Gets Local Resident In Hot Water

What you post about other people on the website Topix may not be so anonymous after all, is what an Overton County resident recently discovered.

Law enforcement authorities searched a Monroe home on March 6 with a warrant after a two-week investigation was carried out because of a Topix forum post that was traced back to the residence.

“I guess I am in a lot of trouble now,” is what the resident said to authorities when they came to search, stated a recent press release through the 15th Judicial District Drug and Violent Crimes Task Force. The task force covers Jackson, Macon, Smith, Trousdale and Wilson counties.

According to the release, the post said the following:

“We need to get all the people that don’t have popular names together and systematically take out all those Staffords, Mayberrys and Gentrys…But we can spare the judge though,‘cause she’s kind of hot. If we all work together and keep it a secret, we can make it look like the deaths were all accidents. I know that most of the populars are dumber than hell,‘cause let’s face it, if you have that name…You don’t need an education to make it in this town. Who’s with me?”

The post concerned Assistant District Attorney Edwin Sadler, who then contacted the Drug and Violent Crimes Task Force.

Authorities seized several computers, all weapons and other items during the search.

The task force made the following statement in its release:

“For some reason people think that they can create a fictitious name and residence and post something on Topix and law enforcement does not know who they are. Topix is regularly monitored by specialized law enforcement groups, and we know who is making the postings, and at times these postings result in criminal charges and other times they are witnesses to crimes and interviewed by law enforcement. We have interviewed people that made postings months in the past and in some investigations even years later people will be interviewed. This is a situation where someone, like most people who post, thought they could hide behind a computer, scare people and say lies about them and no one would ever know, and it would be funny.”

Agencies involved in the investigation were the 15th District Attorney’s Office, 13th District Attorney’s Office, Overton County Sheriff’s Department, Jackson County Sheriff’s Department and the 15th Judicial Drug and Violent Crimes Task Force.

Charges will be filed against the Monroe resident and brought before the Overton County and Jackson County grand juries at a later date.

They quote the person arrested, but DO NOT name him ?

I dont truct the authority enough to believe EVERYTHING they say.

Contact the 15th Judicial District Drug and Violent Crimes Task Force and ask the name of the person, they are the ones who claim these things.

Also, from what I've learned, these people will not release names until charges are filed / arrests are made.

I have seen much worse on topix than that. Not that he should have said what he did, if he really did. Just saying I have seen people threatened for months and nothing ever done about it. Still walking around free as a bird.

Yep, because they have a shaky case, constitutionally, and they need the plea bargain, or with raiding his home, they gain access to other possible charges. And the original charge is just a way to gain access into your lives.

Its only a matter of time untill WB gets ahold of this cop scheme and uses it himself, always carry a video camera/phone camera with you and insist they have a search warrant before they enter your home or vehicle. The only rights we have left now are our first amendment rights and personally no one should be charged over something that is protected under the constitution. Ill be calling all of the news stations and trying to get some coverage on this but also facebook is a great outlet. The only reason the local law can get away with what they are doing is because A. People dont know what rights they have. B. The sheriffs dept is given far too much authority by a money poor community. C. The newspapers in town are shamefully disregarding the terrible unjust boss hog way overton runs its county. Personally we have several security cameras surveying our property. I always carry a camera with me in my vehicle along side my firearm as well as my permit. If these "special task force officers don't care for my post and try retaliate in any form or way, i will tell all I know to the TBI, CNN, News 5, and my non Livingston lawyer who did more than drive thru the parking lot of a law school. The police force should never intimidate, manipulate, or pursue a vendetta against the people who pay to put the food in their mouths. Eventually its time to say enough is enough and stand for what's really right. An injustice to one of us is an injustice for all of us. How much longer and how much more power are you going to give to the devils hiding behind badges? I am making no threats in this post and am in no way slandering any particular person, hence this message is iron clad safe and lawyer approved. We never forget, we never forgive, expect us.

threatening to kill someone, or trying to convince others to cooperate, isn't protected by the first amendment. it's conspiracy to murder. sarcasm isn't a defense, either.

that said, you're absolutely right about defending your rights. if a cop ever tries to get you to stop recording, let them know that they are NOT PROTECTED by the so-called "wiretapping laws." the courts have repeatedly ruled that any on duty cop is considered a Public Official Engaged in a Public Act and is NOT assumed to have any sort of privacy. recording cops is entirely legal and if they try to stop you they can be sued.
